About this file

This is a Non-Competitive Memorandum for Simplified Acquisition Actions justifying a sole source award under IAW FAR 13.101-3(b).

The Department of Justice, Bureau of Prisons, FCI Cumberland is awarding a sole source contract to American Correctional Healthcare, Inc. (ACH), the incumbent contractor, for comprehensive medical services to the inmate population. The required services include inpatient/outpatient facility and physician services, as well as outpatient institution services of dentist, physician, pharmacist, and phlebotomist. Services will be procured through purchase orders for the performance period of July 1, 2026 through July 31, 2026, with an estimated value of $170,000.00. The statutory authority for this non-competitive action is cited as 41 U.S.C. 253 and 41 U.S.C. 1901(e).

The justification demonstrates that ACH, as the incumbent, is the only provider capable of ensuring seamless service delivery without lapse in performance. The memorandum notes that ACH's comprehensive medical contract has expired and continuity of care is essential during the pending competitive award of a CMS contract. The government determined that ACH's established medical network of local medical facilities and physicians, combined with their immediate availability of community-based health care services, makes them uniquely qualified to prevent disruption to inmate medical services and maintain operational continuity. The contracting officer, Brian Logsdon, certified this justification as accurate and complete on July 7, 2026.
