Addendum 2 to RFP-258-24: Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program
This is Addendum No. 2 to a Request for Proposal issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Package J located in Hollerwood, Stanton, Kentucky (Powell County). The project involves the removal and remediation of an abandoned tank battery site designated as T000696, which contains multiple steel and fiberglass tanks ranging from 20 barrels to 500 barrels in capacity, along with associated infrastructure including separators, hoppers, piping, a pump house, a shop building, and contaminated soil. Contractors are responsible for tank removal, infrastructure decommissioning, contaminated soil remediation, site grading, drainage establishment, and area stabilization in accordance with Kentucky state statute (KRS Chapter 353.562-564 and 805 KAR 1:190). The addendum provides revised Attachment H containing site-specific information, including an estimated contaminated soil removal quantity of approximately 100 cubic yards in a 100-foot by 25-foot area and an additional 10 cubic yards from miscellaneous other areas across the site. Contractors are encouraged to conduct site visits to assess conditions, tank contents, and material removal procedures prior to bidding. Addendum No. 1 included 27 question-and-answer responses addressing contractor inquiries regarding sampling procedures, quantity estimates, electrical deenergization, asbestos presence, contaminated soil removal parameters, job office requirements, and insurance coverage provisions.
The contract is structured as a firm-fixed price agreement with the Commonwealth of Kentucky reserving the right to delete individual tank sites and adjust pricing accordingly. Contractors must provide their own estimates for all tank contents (sludge, bottom sediment, oil, and water) and are responsible for determining contaminated soil removal limits through field assessment and photographic documentation. The state declined to provide specific quantity breakdowns, removal depth limits beyond the statutory three-foot maximum, or design specifications for site reclamation and best management practices, requiring contractors to exercise professional judgment based on site conditions and past experience. Key requirements include ensuring electrical power deenergization, compliance with all applicable state and federal disposal laws for hazardous materials including potential asbestos, providing three-day advance electronic notice for insurance coverage changes, and listing the Commonwealth of Kentucky Division of Engineering and Contract Administration as certificate holder for additional insured endorsements. Builders' Risk coverage is not required; Self-Insured Retention for Commercial General Liability is fixed at $100,000 and cannot be modified. The Kentucky Tax Registration Application (Form 10A100) may be completed either prior to bid submission or upon award.

RFP 258-24
Kentucky Energy and Environment Cabinet Addendum No. 1
QUESTION: RESPONSE:
1. The Chain of Custody notes for the TENORM sampling designates samples as “soil” and “sludge”. Can KDOG explain the difference between the two sample designations?
a. Is “soil” from outside the tank?
b. Is “sludge” from inside the tank?
"Soil" is outside the tank and "Sludge" is inside the tank.
2. Can KDOG provide a quantity estimate for each of the wastes expected to be generated from the Site?
a. Soil
b. Sludge/Bottom Sediment
c. Oil
d. Water
No, KDOG cannot provide this breakdown. However, KDOG has revised Attachment H (page 7) and provided a contaminated soil removal estimate. All tank contents (sludge/bottom sediment (BS), oil and water) shall be independently quantified by the Contractor.
3. If KDOG cannot provide quantity estimates, are we the Contractors allowed on Site to make these measurements ourselves?
Contractors are highly encouraged to visit all of the tank sites to assess tank and material removal procedures, site remediation requirements, reclamation criteria, and available access to the tank facility.
4. Should we the Contactors estimate one (1) foot of soil will need to be removed from each area of visibly oil-stained soil?
Contractors should estimate based on past experience and personal site assessment.
5. We see that the soil sample from the Weir Dam (WDS-12) revealed elevated concentrations of TENORM. However, only one (1) soil sample was collected. Should we the Contractors collect three (3) additional soil samples, one from each of the separate areas, in order to potentially reduce the amount of soil waste that would need to be disposed of Out of State?
There is no set number of samples required; only that all materials leaving the property must have been prior sampled to assure proper disposal. Contractors should sample the site according to their best judgment, with the goal to limit soil extraction activity to the minimum needed for weir removal, grading for drainage, and stabilization. It is not required to excavate all material in the catch basin, only enough to complete the scope. Contractors indeed should segregate the removed materials then to minimize special disposal requirements.
Kentucky Energy and Environment Cabinet Addendum No. 1
QUESTION: RESPONSE:
6. Will KDOG be responsible for shutting power and disconnecting the electrical line(s) to the Pump House and the Shop Building?
a. Would we the Contractors confirm electrical power is removed through the KDOG Inspector?
The Contractor will be responsible to ensure all electrical power is deenergized from the facilities, and the area is properly and safely prepared to perform the Scope of Work.
7. Is there asbestos within any of the structures on the site? This is unknown.
8. If there is asbestos within any of the structures on the site, what are the requirements for addressing asbestos?
Any materials to be disposed during the site cleanup process must follow requirements of state and federal laws.
The KY Division of Waste Management may be able to provide direction on compliant disposal of such material.
9. Have all electrical lines been disconnected? The Contractor will be responsible to ensure all electrical power is deenergized from the facilities, and the area is properly and safely prepared to perform the Scope of Work.
10. Can the state please let us know what the contents and volumes are in each tank?
No, contractors should perform their own assessments.
11. Can the state please let us know what the contents and volumes are in separators, treaters, and tanks?
No, contractors should perform their own assessments.
12. Can the Owner clarify what the existing soils are contaminated with? No, contractors can sample to assess and determine their own findings.
