About this file
This is Addendum #1 to IFB #10204537 from the California Department of Water Resources (DWR) for Technical and Confined Space Rescue Services, dated November 21, 2024. The addendum modifies the overtime definition in the bid sheet and scope of work to specify that overtime applies to hours exceeding 8 hours up to 12 hours Monday through Friday and up to 12 hours on Saturday, while double time applies to hours exceeding 12 hours Monday through Saturday and all hours on Sundays and holidays. Rural Metro Fire Department Inc. DBA Capstone Fire & Safety Management is identified as the incumbent contractor.
The addendum provides answers to 14 technical questions covering various aspects of the solicitation. Key details include that the budget will be determined based on the lowest responsible bidder, historical usage was split approximately 1/3 from Southern Field Division and 2/3 from San Joaquin Field Division, and bidders must submit new DVBE documentation specific to this IFB. The bid rates must be all-inclusive of labor, materials, licenses, permits, transportation, per diem, equipment and travel time, with no separate billing allowed for these components. Bidders must use the revised bid sheet that includes straight time, overtime and double time rates for both field divisions.

3. DWR received the following question(s) for IFB No.10204537, for Technical and Confined Space Rescue Services.
Q1. The IFB Documents are locked, is it possible to obtain the password?
A1. No, the IFB Documents must remain locked so that they are not changed in any way, please write as clearly as possible on the required documents.
Q2. Can you please provide the current pricing (including escalators) from the last successful winning bidder? Also the name of the winning bidder?
A2. The name of the last successful bidder is Rural Metro Fire Department Inc. DBA Capstone Fire & Safety Management. For the bid information that you are requesting you will need to do a public records request, you can submit the request online at the link below. The Contract number (4600014444), will be required for the public records request.

Q3. What is the budget estimate for the new contract?
https://californiadwr.mycusthelp.com/WEBAPP/_rs/(S(a4dkz0axmi5xnlpeogl23sgi))/supporthome.aspx https://californiadwr.mycusthelp.com/WEBAPP/_rs/(S(a4dkz0axmi5xnlpeogl23sgi))/supporthome.aspx
A3. The budget amount for this contract will be dependent upon the bids received and calculated from the amount bid by the lowest responsible bidder. Until we know the cost, we cannot determine the budget amount of the contract.
Q4. Can you provide a breakdown of the number of jobs requested in the last two years, by county, highlighted in yellow on page 43, Exhibit A, Attachment 1?
A4. We do not have this data by County. In the current contract, as far as usage by field division, 1/3 of the usage in dollars has been from Southern Field Division, and 2/3 of the usage in dollars was San Joaquin Field Division. Since this is on an as-needed basis the usage could be completely different depending on scheduled and non-scheduled work that comes up during the contract term.
Q5. In the IFB 10204537, page 5, under Bidder Minimum Qualifications, you are requesting one work order per year for a three year period for a total of three work orders/invoices, or one work order or invoice per year for the three year period for each reference, a total of nine work orders or invoices?
A5. A total of three work orders or invoices are required, showing work performed for the firms listed on Attachment III, Bidder References, covering the three year requirement.
For example, firm reference 1 work order/invoice showing work in 2023, firm reference 2 work order/invoice showing work in 2022, and firm reference 3, with an work order/invoice showing work in 2021.
Q6. For the DIR Registration requirement, requested on Bid Checklist, page 17 of the IFB, does a DIR Registration application meet the documentation request?
A6. Yes, a submitted DIR Registration application does meet the DIR Registration documentation request.
Q7. If a bidder has received a DVBE notification of compliance for another solicitation, do they need to submit those documents again for this IFB?
A7. Yes you will need to submit your DVBE documentation for a new Notification of Compliance for this particular IFB. The notification of compliance for a different solicitation may not have the DVBE requirements that this solicitation does. This IFB 10204537, does have DVBE program requirements, these requirements are explained on page 4 of the IFB. On page 16 of the IFB, it explains the opportunity for bidders to receive a pre-review of the bidders DVBE documentation prior to submission for a Notification of Compliance. This is strongly recommended, as non-compliance with the DVBE program requirements is cause for rejection.
Q8. If a bidder has a State of California Small Business Certification, is there any other documentation necessary to meet the Small Business requirement?
A8. Being or having a Small Business Certification is not a requirement, but you can claim your small business preference by supplying a copy of the Small Business Certification, and by noting the current certifications on the Bidder Declaration, Attachment VIII, also on the Attachment II, Bid/Bidder Certification Sheet under section 14 where you check the appropriate boxes for Small Business and/or Disabled Veteran Business Enterprise, and enter the Certification numbers. Information regarding the Small Business Preference Program can be found in the IFB starting on page 11.
Q9. On the Bid Sheet, page 19, it asks for an hourly rate for a two-person and a three-person team for straight time rate per hour. This bid sheet does not support billing labor in accordance with prevailing wage rates. Prevailing wage work on a Saturday should be paid at time and a half for the first 12 hours, work exceeding 12 hours in a day, and any work on Sunday should be calculated at double time. Can we add categories for overtime and double time rates?
A9. Please see attached Attachment I, Revised Bid Sheet, this revised bid sheet allows for bidding straight time, overtime, and double time rates for both Southern and San Joaquin Field Divisions. Please make sure and submit the Revised Bid sheet with your bid packet.
Q10. Wage Determinations have specific timeframes when wages increase yearly, there is no point escalators in the IFB, there are two determinations applicable, one has one increase, and the other has two increases.
A10. Bid your hourly rate inclusive of any current published pre-determined increases. This rate will be binding for the term of the contract as stated on the Attachment I Bid Sheet “actual costs quoted below by the bidder shall be binding for the term of the agreement.”
Q11. According to the DIR prevailing wage classification, a $45.00 per day per diem is required. Can this be billed independently as a pass though so that it is not included in the total hourly rate?
A11. No, this cannot be billed separately. All labor, materials, licenses, permits, and transportation necessary to perform all services for the foregoing titled work in accordance with the Scope of Work, Exhibit A. The rates listed on the bid sheet shall include every item of expense, direct and indirect, including per diem incidental to the specified rates.
Q12. Per prevailing wage regulations, wages are to be paid to and from the job site, current billing does not allow us to account for that time?
