REMOVAL OF OUTDATED INSTRUCTIONS ABOUT PATENT TERM ADJUSTMENT PETITIONS AND CANDOR LETTERS
The information in this bulletin will be included in the 2020 revision of
DATA ENTRY MANUAL FOR UTILITY PATENTS.

For patents granted on or after January 14, 2013, the USPTO no longer sends an initial patent term adjustment (PTA) determination on Page 3 of the PTOL-85, Notice of Allowance. The issue notification (ISSUE.NTF) will show the patent term adjustment (PTA) determination, “but the patent term adjustment … indicated on the patent is the ‘official’ notification of the Office’s patent term adjustment determination.”
There is no longer an opportunity for the applicant to file a post-allowance/pre-issue-fee-payment request/petition for reconsideration of the PTA determination. If the applicant wants to request that the PTA determination be reconsidered, such request will be filed after the patent has issued.
Consequently—and belatedly—in DATA ENTRY MANUAL FOR UTILITY PATENTS, 9. Term Notice, Patent Term Adjustment/Extension (PTA/PTE) Notice, all information under the headings PTA Petitions versus PTA “Candor Letters”, PTA Petitions, and PTA “Candor Letters” is removed.
