STATEMENT OF WORK

Scope of Work

Vessel Charter and Services to:

1. Investigate abundance, trends, and stock structure of small cetaceans throughout Southeastern Alaska, specifically harbor porpoise.

2. Continue long-term investigations on killer whales through photo-identification, biopsy sampling, and satellite tagging operations.

3. Accommodations for a scientific party of up to 6 biologists will be required.

Specifications and Operating Procedures

The cruise will begin and end in Juneau or Ketchikan, Alaska. All major inland waters of Southeast Alaska may be surveyed during the course of this cruise to include Stephen’s Passage, Lynn Canal, Icy Strait, Cross Sound, Chatham Strait, Sumner Strait, Clarence Strait, and Frederick Sound. The specific itinerary of the cruise will be flexible, with decisions being made by the chief scientist depending on both weather conditions and research accomplishments.

The scientific party will be U.S. government employees or cooperators. The primary purpose of the vessel will be to conduct both genetic studies on harbor porpoise and conduct 3-4 days of line-transect surveys for small cetaceans in the inland waterways of Southeast Alaska. During line-transect operations, scientific observers will rotate among three positions logging in all cetacean sightings, environmental conditions, and trackline information. Pre-determined tracklines will be followed and all positional information (i.e., waypoints) will be given to the vessel Captain prior to departure for entry into the ship’s GPS system. General search patterns will require the vessel to operate at approximately 9-10 kts during these surveys. During line-transect days (total of 3-4 only), approximately 100-150 nautical miles a day may be surveyed. Additional transits may occur overnight to position research effort for the following day. During genetic studies of porpoise, the vessel may in fact remain in the same general area. Scientists will work from a skiff during this phase of the research. The vessel is required to stay in close proximity (within at least 2 miles) or follow the skiff to ensure the safety of the researchers. The vessel will be required to closely approach several species of whales, dolphins, and porpoises and all required permits will be provided by the Chief Scientist prior to the cruise.

Work day length will be determined each day by the Chief Scientist or her alternate, in consultation with the vessel Master. A 12-hour work day is required each day however work day length may extend beyond the 12 hours depending upon the research that needs to be accomplished. The decision will be based on the type of activity as well as prevailing situations regarding weather, sea state, and overall work progress. The Chief Scientist or her alternate has final authority except for work stoppage resulting from uncontrollable situations such as unsafe weather and sea state conditions and other safety-of-life-at-sea considerations as determined by the vessel Master.

As part of our long-term project on Southeastern Alaska killer whales, when killer whales are encountered a skiff will be deployed allowing researchers to closely approach this species to collect photo-identification photographs, biopsy samples, and conduct satellite tagging operations. When the scientific party is aboard the skiffs, the vessel must wait nearby or follow the scientific party and must maintain regular radio communication with the scientific party. In the event that sea conditions prohibit launching a skiff, attempts to photograph whales from the charter vessel will be made, as practicable.

The crew, when not required by the Captain for vessel operations, shall assist the Government field party.

Place and Period of Performance

1. All waters of Southeastern Alaska will be potentially surveyed covering major inland waterways from Juneau to Ketchikan.

2. The charter will be two, 10-14-days cruises.

a) The first survey needs to be completed during the month of July 2015 and operate for 10-14 days, leaving from and returning to Juneau or Ketchikan, Alaska.

b) The second survey needs to begin around the 14 September 2015 operating from 10-14 days ending on or about the 27 September 2015, once again leaving from and returning to Juneau or Ketchikan, Alaska.

General Conditions

a. The Government’s representative (COR), under whose technical guidance the work will be performed, shall be consulted as to the manner of starting and performing the work so as to assure the use of approved techniques and materials.

b. The work shall be carried on in such a manner that there will be maximum coordination between the Contractor and the Government

COR.

c. Contractor shall invoice upon completion of the surveys after which time the payment will be made.

