About this file

This is Addendum 2 with questions and answers for Bid Number 6024-004 DPR Onyx Ranch Abandoned Mine Remediations project from the California Department of Conservation. The document clarifies that contractors must have three references of relevant abandoned mine remediation work to qualify, requires MSHA Form 5000-23 (40 hours) certification for the jobsite foreman, and specifies that the pipe for Task 5 shall be 6' long and 48" in diameter. The addendum provides KMZ files for site locations and allows separate line items for helicopter mobilization and demobilization with a revised bid sheet.

The addendum addresses wage determinations, noting that contractors should use rates that best match the work being performed, with guidance to contact the Division of Labor Statistics for updated 2025 rates. It also clarifies monitoring requirements, stating that one tribal monitor from the Kern Valley Indian Community must be present for all ground-disturbed activities, along with a State Parks staff archaeologist. The work can continue if the tribal monitor is not present, though they should be notified of work schedules and are responsible for their own transportation to work locations.

Department of Conservation Bid Number 6024-004 DPR Onyx Ranch

Addendum 2 December 12, 2024

ADDENDUM 2 QUESTIONS AND ANSWERS

1. We have never worked for abandoned mines or installed bat gates, which are very straightforward. Can we bid on this job?

The Bidder Minimum Qualifications requires contractors to submit three references of relevant abandoned mine remediation work performed, so contractors with no experience would not meet the minimum qualifications.

2. As per John's conversation at the pre-job walk, we can submit MHSA certificates after the bid opening. What if we are the lowest bidder?

The Required Attachment Checklist lists a copy of MSHA Form 5000-23 (40 hours) for the jobsite foreman only, so contractors without this could not submit a complete bid.

3. In your previous response you provided KMZ files for the routes, can we get the

KMZ for the sites on this project?

Yes, see file OnyxRanchMineClosures.kmz.

4. On the pipe for Task 5, have you determined the size of pipe to be installed or is it up to the contractor?

As per Addendum 1, the pipe shall be 6’ long and 48” in diameter.

5. For safety reasons, a helicopter will likely be required, can we add a line item for mobilization and one for demobilization?

Yes. We can accept a separate line item for mobilization and demobilization.

Please use revised bid sheet.

6. You listed 2 different wage decisions that cover fencing, which one would you prefer we use? The pay rate is nearly identical between them.

The contractor should use the wage determination for the position that best describes the work being performed.

7. The wage decision for Iron Worker C-20-X-1-2024-1 expires on 12/31/24 Has DIR notified you in regards to the planned rate for 2025? What labor rate should we anticipate?

The rates are effective until superseded by a new determination issued by the Director of Industrial Relations. The contractor should contact the Division of Labor Statistics and Research at (415) 703-4774 for the new rates after 10 days from the expiration date, if no subsequent determination is issued. More information can be found at www.dir.ca.gov.

8. This project requires 2 monitors that are separately contracted by the State. Are they required to be on site at ALL times? Are they able to approve us to work independently once we have shown the necessary experience for the sites? IF we must wait for the monitors to arrive on site, is there a way to establish a contingency fund that is only accessed in case there is an issue for weather or https://gcc02.safelinks.protection.outlook.com/?url=http%3A%2F%2Fwww.dir.ca.gov%2F&data=05%7C02%7CSamantha.Brooks%40conservation.ca.gov%7C37ab873480cf4ffcb9c708dd18b16ad5%7C4c5988ae5a0040e8b065a017f9c99494%7C0%7C0%7C638693872955723388%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=gslXjEYtlp7%2FmB2L%2B3dHBZCnKJ19JxZHUuha7rPDduo%3D&reserved=0

Addendum 2 December 12, 2024 vehicle trouble or anything that prevents them from being on site at the previously agreed upon time. Otherwise, the contractors are at the mercy of an arrangement where they incur costs that are unplanned and unrecoverable without a contingency fund or something similar.

One tribal monitor representing the Kern Valley Indian Community (KVIC) shall be present for all ground-disturbed activities related to this project. This includes excavating soil, drilling of bedrock, and any backfilling. They should be present for the work unless the monitor indicates to the project supervisor or State Parks representative that monitoring is no longer needed for the day or project. A State Parks staff archaeologist will also be on-site to provide monitoring support.

The tribal monitor will only focus on the groundwork and identification of tribal cultural resources (artifacts), so that impacts on the resources are mitigated.

They will not review or approve the contractors’ credentials to be on-site.

The tribal monitor should be notified of the start and end of the work time. In return, the tribal monitor should inform the project supervisor or State Parks representative of any emergency or late arrival. The tribal monitor should be made aware of park road conditions and is responsible for their transportation to each work location and may coordinate with State Park staff if space and parking on-site is limited.

The work plan should continue if the tribal monitor is not present.
