About this file
This document is an Addendum (#2) to the Invitation to Bid (ITB) #23-053-G for Low Lead Brass Fittings issued by Eugene Water & Electric Board (EWEB), a utility serving the city of Eugene and Lane County, Oregon. The addendum provides clarification on the warranty expectations, the 3% annual price increase limitation, and the process for proposing revisions to the contract terms. The solicitation seeks bids from interested companies to provide low lead brass fittings on an as-needed basis to EWEB.
The addendum notes that the 3% annual increase limitation is not automatic, and the contractor will need to provide material and supporting documentation for EWEB to consider any requested rate increase. Bidders have the option to propose revisions to the contract terms, but EWEB may accept or reject such proposals, and the award may go to the next lowest bidder if EWEB cannot accept the proposed terms. The bid due date remains unchanged, with the closing date set for May 3, 2023.

ADDENDUM # 2
Low Lead Brass Fittings
ITB #23-053-G
This addendum modifies the bidding document(s) for work only to the extent indicated herein. All other areas not specifically mentioned or affected by this addendum shall remain in full force. This addendum shall be added as a part of the original bidding document and shall become part of the work required.
QUESTION & ANSWER
1. In Atachment A, Terms and condions, A.5 states “Contractor warrants all goods delivered to be free from defects……” Is EWEB asking for warranty beyond the standard manufacturer’s warranty?
To clarify the expectation, warranties assure repair or replacement of deliverables within a specified period of time should the deliverables turn out to have defects, shortcomings, flaws, or abnormalities that impair the quality of the item before the warranty expires.
2. The Example Contract - Secon 4 seems to state that the Contractor is limited to a 3% annual increase. Current price escalaons frequently exceed 3% in today’s volale market. Can you expand on this?
EWEB notes that inflation increases have been slowing significantly as the Federal Reserve slows its increase of interest rates, compared to 2022. The 3% is not an automatic increase; material, supportive documentation is required for EWEB to review a requested rate increase and hopefully the awarded Contractor can work with the manufacturer and help manage how increases are distributed between manufacturer/distributor/Owner. Bidders do have the option to propose revisions to the terms per section 1.7 of the ITB. They are only to be made at time of bid submission and per the section, EWEB may accept or reject.
For clarification, per Section 1.22 of the ITB, if the Bidder offering the lowest price proposes terms revisions that EWEB is not able to accept, the bid will be rejected and the award will be offered to the next lowest Bidder until a contract can be executed.