3. PROHIBITED SPECIES

All crab, salmon and halibut taken in survey operations must be returned to the sea unless the Field Party Chief directs they be retained for scientific purposes or for consumption aboard the vessel. (End of Clause)

4. POSSESSION OF LIQUOR/ILLEGAL DRUGS

During the charter period, the possession or use of intoxicating liquor and/or illegal drugs by any person is not permitted and may be grounds for termination of this contract by the Government. (End of Clause)

5. CONTROL OF PLASTIC DISCHARGES

Contractor shall comply with the Marine Plastic Pollution Research and Control Act of 1987, which establishes Federal requirements for controlling plastic discharges from ships. (End of Clause)

6. WORKING CONDITIONS FOR GOVERNMENT PERSONNEL

The contractor shall provide safe, efficient working conditions and accommodations to the Government personnel free from violence, threats of violence, harassment (including sexual harassment), intimidation, and other disruptive behavior. The contractor, its agents, subcontractors, and employees, including the Captain and crew of the vessel shall not harass, assault, oppose, impede, intimidate, threaten, interfere with or make unwelcome advances toward any member of the Government field party.

Violation under this clause may result in termination of the contract, at the discretion of the Government under the Default clause, and in consequent liability of the contractor to the Government for any costs incurred, as well as debarment, suspension or similar action from future participation in government contracts. (End of Clause)

7. PRESENCE OF FAMILY MEMBERS

Unless serving as crew, the spouses or children of crew members or owner(s) may not accompany the vessel during the term of the charter without obtaining written approval in advance from the vessel captain.

Liability for any family members allowed on board during the charter is solely the responsibility of the contractor. (End of clause)

8. HARMLESS FROM LIABILITY / INDEMNIFICATON

The contractor shall hold and save the Government, its officers, agents, and employees harmless from liability of any nature or kind, including costs and expenses to which they may be subject or on account of any or all suits or damages of any character whatsoever resulting from injuries or damages sustained by any person or persons or property by virtue of performance of this contract, arising or resulting in whole or in part from the fault, negligence, wrongful act or wrongful omission of the contractor, or any subcontractor, their employees, and agents. (End of clause)

9. Coast Guard Inspection NOAA's issuance of a notice to proceed will depend on the vessel's passing a Coast Guard fire and safety inspection. Unless the Coast Guard's inspection is performed earlier than two weeks before the vessel's scheduled departure and Coast Guard certification obtained no more than one week before scheduled departure, the Government may terminate this contract without any payment to the Contractor of this contract.

Furthermore, the Contractor, in the event of such termination, may be liable to the government for excess reprocurement costs. The cost for bringing a vessel to a passing standard shall be borne by the Contractor.

10. WORKMANSHIP

a. The work involved in this contract must be performed accurately, on a timely basis, and with established guidelines followed closely.

11. MECHANICAL BREAKDOWNS OR NONPERFORMANCE OF VESSEL

a. The contractor is responsible for maintaining all contractor provided equipment and vessels in a safe operating condition during contract performance. If a mechanical breakdown of the vessel occurs or other contractor provided equipment that is greater than 12 hours cumulative within a 24-hour period that begins at 0700 and ends at 0659, the vessel and all contractor provided equipment shall be considered off charter and make-up fishing days may be required at the prices contained in the Contract’s price schedule. The charter shall also be considered off charter if the Captain or Crew of the boat is unable to perform the duties as outlined in the Statement of Work in increments of time greater than 12 hours cumulative within a 24-hour period that begins at 0700 and ends at 0659. The contractor shall make every reasonable effort to resolve the problem causing the vessel, contractor provided equipment or Captain and Crew to be out of service and bring it back into service as quickly as possible to continue contract performance. Mechanical breakdown periods in excess of four (4) consecutive or four (4) cumulative days may be grounds for termination of the contract. In the event that the breakdown requires the vessel to return to port for repairs, the vessel will not be considered back on charter until the vessel returns to active survey status as determined by the Contracting Officer in consultation with COR.

12. Performance of Work

a. Promptly after award of the contract, the contractor shall designate a project manager responsible for coordination and execution of the contract, and to serve as liaison between the contractor and the NOAA representative for all work required under this contract.
