About this file

This is an Addendum No. 1 for a Request for Proposal (RFP) issued by the Commonwealth of Kentucky's Department for Facilities and Support Services, Division of Engineering and Contract Administration for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) in Adair County. The project involves plugging and remediating seven orphan wells (Permits 89090, 94563, 103154, 104515, 106098, 108218, and N24790) with varying characteristics such as open hole sizes, access conditions, and specific site requirements. The addendum provides clarifications on bidding requirements, including guidance on documenting past performance with federal or state agencies, markup percentages for modifications, and details about conference attendance.

The document includes a disclaimer from the Kentucky Division of Oil and Gas acknowledging that site conditions may vary and that contractors must comply with specific state regulations (KRS Chapter 353.562-564 and 805 KAR 1:060). The wells are located in different settings including pastures, hay fields, and near residential properties, with some requiring additional site preparation like clearing vegetation or excavation. The pre-construction meeting will be held virtually via Microsoft Teams, and contractors are highly encouraged to visit all sites to assess wellsite conditions, plugging procedures, site remediation requirements, and access.

QUESTION: RESPONSE:

1.

In Attachment I, General Requirements, the bullet regarding criteria for contract award requires the following: “past well plugging experience with the Division’s State Plugging Program, or a similar program outside the Commonwealth (provide details)” [bold and italics added]. Attachment T, Past Performance with KDOG requests the “PRIME CONTRACTOR’S

AND SUB-CONTRACTOR'S PAST PERFORMANCE WITH KDOG:

Provide summary examples of Prime and Sub-Contractor’s past performance with the Kentucky Division of Oil and Gas (KDOG) Federal Plugging, State Plugging or Tank Remediation programs.” Should we include our experience with other federal or state plugging and tank remediation programs in Attachment T, or only our experience with KDOG? Will experience with federal or state agencies other than KDOG contribute to achieving the maximum 6 points available for this criterion?

Attachment Q should be used to describe experience with federal or state agencies other than Kentucky Division of Oil and Gas (KDOG).

Attachment T should be used to describe experience with the Kentucky Division of Oil and Gas (KDOG).

2.

Would the State please clarify the combined percentage limit of 15% for modifications given in Subsection 14.1.3 under Section 14, Changes in the Work / Change Orders? Does this refer to overhead for labor rates (including fringe, income taxes, retirement contributions, etc.) or to general overhead costs?

It's a 15% markup on the labor and materials costs.

Subsections 31.1.1, 31.2.1 and 31.3.1 under Section 30, Allowances, states that attendance at the Pre-Construction, Installation, and Progress conferences is mandatory for personnel including the Contractor and his Project Manager, in addition to the Job Superintendent, key personnel, and all major subcontractors. Please confirm that these conferences will be held remotely via Teams, Zoom or another virtual platform and that the Contractor’s Project Manager is not required to attend in person on site. We note that Subsection 8.10, Contractor’s Project Manager, under 8, Supervision and Construction Procedures, includes the following statement: “This Project Manager is not required be present on site at all times that Work of this contract is underway, but shall be intimately familiar with the status of the Work of the Project at all times.”

The Pre-Construction meeting will be held via Microsoft Teams.

4. In Section 40, Procurement Requirements, the end of the second paragraph under 40.19, Patent or Copyright Infringement, is cut off. Would the State please provide the complete statement?

The Commonwealth agrees to notify the contractor promptly, in writing, of any such claim, suit or proceeding.

QUESTION: RESPONSE:

5. Adair County #001 - RFP 785 2500000319, Permit 103154 states, “Well needs to be left where it can be cut off several feet.” Would the State please elaborate on or explain this statement further?

The Landowner has requested the casing and cement level be a few feet lower than surface level. This specific well bore/casing will need additional excavation at plugging to allow casing cutoff at minimum 6 feet depth below surface. Contractor will work with KDOG inspector and landowner to address.
