About this file

This is an Addendum to a Request for Proposals (RFP #22-054-PSC) issued by the Eugene Water & Electric Board (EWEB) for Northern Spotted Owl analyses and biological reviews. The addendum, dated March 31, 2022, modifies the original ITB document and provides clarification on project scope and contract terms. The work involves conducting biological evaluations for four U.S. Forest Service Survey & Manage wildlife species with known or suspected occurrence in the Willamette National Forest: the Great Gray Owl, Red Tree Vole, Crater Lake Tightcoil, and Oregon Megomphix. Additionally, the Oregon Department of Fish and Wildlife (ODFW) has requested evaluation of Oregon Conservation Strategy Species for the West Cascades Ecoregion, with a complete species list provided as an attachment. The closing date for submissions remains April 6, 2022. EWEB and the selected contractor will jointly establish the maximum budget and specific scope of work based on the contractor's proposal and anticipated level of effort, rather than a predetermined budget figure.

The addendum makes a material change to the contract's payment structure under Section 3b (Consideration & Payments). The revised language clarifies that the contractor is responsible for completing all work identified in the Statement of Work without exceeding the maximum not-to-exceed compensation stated in the contract. If the contractor expends the maximum compensation before completing satisfactory work, the contractor must complete remaining work to EWEB's satisfaction at no additional cost. This modification shifts responsibility to the contractor to manage project completion within the negotiated budget parameters established during the contracting process.

ADDENDUM # 1

Title: Northern Spotted Owl analyses & Biological Reviews

RFP # 22-054-PSC

This addendum adds additional information to the original ITB document.

CHANGES TO ITB DOCUMENT:

Revisions to Documents – Sample Contract Section 3b (Consideration & Payments):

Strike 3rd paragraph altogether and revise 2nd paragraph as follows:

(Red-line:)

The cost of the Work or Contractor services shall be determined by multiplying the number of Contractor hours for each Contractor employee multiplied by the applicable hourly billing rate identified in the Contract for that employee. The Contract establishes an estimated number of hours for Contractor to complete, and a total number of hours within which Contractor must complete all Work described in the Statement of Work. Contractor agrees that it is responsible for (a) performing the Work without exceeding the total number of hours allocated for the Work, and for (b) completing all work identified in the Statement of Work without exceeding the maximum not-to-exceed compensation stated in the Contract. If Contractor expends the total hours allocated for the Work in the Statement of Work, and expends the maximum not-to-exceed compensation stated in the Contract, but the Work is not complete or is not satisfactory, Contractor is responsible to complete the Work to EWEB's satisfaction without further compensation.

(Clean:)

Contractor agrees that it is responsible for completing all work identified in the Statement of Work without exceeding the maximum not-to-exceed compensation stated in the Contract. If Contractor expends the maximum not-to-exceed compensation stated in the Contract, but the Work is not complete or is not satisfactory, Contractor is responsible to complete the Work to EWEB's satisfaction without further compensation.

Question & Answer

1. Page 11 of the bid document mentions 4 species that will be included in the new biological evaluation, and then states that ODFW has requested an evaluation of Oregon Conservation Strategy Species for the West Cascades Ecoregion....Is there an available list of these additional species so we can get an idea of the scope of the work involved in Task 2?

A. U.S. Forest Service Survey & Manage wildlife species with known or suspected occurrence in the Willamette National Forest currently include (4) species: the Great Gray Owl, Red Tree Vole, Crater Lake Tightcoil, And Oregon Megomphix. The full Oregon Conservation Strategy Species list for the West Cascades Ecoregion is in the attached PDF (copied from website:

Contractor...Contractor agrees that is responsible for (a) performing the work without exceeding the total number of hours allocated, and (b) completing all work identified ...without exceeding the maximum not-to-exceed compensation stated in the Contract.