Kentucky Energy and Environment Cabinet Addendum No. 1
QUESTION: RESPONSE:
13. Can the Owner provide removal limits (i.e., width, length, and depth) for all contaminated soil areas? Can the state also provide a total quantity for contaminated soil that all bidders can bid too? With an owner provided quantity the contractors will not need to guess quantities and therefore the state will get the best price.
No, KDOG does not provide removal limits, those must be field proved by the contractor. KDOG has revised Attachment H (page 7) to provide an estimated soil removal tonnage, please see revised Attachment H (page 7) attached to this Addendum.
14. In Attachment D, Bid Document, it states If soil contamination is confirmed and approved (by the Inspector) above the estimated amount shown on the Attachment H, the contractor specifies in this proposal the firm all-inclusive rate of $________________(insert amount) per additional ton of contaminated soil removed and transported to an approved disposal site. Attachment H does not list a tonnage quantity.
Can the Owner provide the tonnage quantity for this project?
KDOG has revised Attachment H (page 7) to provide an estimated soil removal tonnage, please see revised Attachment H (page 7) attached to this Addendum.
Contractors are highly encouraged to visit all of the tank sites to assess tank and material removal procedures, site remediation requirements, reclamation criteria, and available access to the tank facility.
15. After contaminated soil removal is the contractor required to bring in new soil to replace what was removed from the site? If so, can the Owner provide this quantity of material?
The tank site once remediated shall be graded, positive drainage established and all disturbed areas seeded, as summarized in Attachment G (Site Reclamation and BMP’s).
16. Can the Owner verify that contractors are to remove contaminated soil up to 3’ in depth? Attachment H states 6” - 12”. However, Attachments F and G states 3’.
The 3 feet reference is from the KASTOW Program Statute;
Attachment H is an actual site estimate by KDOG. It is the Contractor's responsibility to remove contaminated soil. Any expansion of the removal area should be documented by photos and field markup of the Project Sketch, which markup the contractor shall provide to the Division before completion of the work.
(Visual evidence of crude oil and/or brine discharge below a depth of three (3) feet shall cause suspension of the reclamation project, until the Department of Environmental Protection/ ERT group can investigate and determine if additional steps are required.
Kentucky Energy and Environment Cabinet Addendum No. 1
QUESTION: RESPONSE:
17. In Attachment D, Bid Document, it states The Request for Proposal contemplates a firm-fixed contract. However, the Division reserves the right to delete individual tank sites from the Project Scope and adjust the contract price accordingly. Is the Owner requiring further cost breakdown of this one tank site? If so, can the State provide the detailed cost breakdown?
No. KDOG is not requiring further cost breakdown of the tank site.
18. It is stated in Attachment A, under the General Conditions section 8.11 Temporary Support Facilities Required: The Contractor shall provide temporary job offices for use by the Job Superintendent, A-E, Resident Observer (if applicable) and the Owner during the course of construction from the time of commencement of the Work until Substantial Completion. Provide electric, water, HVAC internet access and telephone for all areas of the temporary job office. This job office shall be large enough to accommodate project meetings and to provide for construction management operations. Where a Resident Observer is utilized on the project, a separate office shall be provided for the Resident Observer’s use with electric, water, HVAC, telephone, and internet access. This project will have a short construction period, so will this requirement be required for this project? The Internet and phone services for this project will be expensive to provide. Will a Resident Observer be provided for this project?
No, this is not required for this project.
19. In Attachment G it states the site to be backfilled with earthen material to establish grade. Can the Owner provide this quantity of material? Also, Attachment G states to use BMP’s for erosion prevention, water runoff control and sedimentation control. Can the Owner provide a design drawing showing what is required for site reclamation and BMP’s?
No further details will be provided. The tank site once remediated shall be graded, positive drainage established and all disturbed areas seeded, as summarized in Attachment G (Site Reclamation and BMP’s).
Kentucky Energy and Environment Cabinet Addendum No. 1
QUESTION: RESPONSE:
20. Can the state provide the third weir's location? It was not visible during the site walk.
Contractors are highly encouraged to visit all of the tank sites to assess tank and material removal procedures, site remediation requirements, reclamation criteria, and available access to the tank facility.
21. 14.1.1.1 appears to be missing language in the first sentence. Can you ask a question to verify? 14.1.1.1 In specific instances where the progress of the Work would be negatively affected by a delay in the Work while a fully executed Change Order is being processed. This does not apply to this solicitation
22. Contract Documents references “Special or Supplemental Conditions”, are there any? If so, can the agency please provide? There are none
23. Would the agency consider allowing the following changes to 24.4.1 Commercial General Liability - $1,000,000 combined single limit per occurrence for bodily injury, personal injury and property damage with a $3,000,000 $2,000,000 annual aggregate. The deducible or Self-Insured Retention per occurrence shall not be more than $10,000. SIR is $100,000 and cannot be changed. This requirement will remain as is.
24. Under section 24.5.2 All Coverages, 30 days’ prior notice is required for any changes in insurance coverage. Per the section written notice by certified mail with return receipt is required, would electronic notice be acceptable? Yes electronic notice will suffice
25. Will Builders’ Risk coverage be required under the contract? Builders' Risk is not required on this project
26. Additional insured is on a blanket basis – individuals are not “named” on the endorsement. Is this acceptable? Commonwealth of KY, Division of Engineering & Contract
Administration must be listed as the certificate holder
Kentucky Energy and Environment Cabinet Addendum No. 1
QUESTION: RESPONSE:
27. 21.Do potential bidders need to complete the Revenue Form 10A100
Kentucky Tax Registration Application to bid? Or can we plan on completing upon award if project is awarded?
This can be completed by the successful bidder prior to award.
