About this file
This is Addendum No. 1 issued by Otwell Mawby, P.C. for Shelby Public Schools' asbestos abatement project at Shelby Middle School in Shelby, Michigan. The addendum modifies the original bid specifications dated February 13, 2025, and includes clarifications from the mandatory pre-bid meeting held on February 20, 2025. The bid opening is scheduled for March 6, 2025 at 2:00 pm. The project involves asbestos abatement of approximately 8,825 square feet of 9" floor tile, 1,258 square feet of 12" floor tile, 135 square feet of countertops, 11 square feet of window glazing, 6 square feet of sink undercoating, and 3,882 square feet of carpet mastic. The work must commence no earlier than June 11, 2025 and be completed by June 25, 2025.
The addendum includes several scope clarifications, including that the gray glazing work in the Library office has been modified from 22 windows to 5 windows and 15 metal panels. Paint sampling analysis revealed lead present in paints within the work area, requiring contractors to follow MIOSHA standards for lead exposure in construction. Three contractors attended the mandatory pre-bid meeting. The Owner will provide access to utilities and coordinate dumpster placement. All measurements and quantities listed are estimates, and bidders are responsible for their own measurements. A bid bond of 5% and performance/payment bonds of 100% are required.

10) Revision 1:
On February 13, 2025, an “Invitation to Bid” was issued for Asbestos Abatement to invite firms to provide a bid on asbestos abatement activities at the Shelby Middle School building. On the Contractor’s Price Sheet/ Bid Proposal Form for the initial invitation, it was indicated that:
“Deadline for Receipt of Bids/ Proposals: Thursday, February 20, 2025, 12:00 PM EDT”
A correction has been made to the Contractor’s Price Sheet/ Bid Proposal Form, which corrected the bid due date to March 6, 2025 at 12:00 pm, not February 20, as noted on the original package. The remaining dates listed in the bid documents did not change. The correction applied only to the Contractor’s Price Sheet/ Bid Proposal Form. The corrected Contractor’s Price Sheet/ Bid Proposal Form is attached.
11) Scope Change 1:
The scope of work associated with the Gray Glazing within the Library office, as detailed in the Bid Specifications, dated, February 13, 2025, has been modified from 22-Windows to 5-Windows and 15-Metal Panels. The quantities to be abated remain unchanged, as detailed in the following table.

12) Scope Change 2:
Paint sampling and analysis for areas to be impacted during the planned renovations has been completed.
The results are detailed in the attached Shelby Middle School Paint Sampling and Laboratory Analysis Report dated 2/27/2025. The results of the paint sampling analysis indicate that lead is present in paints within the work area. Painted materials disturbed during abatement/ demolition activities should be assumed to contain lead paint. The Contractor is responsible to manage these materials in accordance with local, state and federal laws.

RE: PAINT SAMPLING AND LABORATORY ANALYSIS REPORT
SHELBY MIDDLE SCHOOL
525 NORTH STATE STREET, SHELBY, MICHIGAN
OTWELL MAWBY PROJECT NUMBER: 24-064
Dear Jeff:
At your request, Otwell Mawby P.C. (Otwell Mawby) collected samples of paint associated with the areas of planned renovation within the Shelby Middle School, located at 525 North State Street in Shelby, Michigan (hereafter referred to as the subject property). The purpose of this sampling was to determine if cadmium and/ or lead is present in paints or coatings on the structure prior to its renovation. The structure was reported to have been constructed prior to 1978, as a result, the sampling was completed for compliance with the Michigan Occupational Safety and Health Administration (MIOSHA) Part 309
Cadmium in General Industry and Part 603 Lead Exposure in Construction Standards. The sampling was completed February 20, 2025 This document presents the findings of the sampling and analysis.
Collection Protocol and Results
Two composite paint chip samples, identified as C-1 and C-2, were collected from paints on the structure.
The samples were comprised of paints composited into a single sample from multiple within the area of planned renovations. The collected paint chip samples were sent to EMSL Analytical, Inc. (EMSL) in
Indianapolis, Indiana for analysis of cadmium and lead using inductively methods 3050B/ 6010D. The analytical results and chain of custody are attached in Appendix A and are summarized in the following table.
Sample Identification/ Location Concentration of
Cadmium Identified
Concentration of
Lead Identified
C-1 / Composite / Masonry Block ND 21
C-2 / Composite / Non-Masonry ND 740
ND= Indicates that the analyte was not detected at or above the reporting limit.
Results shown in mg/Kg
Summary/ Recommendations
Laboratory analytical results indicated that sampled paints associated with the structure contain lead. The presence lead in paint becomes a health and safety issue if the painted surfaces are disturbed and the resultant dust containing lead is released into the atmosphere. It is our understanding that the buildings are to be demolished. Based on the laboratory analytical results the contractor completing the demolition is required to be trained according to the MIOSHA Health Standards, Part 603, Lead Exposure in
Paint Sampling Report Otwell Mawby, P.C.
Shelby Middle School February 27, 2025
525 North State Stret, Shelby, Michigan Page 2
Construction. The Standard covers the disturbance of lead when it is present in any detectable amount in a material. In addition to the required training, an initial exposure assessment (air monitoring) must be performed to determine if the workers are being exposed above the permissible exposure limit (PEL) for lead. Until initial exposure monitoring has been performed, the Standard requires the workers to wear respiratory and personnel protection equipment (respirators, gloves, and disposable coveralls). A hand-washing station must also be available on site. During demolition, measures (i.e., water application) should also be taken to suppress dust.
Based on the laboratory results (total concentrations) of the painted masonry block, which contains lead, the material may meet the definition of an “inert material” per Section 11504 (2)(e) (Part 115, Solid Waste
Management, of Act 451 of 1994, as amended and its administrative rules), as a result, the masonry block could be disposed of at a licensed landfill or recycled for reuse. Following is a citation for the “inert material” definition as it applies to lead paint on masonry surfaces:
324.11504 Definitions; H to P.
Sec. 11504.
(7) "Inert material" means any of the following (other conditions listed in the Act):
(iv) The placement of the debris does not violate federal, state, or local law or create a nuisance.
(e) Construction brick, masonry, pavement, or broken concrete that is reused for fill, rip rap, slope stabilization, or other construction, if all of the following conditions are met:
(i) The use of the material does not violate section 3108, part 301, or part 303.
(ii) The material is not materially contaminated. Typical surface oil staining on pavement or concrete from driveways, roadways, or parking lots is not material contamination. Material covered in whole or in part with paint that contains more than 0.5% lead is materially contaminated.
Additional sampling is likely required to ensure the lead painted masonry materials meet the definition of an “inert material” per Section 11504 (2)(e) and the EGLE Designation of Inertness #17-I-003 for Lead
Painted Debris.
Based on the presence of lead in the paints, the landfill where the materials are to be disposed should be contacted, in advance of the demolition commencement, to determine if any additional characterization of the waste is warranted or if they will accept the waste based on the provided results.
If you should have any questions regarding this report or the MIOSHA/ landfill requirements, please feel free to contact the undersigned. Thank you again for your confidence in Otwell Mawby, we enjoyed working with you on this project.
Sincerely, OTWELL MAWBY, P.C.
