About this file

This document is Addendum Number Three for the Little Red School House CM/GC Project, issued by the Town of Snowmass Village on January 23, 2025. The addendum provides critical clarifications for potential contractors bidding on the Construction Management/General Contractor (CM/GC) services for an early childcare center expansion project. The document addresses various bidding questions, including budget confirmation, general conditions interpretation, contingency percentages, profit and overhead calculations, construction management service continuity, bid form completion requirements, permitting expectations, and tax exemption status.

The project has an established overall budget that will be shared with the selected CM/GC contractor, with only pricing for the Construction Documents phase currently required. The project is tax exempt for local and state sales taxes, and permit fees will be covered by the Town. Contractors are expected to obtain local business licenses and create necessary permit submittal documents. Construction Management services are intended to continue through both the preconstruction and construction phases, with the Construction Management fee expected to be included in general conditions. Bidders are advised that not all bid form lines must be completed with both price and percentage, but a cost for the Construction Management scope is mandatory.

Little Red School House CM/GC Project

ADDENDUM NUMBER THREE

January 23, 2025

THE FOLLOWING REVISIONS, JUDGEMENTS, RULINGS AND

CLARIFICATIONS SHALL BE INCORPORATED INTO THE RFP KNOWN AS

Little Red School House PROJECT.

“The judgments, rulings, clarifications and definitions presented in this Addendum shall become a binding portion of the Contract Documents and shall take precedence over all other parts of the same Contract Documents.”

1. CLARIFICATION (Answers in BOLD)

(a) Is there an established budget/FLC for this project?

This information will help ensure our bid aligns with project expectations.

Yes, the project has an established budget. The budget will be shared with the selected CM/GC contractor. Only pricing for Construction Management for the Construction Documents phase is required at this point and there is no specific budget line item for this scope just the overall project budget including construction.

(b) Can you clarify your definition or interpretation of "General Conditions"?

Since definitions can vary between agencies acquiring CM/GC services, this clarification is critical to avoid discrepancies in pricing. General Conditions are defined within the AIA contract. The CM scope is outlined within the RFP.

(c) Are there specific items you would like explicitly included or excluded from

General Conditions? Identifying these will help ensure consistency in our bid submission. See AIA contract, specifically AIA Document A201.

(d) The bid form references "Contingency carried at 100% Construction

Documents/Guaranteed Minimum Payment."

Was this intended to be "Contingency carried at 100% Construction

Documents/Guaranteed Maximum Price"? Please confirm. Yes, this is the percentage of contingency at time of Guaranteed Maximum Price.

(e) On the bid form line labeled "Contractor Profit & Overhead," should this include:

i. Profit and Overhead for preconstruction services and General Contractor fees for construction phase services? Or just Profit and Overhead for the

General Contracting portion of the construction phase services? Just profit and overhead percentage for the General Contracting portion of the project.

(f) Will Construction Management (distinct from Project Management) services continue through the construction phase, or will the contract transition solely to

General Contractor services during this phase? According to the referenced AIA

Document A133–2019, Owner/CMC Agreement it appears the intent would be for

Construction Management to continue through the construction phase.

Construction Management would continue through the GC phase as well.

(g) If this is the case, would you like to see a Construction Management fee for the construction phase? Or where would you like that fee to be included? We would expect this to be included in the general conditions.

(h) Must all lines of the bid form be completed with both a price and a percentage?

Without a project budget or construction cost, it may be challenging to provide both. Is it acceptable to complete only the field(s) that make sense? Yes, please ensure a cost is included for the CM scope. Other items can be a percentage or a cost, whichever makes more sense to the contractor.

(i) For the bid form line labeled "Permitting," could you clarify what is expected?

Are you requesting the General Contractor's fee to acquire building permits, or is additional scope implied? Permit fees will be covered by the Town. Local contractors and business licenses would be required and the responsibility of the contractor to obtain. This line item would also include creation of a

CMP and other required documents for the permit submittal package.

(j) Is this project tax exempt? Yes. And if so, what taxes are exempt? Local and state sales tax.
