About this file
This Addendum #1 document contains supplier questions and answers for RFP-25-017, issued by the City of Fairburn, Georgia on October 1, 2025, for On-Call Professional Engineering and Landscape Architectural Services. The scope includes landscape design and plan review services but excludes installation or spray work. The City reserves the right to award the contract to multiple firms. Responses are due by 2:00 p.m. on Thursday, October 30, 2025, at the City of Fairburn Administration Building located at 314 NW Broad Street, Fairburn, Georgia 30213. Technical questions must be submitted in writing via email to purchasing@fairburn.com by October 17, 2025, at 5:00 p.m. The final awardee(s) will be notified following the evaluation process; no shortlist of interviewed firms will be published. Respondents must submit proposals not exceeding 15 pages, excluding cover pages, divider pages, tables of contents, and resumes of key personnel. A minimum of three client references is required, with five preferred, for similar services within the past five years.
There is no estimated contract budget. Firms may consist of landscape architects without civil engineers in-house, though firms with both disciplines are preferred. The City accepts statements attesting to the absence of conflicts of interest in lieu of detailed conflict disclosures. Proposals should include resumes of all professionals proposed for the team. Questions and answers will be posted to the BidNet Direct portal, and all registered suppliers will receive notification of availability. Regarding indemnification provisions, any modifications to the standard language requiring defense and payment of attorney fees will be conducted during the contract negotiation period following award. Issuing Officer Attlee Billings should be contacted via email at attlee.billings@fairburn.com for additional information.

11. Page 4, in the "SCHEDULE" table, lists "Responses to Written Questions" with a date of "10/24/25" and a time of "5:00 p.m. ET." Please clarify where these questions and responses will be posted or how they will be distributed to interested parties.

12. As part of all our municipal contracts in Georgia, we are used to agreeing to indemnification statements, but in this case, the statement requires us to "defend" and pay for attorneys, etc. for others, such as the City, from cases that arise from the regular delivery of our services, which might include where we do everything correctly and as we should, and we aren't negligent, willful, at fault, etc. Can it be modified so that our duty to defend is for negligent, willful acts or omissions, so we aren't paying for the attorney costs of the City or others when we aren't at fault? This type of modification would be needed to be in compliance with the Georgia House Bill 983 that was passed in 2016 to cover negligence and such indemnification statements for design services like these.
Any modifications will be conducted at the request of the successful respondent during the contract negotiation period.
