About this file
This document is an addendum to FAR clause 52.212-1 providing instructions to offerors for commercial products and commercial services solicitations.
The Government will award the contract to the responsible offeror whose conforming offer is most advantageous considering price and other factors. Offerors must consent to all solicitation requirements, terms, conditions, representations, and certifications by submitting an offer, and failure to meet requirements may result in non-responsive determinations. Offers must be signed, dated, and submitted to the specified office by the exact deadline. Pricing must be submitted on Standard Form (SF) 1449, with unit price and extended price for CLINs 0001 and 0002, plus a total price on page 3. Offerors must provide solicitation number, receipt deadline, company name/address/phone number, technical description of items with sufficient detail to evaluate compliance (including product literature if necessary), express warranty terms, price breakdown, discount terms, remit-to address if different from mailing address, current SAM.gov registration validation with mandatory Cage Code and optional DUNS number, and acknowledgment of solicitation amendments. Offers lacking required representations, information, or rejecting solicitation terms and conditions will be excluded from consideration. Offerors must hold prices firm for 60 calendar days from the offer receipt date unless a different period is specified in an addendum, and must clearly identify the offer expiration date. Products submitted as "equal items" must be clearly identified with supporting product information provided. Completion of SF 1449 blocks 12, 17a, and 30a, b, and c constitutes the offeror's accession to contract terms and conditions as written, with the solicitation serving as the model contract.
