About this file
This is Addendum No. 1 issued by the Nebraska Department of Transportation for Project No. NH-83-4(124), Control No. 81114, Call No. 805, covering US-83, S-16B, and US-20 resurfacing work in Cherry County with a letting date of October 1, 2026. The addendum voids and supersedes the Asphaltic Concrete Pavement Smoothness provision (5-7-0126A) on pages 154-169 of the Special Provisions, replacing it with a revised provision (5-7-1026) that specifies smoothness measurement standards and correctable defects including bumps, dips, and segments. The addendum also voids the Concrete Surface Milling for Bridge Deck & Approaches provision on page 173. Additionally, the addendum introduces a Contractor Use Site provision addressing American Burying Beetle (ABB) mitigation for off-project operations including borrow sites, waste sites, and material staging areas. The document establishes that contractors unable to locate suitable sites without ABB habitat disturbance may utilize Nebraska Department of Transportation mitigation credits at a cost of $6,000 per acre based on a 1.5-acre impact ratio for every 1.0 acre disturbed. Finally, the addendum amends Subsection 510.04 of the Standard Specifications regarding Concrete Surface Milling, requiring waterblasting equipment to clean milled pavement surfaces and establishing restrictions on debris entry into waterways and drainage inlets, with all salvaged material becoming contractor property.
The mitigation credit option requires formal submission of requested contractor use sites through established approval processes, documentation of estimated acres of ABB habitat disturbance, confirmation that sites conform to resource agency criteria, and evidence that alternative sites avoiding ABB habitat disturbance are either unavailable or not reasonably proximate to the project. The Department will conduct a site visit upon project conclusion to assess actual disturbed acres and calculate final mitigation costs, which will be deducted from contract monies owed. All use of mitigation credit acres must receive written Department approval prior to commencement of project-related activities. The concrete surface milling work shall be performed after concrete repair work, with all concrete required to be completely dry before asphaltic concrete placement.

On pages 154 to 169 of the Special Provisions, the provision titled ASPHALTIC CONCRETE PAVEMENT SMOOTHNESS (5-7-0126A) is void and superseded by the following:
ASPHALTIC CONCRETE PAVEMENT SMOOTHNESS

On page 173 of the Special Provisions, the provision titled CONCRETE SURFACE MILLING FOR BRIDGE DECK & APPROACHES is void.
The Special Provisions are amended to include the following:
CONTRACTOR USE SITE
(American Burying Beetle Mitigation Option)
The Contractor shall furnish suitable sites for the off-project operations necessary to construct the project in accordance with the contract requirements. Contractor Use Sites may consist of borrow sites, waste sites or other sites necessary for the staging or stockpiling of materials or equipment.
This project is located within an area that contains habitat generally suitable for the American Burying Beetle (ABB).
If the Contractor cannot locate Contractor Use Sites that do not require mitigation for disturbance of suitable ABB habitat - as determined during the site approval process - the NDOT may allow the Contractor the option to utilize NDOT mitigation credit at a cost of $6,000 per acre operating, and maintaining the mitigation site. The cost is calculated based upon the permanent impact ratio of 1.5 acres for every 1.0 acre disturbed.
Eligibility to use NDOT mitigation credit acres will be based on the following criteria:
1. Requested Contractor Use Sites have been formally submitted using the site approval processes described in the contract.
2. The Contractor shall include an estimated number of acres of ABB habitat disturbance with each site request.
3. The proposed sites conform to resource agency criteria and can be permitted except for the mitigation required for impacted suitable ABB habitat.
4. The Contractor provides documentation demonstrating that:
a. No Contractor Use Sites are available that would avoid disturbance to ABB habitat, or
b. Alternative Contractor Use Sites that do not impact ABB habitat are not located within reasonable proximity to the project.
5. NDOT approves the use of mitigation credits from the mitigation bank site.
NDOT will perform a site visit at the conclusion of project to assess the actual disturbed acres of suitable ABB habitat for each site approved to use mitigation credits. NDOT will measure the disturbed acres and calculate the final mitigation cost based on this assessment. The final cost will be deducted from monies owed on the contract.
The use of the NDOT mitigation credit acres must be approved in writing by the Department prior to allowing any project related activities to take place on the proposed Contractor Use Site.
The Special Provisions are amended to include the following:
CONCRETE SURFACE MILLING
Subsection 510.04 of the Standard Specifications is amended to include the following:
The Contractor shall use waterblasting equipment operated with sufficient consistent pressure to effectively clean the milled pavement surface of all dirt, foreign materials, loose surfacing material, and any residue before placement of the asphaltic concrete overlay. Care shall be taken to prevent any debris or construction materials from directly entering, or entering any inlets on the project that lead directly to:
1. waterways.
2. poorly vegetated ditches, or
3. Well-vegetated ditches having less than 200 feet between the conduit outlet and the point of discharge of the ditch into a waterway.
Inlets shall not be blocked or otherwise restricted in such a way to cause water to collect within an active traffic lane.
The concrete must be completely dry before placement of any asphaltic concrete on these areas.
Paragraph 10. of Subsection 510.04 of the Standard Specifications is void and superseded by the following:
10. All material salvaged from this operation shall become the property of the
Contractor and shall be removed from the project.
Concrete Surface Milling work shall be performed after Concrete Repair work.
