About this file

This is a Limited Sources Justification (LSJ) document approving a sole-source task order award to Diversified Protection Corporation (DPC) for armed guard services at the Department of Labor's Frances Perkins Building (FPB) in Washington, DC. The task order will be placed against DPC's GSA Multiple Award Schedule contract GS-07F-120GA for a three-month base period (12/28/2024 - 3/31/2025) and three three-month option periods extending through 12/31/2025, with a total estimated value of $14,078,871.95.

The justification cites DPC's incumbent status since June 2019 and the need for continuity during a transition of physical security responsibility from DOL to the Department of Homeland Security's Federal Protective Services (FPS), scheduled for April 1, 2025. The scope includes providing trained armed guards, operating security equipment, monitoring building systems, conducting patrols, and serving as first responders. The LSJ states that while other vendors have technical capability, only DPC has the personnel and institutional knowledge to avoid service disruption during this transition period. The document is signed by Timothy Deane (Security Specialist), Emily Bear (Contracting Officer), and Amanda Woodard (Advocate for Competition).

Limited-Sources Justification Far part 8.4 - Federal Supply Schedule

1. Identification of the agency and contracting activity

Contracting Activity Customer Agency Department of Labor Department of Labor OASAM/OSPE OASAM/Security Center 200 Constitution Avenue, NW 200 Constitution Avenue, NW Washington, DC 20210 Washington, DC 20210

2. Nature and description of the action being approved.

This Limited Source Justification and Approval authorizes and approves the issuance of a task order to Diversified Protection Corporation (DPC) located at 109 River Landing Drive, Ste 300, Daniel Island, SC 29492. Pursuant to FAR 8.405-6(a)(1)(C), full and open competition will not be utilized and a task order will be placed against DPC’s General Services Administration (GSA), Multiple Award Schedule (MAS) contract GS-07F-120GA in order to continue supporting Department of Labor (DOL), Security Center (SC) with armed guard services at the Frances Perkins Building (FPB) located at 200 Constitution Ave NW, Washington DC 20210.

The current award (1605DC-19-F-00186) expires on December 27, 2024, so continuity of services is essential for guard services at the FPB. FPB is a GSA owned facility, but responsibility for physical security was delegated to DOL in 2003. In November 2023, the Department of Homeland Security (DHS) terminated the physical security delegation that authorized DOL to provide armed guard services at FPB. As a result, a transition of services is needed for the armed guard services at the FPB from DOL to DHS, Federal Protective Services (FPS). Currently, DHS/FPS is scheduled to assume physical security at FPB on April 1, 2025, however, it is necessary to plan for significant delays.

The government anticipates awarding a Labor Hour task order with fixed hourly rates for a three-month base period, and three, three-month option periods.

3. A description of the supplies or services required to meet the agency’s needs

(including the estimated value).

The Contracting Officer intends to limit the number of sources solicited pursuant to FAR 8.405- 6(a)(1)(C) for this requirement since DPC’s continued support and requisite expertise are essential for the needed armed guard services at FPB. Due to the unique circumstances of the armed guard services transitioning from DOL to DHS/FPS, a new contractor would not be able to hire and train new staff in time to meet SC’s mission.

Specifically, DPC’s continued support is required to accomplish the following tasks:

1) Provide trained and certified employees at all times to perform armed guard services.

2) Report all incidents to the regional FPS Mega Center.

3) Guard post access and egress.

4) Operate all government issued security equipment at each designated guard post, such as x-ray machines, magnetometers, and closed-circuit televisions (CCTV).

5) Monitor and operate the building fire alarm, emergency notification system, public address system, environmental and intrusion detection systems, CCTV systems, automated access control systems, package and personnel screening systems, communications systems, and other protection devices or building equipment located on or near the post, in accordance with the Guard Post Orders and Security Officer’s Duty Book guidance.

6) Conduct patrols in accordance with routes and schedules established in the Guard Post Orders, and shall observe, detect, report, and respond to all suspected or apparent security violations.

7) Serve as “first responders” and communicate, coordinate, and control an emergency environment.

