About this file

This is an Addendum to Invitation to Bid No. FFS 24 25 118 issued by the Florida Department of Agriculture and Consumer Services (FDACS) on February 12, 2025, for the Myakka State Forest Road Project. The ITB is specifically for the purchase of shell road base materials, and this addendum provides answers to five vendor questions. Key clarifications include that bidders are not required to have a general contractor's license but must be registered as active vendors with the State of Florida and comply with all applicable laws.

The addendum addresses questions about authorized representatives, including foreign representatives and documentation requirements. FDACS clarified that no specific documentation is required to evidence authority to bind the company, but foreign companies must provide proof of authorization to conduct business in Florida. For questions about subcontracted trucking companies, bidders are directed to review section 4.14 of the ITB. Questions regarding the addendum can be directed to the Purchasing Office at (850) 617-7181 or Bids@FDACS.gov.

ADDENDUM I

DATE: February 12, 2025

TO: VENDORS

FROM: Britne’ Hill, Procurement Officer

RE: Invitation to Bid No. FFS 24 25 118 Myakka State Forest Road Project

This addendum is to provide answers to questions received in reference to this Invitation to Bid.

Question / Answer

1. It is necessary to have a license as a general contractor to participate in this process.

This Invitation to Bid (ITB) is for the purchase of a commodity (shell road base materials).

Bidders are not required to have a general contractor’s license to participate; however, Bidders must be registered as an active vendor with the State of Florida, and comply with all federal, state, and local laws required to conduct business in the State of Florida.

2. What specific documentation is required to verify that the authorized representative has the legal authority to bind the company in this procurement process, or solely for signing the Attachment A - Acknowledgment Form?

The Department does not require any specific documentation to evidence this authority.

3. If the authorized representative holds legal documents from Colombia (such as a notarized power of attorney or a Certificate of Legal Representation), would these be acceptable? If so, would they need to be apostilled?

See response to Question No. 2 above.

4. Are there any additional requirements or steps that a foreign-authorized representative must comply with to meet ITB submission standards.

The Department cannot provide legal advice to potential bidders. Please consult an attorney for all of the specific legal requirements for a foreign-authorized representative or international company to conduct business in the State of Florida. Proof that the company is authorized to conduct business in the state should be provided with its ITB documents.

Follow all the directions and return all the required documents as specified in the ITB.

5. We would use subcontracted trucking companies to deliver this material. Please confirm that this would be acceptable and if so, under what conditions listed in the paragraph.

See section 4.14 of this Invitation to Bid.

This Addendum is hereby incorporated into and made a part of the above noted Invitation to Bid.

All other terms, conditions and specifications of this Invitation to Bid will remain the same. For questions regarding this Addendum, please contact the Purchasing Office at (850) 617-7181 or email at Bids@FDACS.gov.
