About this file
Addendum #1 to ITB FNW 26 27 01 is issued by the Florida Department of Agriculture and Consumer Services (FDACS) in response to written vendor questions regarding the Distribution of USDA Foods for the National School Lunch Program in Service Area 1, Region 2. The solicitation seeks a contractor to provide distribution services for USDA Foods across four categories: dry items, special dry items, refrigerated items, and frozen items. The contract encompasses receipt, handling, storage, inventory management, and outbound deliveries to schools within the service area. The contractor must begin distribution immediately upon contract execution, with the contract term extending through June 30, 2027, and FDACS retaining the right to renew for three additional one-year periods at its discretion. Vendor questions were due May 21, 2026, with written responses provided in this addendum dated May 29, 2026. Sealed bids are due June 10, 2026 at 5:00 PM Eastern Time, with public bid opening scheduled for June 11, 2026 at 9:15 AM via teleconference.
The addendum clarifies critical contract requirements through five question-and-answer exchanges addressing contractor responsibilities and facility requirements. Most significantly, FDACS confirms that all services must be performed directly by the contractor without subcontracting without prior written consent, though the contractor must coordinate with the previously awarded storage and handling contractor for Service Area 1, Region 2. A warehouse facility is not required to be located within the service area but must remain within the State of Florida. The incoming contractor should expect to receive between 10,000 and 20,000 cases from the incumbent contractor during transition. FDACS confirms that bidders with comparable institutional food distribution and cold-chain logistics experience may substitute for limited prior USDA Foods contract experience to satisfy past performance requirements. A $50,000 performance bond is required within 15 days of award, and pricing is submitted on a fixed price per case basis with allowable fuel surcharges indexed to the U.S. Department of Energy's Weekly Petroleum Status Report and price adjustments permitted based on Consumer Price Index changes.

Question Number
Question Answer
Although the solicitation is titled as a “Distribution” contract, several sections also reference inbound freight receiving, inventory management, warehousing, and temperature-controlled storage requirements. Can FDACS clarify whether the awarded contractor is expected to directly operate warehouse/storage services as part of this contract, or whether those services may be performed through an approved subcontracted warehouse partner?
This solicitation does include sections for storage requirements due to the federal regulations, but the awarded contractor would only be required to provide distribution for Service Area 1, Region 2. The contractor agrees that all services to be performed under any awarded contract shall be performed solely by the contractor and may not be subcontracted for or assigned without prior written consent of the department. The receipt, handling, and storage of USDA Foods for Service Area 1, Region 2 has previously been awarded and the awarded contractor for distribution would be required to work with them.
Would FDACS allow the awarded contractor to utilize a third-party warehouse facility for storage operations, provided the awarded contractor remains fully responsible for inventory management, reporting, compliance, and outbound deliveries?
No, the receipt, handling, and storage of USDA Foods for Service Area 1, Region 2 has previously been awarded and the awarded contractor for distribution would be required to work with them.
Approximately how much USDA Foods inventory is typically transferred from the incumbent contractor to the newly
The amount of USDA Foods typically transferred from the incumbent contractor to the newly awarded awarded contractor during the transition period?
contractor can vary but should be between 10,000-20,000 cases.
Does FDACS require warehouse operations to be physically located within Service Area 1, Region 2, or would a facility outside the service area be acceptable if all delivery schedules and contract requirements are met?
This solicitation is only for distribution and the receipt, handling, and storage of USDA Foods for Service Area 1, Region 2 has been previously awarded. No, the warehouse does not need to be physically located within Service Area 1, Region 2 but must be located within the State of Florida.
Would FDACS consider comparable institutional food distribution and cold-chain logistics experience acceptable for the past performance requirement if the bidder has limited prior USDA Foods contract experience?
Yes, comparable institutional food distribution and cold-chain logistics experience would be acceptable for the past performance requirement.
