JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department, 02.

2. Description of the Action Being Approved

This justification is for an award of a five (5) year Indefinite Delivery Indefinite Quantity (IDIQ) contract with Firm-Fixed-Price (FFP) and Cost- Plus-Fixed-Fee (CPFF) Delivery Orders on a sole source basis to MOOG, Inc., 300 Jamison Road, East Aurora, NY 14052, to provide upgrades and repairs of Precision Strike Package (PSP) Gun Weapon Systems (GWS) actuator sets onboard fielded Battle Management Systems (BMS) platforms in support of the NSWCDD Weapons Control and Integration Department (H), Platform Integration Division (H40), Weapon Control Systems Development Branch (H43), and Battle Management Systems (BMS) program. Authority to act under this J&A expires 20 August 2025.

3. Description of Supplies/Services

The primary purpose of the proposed contract is to perform upgrades and repairs of the PSP GWS actuator sets onboard fielded BMS platforms.

Supporting capability improvements and technological advancements is required and incorporates one or all aspects of the development phases such as; system design including software, test equipment and hardware builds, hardware and software setup, system integration and lab testing, systems revision and updates, and flight and integration testing and training as they can be interrelated. Additionally, as BMS fielded systems age or actuator hardware enhancements are identified, there is a need for procuring hardware to support the AC130 fleet.

BMS programs will procure each of the following: 105 millimeter (mm) Actuators, 30mm Actuators, Motor Control Units (MCU’s), and Regen Boxes.

The total estimated 105mm Actuator purchase quantity will be two (2). The total estimated 30mm Actuator purchase quantity will be three (3). The total estimated Controllers purchase quantity will be five (5). The total estimated Regen Boxes purchase quantity will be ten (10).

The resultant contract will have one five-year ordering period for a total of sixty (60) months.

The total estimated value of the proposed IDIQ contract is $3,080,857.

The table below shows the anticipated funding level for each Fiscal Year (FY) of the ordering period.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

This justification is based upon the authority of 10 U.S.C. 2304 (c)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The use of full and open competition is not feasible since MOOG, Inc. is the only responsible source that can satisfy the Government’s requirements. MOOG, Inc. developed the 30mm and 105mm gun actuators under a series of procurements during the development phase of the BMS program.

NSWCDD engineers designed the Gun Weapon Control System to work integrally with the MOOG actuators. Since MOOG, Inc. originally developed the internal control loops at their own expense, the Government does not have technical rights to the source code. Due to the MOOG designed software controlling the actuators and the redevelopment costs that would be incurred with an overhaul of the system, these actuator sets and associated controllers have historically been procured, on a noncompetitive basis, from MOOG, Inc. for the AC130 fleet since the onset of the BMS program in 2007, and started the actuator requirement in 2009.

Since MOOG, Inc. owns the internal control loop software, which provides an interchange to the Government developed outer control loops, other than full and open competition must be used for the present requirement. In addition, MOOG, Inc. is the only entity that has the highly specialized technical knowledge base to provide upgrades and repairs to existing fielded equipment.

The comprehensive market survey performed by the Weapon Control Systems Development Branch (H43) determined that there are no other manufactures of electronic actuator systems of the size and type that meet the BMS Gun Weapon Control interface requirements. Other manufactures of actuators lack the ruggedization, mechanical precision, and ability to fine tune actuator controllers required by the GWS.

MOOG, Inc. does not have any authorized resellers, and is the only authorized organization to perform repairs and upgrades to current systems. In addition, MOOG, Inc. currently has the proprietary rights of the communication loop being used on the AC130’s already in use in the fleet. Awarding to another Contractor would require development, system functionality verification, and validation of a completely new BMS actuator system for the Gun Weapon Control Systems. Competing this effort would incur substantial duplication of cost that is not expected to be recovered through competition, and unacceptable delays in fulfilling the Government’s requirement for GWS efforts. The schedule impact is thirty-six (36) months for the development and retesting of a new actuator system. The cost of this rework is estimated at $12.1 Million (M) based on Government and Contractor research, development, testing, and tuning costs for both the 30mm and 105mm systems. The Gun Weapon System accounts for approximately $4.3M of the incurred costs ($2.4M development, $1.9M testing), while development and testing of the Gun Weapon System Fire Control software accounts for $7.8M ($5.3M in development, $2.5M in testing).

From the onset of the BMS program, MOOG, Inc. has been the only sole manufacturer utilized with the specialized knowledge and expertise to procure the following sole source procurements: N00178-09-P-1003, N00178- 09-C-1017, N00178-09-C-1025, N00178-09-C-1033, N00178-09-C-1067, N00178- 09-C-1071, N00178-10-C-1025, N00178-12-D-1017, N00178-13-D-1011, and N00178-15-D-1011.

Based on the aforementioned information, MOOG, Inc. is the only manufacturer with the technical data rights capable of performing the tasking required in this effort without a substantial duplication of costs and time.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

NSWCDD intends to solicit MOOG, Inc. for the services required. A Sources Sought for the proposed action was posted in Federal Business Opportunities (FBO) on 24 October 2019 in accordance with FAR Part 5.2, and no other companies expressed an interest in this requirement. The proposed action was synopsized in FBO as a sole source requirement on 06 November 2019 and no additional Contractors expressed interest in this requirement. No other market research was conducted because it is not practicable, for the reasons discussed in item 5 above, for any company other than MOOG, Inc. to provide the required services. Firms interested in subcontracting opportunities were directed to reach out to MOOG, Inc.

As mentioned in item 5 above, a comprehensive market survey was performed and MOOG, Inc. is the only manufacturer capable of manufacturing this specific electronic actuator system in the form, fit, and function required to meet the BMS Gun Weapon Control interface requirements.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable. DCMA pricing assistance will be requested along with the Offeror’s certificate of current cost and pricing to support the fair and reasonable cost determination. Additionally, significant quantities of this requirement have been purchased from this Offeror in the past and cost and pricing information was received on those past procurements.

This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Action to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWCDD Contract’s Department has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, NSWCDD Contract’s Department will assess whether competition for future requirements is feasible.
