About this file
This document is Addendum #2 to Request for Proposal (RFP) 20-5710 for Truck Scale Replacement issued by Guadalupe County Purchasing Agent in Seguin, Texas. The addendum, dated February 26, 2020, provides clarification to potential proposers and does not change the original proposal due date of 2:00 pm CST on March 4, 2020. The addendum addresses three key questions from potential bidders, including clarifications on worker's compensation requirements for subcontractors, contract termination provisions, and permit and licensing requirements for the truck scale replacement project.
The addendum specifically clarifies that subcontractors must provide workers' compensation insurance coverage, confirms a standard 90-day contract termination clause that allows either party to cancel with written notice, and indicates that no additional permits or licenses are required for this project. The document requires proposers to acknowledge receipt of the addendum by returning it signed as part of their sealed proposal, and it incorporates the new information into the original RFP documents, superseding any previously issued conflicting information.

1. This addendum does not change the due date of the proposals. Sealed proposals must be received in the Purchasing Office by: 2:00 pm CST on March 4, 2020.
2. The following questions and answers provide clarification to the RFP:
a. For Subcontractors, in lieu of providing Worker’s Compensation, is it acceptable for a sub-contractor submit a Joint Agreement to Affirm Independent Relationship For Certain Building And Construction Workers? ANSWER: On page 9 of the RFP, in section 1.2.19., The County requires that the Proposer awarded the contract maintain in force such insurance that will protect themselves and the County from claims which may arise out of, or result from the execution of, the work whether such execution be by themselves, their employees, subcontractors, or by anyone for whose acts may be liable. Also, Texas Workers' Compensation Act, Texas Labor Code Sec.
406.096. REQUIRED COVERAGE FOR CERTAIN BUILDING OR CONSTRUCTION
CONTRACTORS. (a) A governmental entity that enters into a building or construction contract shall require the contractor to certify in writing that the contractor provides workers' compensation insurance coverage for each employee of the contractor employed on the public project. (b) Each subcontractor on the public project shall provide such a certificate relating to coverage of the subcontractor's employees to the general contractor, who shall provide the subcontractor's certificate to the governmental entity.
b. On page 10 you state that “Either party may terminate this contract with ninety (90) days written notice prior to either party stating cancellation. The successful Proposer must state therein the reasons for such cancellation. Prior written notice must be delivered in person or sent by registered or certified mail, return receipt requested, proper postage paid, and properly addressed to:
Guadalupe County Judge, 101 E. Court, Room 319, Seguin, Texas 78155.” Can you explain this statement? This seems to leave an open window for cancellation by one party or the other after work has begun on the project. ANSWER: This is a standard clause in government contracts.
