About this file
This document provides guidance for capturing information from certain patent documents. It details how the contractor handling patent data capture and composition should retain word order and phrasing when transcribing statements listing multiple patent trials or proceedings that were joined or consolidated. For example, if the source document lists two trials as consolidated but not consolidated with two other trials, the contractor must maintain this distinction and not imply the trials were part of one consolidation. This guidance aims to accurately capture relationships between proceedings to avoid misstating results.
The second document is a pre-solicitation notice for a patent data and document management contract with the United States Patent and Trademark Office. It seeks indexing and scanning of paper patent documents, quality review of electronic filings, and data capture and composition services to publish patent applications and grants. Key requirements include front-end processing, pre-grant publication, post-allowance processing, post-issuance processing, and quality control. The contractor must convert and compose application data on a weekly schedule and ensure compliance with statutes, standards, and technical references provided by the agency.

ADDITIONAL GUIDELINES FOR CAPTURING THE “The results of” STATEMENT
The information in this bulletin will be included in the 2020 revision of
DATA ENTRY MANUAL FOR NON-UTILITY PATENT DOCUMENTS,
OTHER THAN PATENT APPLICATION PUBLICATIONS.
***This bulletin is effective immediately.***
See DATA ENTRY MANUAL FOR NON-UTILITY PATENT DOCUMENTS, OTHER THAN PATENT APPLICATION PUBLICATIONS, Section XIX. PATENT TRIAL AND APPEAL BOARD CERTIFICATES, Front-Page Bibliographic Data, “The results of” Statement.
The Data Source information is revised by the addition of the following, to be inserted immediately before the paragraph beginning “As stated above, although the source.”
Except for omitting the filing dates, the PaDaCap contractor will capture and print the word order that is shown in the source. When the source shows the phrase “joined with” connecting trial numbers, “joined with” will not be changed to “joined” and will not be moved so that it immediately precedes the first trial number. Similarly, “consolidated with” will not be changed to “consolidated” and will not be moved so that it immediately precedes the first trial number. When the source shows “joined with” more than once or “consolidated with” more than once, such repetitions have significance and will be retained. Altering the word order in some instances can misstate the “The results of” information. For example, the source shows this:
There are four trials. The first and second are consolidated but are not consolidated with the third and fourth. The third and fourth are consolidated but are not consolidated with the first and second. There are two sets of consolidations. Changing the two instances of “consolidated with” to one “consolidated” and moving “consolidated” so that it precedes the first trial number would be an incorrect statement of the information.