8) Direct (vehicle and pedestrian), on-site traffic, control parking, etc., as prescribed by the Guard Poster Orders.

9) Monitor and observe building occupants and visitors for compliance in accordance with the Federal Management Regulations.

10) Be responsible and accountable for receiving and using keys and access control devices (i.e., “key cards,” lock combinations) that are issued for the security officer use only.

11) Lock or unlock specific entrances and exits; turn lights on and off as needed in their duty area at specific time as prescribed in the Guard Post Orders.

12) Monitor and observe building occupants and visitors for compliance in accordance with the Federal Management Regulations.

13) Maintain physical security, law and order as prescribed by statute, regulation, policy, and Guard Post Orders.

14) Report all potentially hazardous conditions and items in need of repair, such as inoperative lights, locks, security hardware, leaky faucets, toilet stoppages, broken or slippery floor surfaces, and blocked emergency routes or exits.

15) Fly (raise or lower) the United States Flag and DOL flag at this facility on a daily basis.

16) Receive, receipt for, and store found articles pending disposition.

17) Turn off unnecessary lights, check safes or repositories, lock cabinets, close windows, secure doors and gates, and perform other actions required to maintain / safeguard the persons and property of the DOL.

18) Perform other functions as required in the event of situations or occurrences such as civil disturbances, attempts to commit espionage, sabotage, or other criminal acts adversely affecting the security and/or safety of the Government, its employees, property, and the general public lawfully in the building or on the grounds under the control of the Government.

19) In case of an emergency condition requiring immediate attention, the on-site Project Manager, or any Contractor supervisory staff shall divert uniformed personnel from their normal assigned duties to respond to the condition and summon appropriate assistance as may be required; and immediately notify the designated Government official or agency, as applicable, of action taken.

20) Greet employees, contractors, vendors, and other visitors entering the building.

21) If CDC guidance or public/DOL policy requires the wear of face coverings in common areas, Contractor PSOs will be required at a minimum to wear face coverings. When social distancing cannot be reasonably accomplished, wear of face coverings, face shields, and disposable gloves is required.

The estimated value for this requirement is $14,078,871.95, which can be seen below.

Period of Performance Dates Total Estimated Value

Base Period 12/28/2024 – 3/31/2025 $3,581,764.33 Option Period 1 4/01/2025 – 6/30/2025 $3,536,569.77 Option Period 2 7/01/2025 – 9/30/2025 $3,449,940.60 Option Period 3 10/01/2025 – 12/31/2025 $3,510,597.25

Total Estimated Cost $14,078,871.95

4. The authority and supporting rationale.

FAR 8.405-6(a)(1)(C). In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures.

DPC has been successfully providing the required armed guard services at FPB since June 2019 under task order 1605DC-19-F-00186, which was competed. Due to the large number of contractor personnel involved in the performance of the armed guard services at the FPB, DPC is the only vendor that is staffed with the personnel, required qualifications, and requisite experience to deliver the needed services within the required timeframe without causing unacceptable delays.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).

The Contracting Officer has determined that issuing the proposed task order to DPC represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs.

The GSA Contracting Officer that awarded DPC’s GSA MAS contract (GS-07F-120GA) has already negotiated fair and reasonable pricing rates. However, additional discounts will be requested by the DOL Contracting Officer.

Additionally, prior to the issuance of the task order, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific tasks being added in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE).

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research has been conducted and while there are other vendors that have the technical capability to perform the armed guard services outlined in the Performance Work Statement, no vendor is readily available with the institutional and programmatic knowledge required to fulfill SC’s requirements within the available timeframe without a disruption in services. Procuring the armed guard services from a source other than DPC would delay critical services and severely adversely impact SC’s mission.

7. Any other facts supporting the justification:

None

8. A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services is made:

9. Technical certification:

The program/technical official further certifies that no conflict of interest exists in awarding a sole source contract to the contractor identified herein.

I hereby certify that the supporting data, which are the responsibility of the technical personnel, and which forms a basis for this justification, is complete and accurate.
