About this file

This is a bid proposal and contract document from the Virginia Department of Transportation (VDOT) for bridge rehabilitation work on Route 95 in Caroline County within the Fredericksburg District. The project, identified as Order No. A89 and Contract ID C0000122360M01, involves bridge rehabilitation work spanning from 2.40 miles north of the Hanover County line to 2.42 miles north of the Hanover County line. Electronic bids were submitted on July 22, 2026, at 10:00 AM through the Bidx platform. The project includes an extensive scope of work encompassing bridge deck grooving maintenance, concrete surface repairs, waterproofing applications, bearing replacements, guardrail installation and modifications, pavement demolition and milling, asphalt concrete placement, drainage work, erosion control, seeding and landscaping, temporary traffic control measures, and pavement markings. The contract completion date is set for May 16, 2028, with a substantial completion date of January 28, 2028. The bid proposal requires submission of a proposal guaranty bond equal to five percent of the bid amount and compliance with all project specifications, plans, and current Road and Bridge Specifications.

Pricing for individual bid items is to be submitted on a unit price or lump sum basis as specified in the detailed schedule of items, which includes over seventy distinct line items ranging from temporary silt fencing at 1,834 linear feet to asphalt concrete placement of 3,430 tons and traffic control services including truck-mounted attenuators for 2,208 hours. The contract is subject to federal Davis-Bacon wage requirements with prevailing wage rates established by the Department of Labor, and the contractor must comply with equal employment opportunity provisions, nondiscrimination requirements, and environmental protections including protection of nesting birds and bat species. Optional price adjustments are available for fuel and steel materials if the contractor elects to participate in those provisions. The contract is federally funded under FHWA number BFP-095-2(570) and requires the selected contractor to post a performance bond and maintain compliance with railroad coordination requirements for CSXT, including documented flagger logs and construction access coordination. A substantial completion disincentive equal to liquidated damages will be assessed if work is not completed by the adjusted substantial completion date, with no concurrent charging of disincentives and liquidated damages.

SUBSTANTIAL COMPLETION DISINCENTIVE

The Substantial Completion date for this will be January 28, 2028.

The following terms are defined:

● Substantial Completion is defined as completing the project to the point that it can be safely and effectively used by the public or the Department for the purposes intended. Work not required for Substantial Completion shall be limited to punch list items and final restoration activities not requiring CSX flaggers, inspectors, railroad coordination, or long-term roadway closures, including but not limited to permanent, final surface course placement, pavement markings, seeding, landscaping, and other incidental remaining work accepted by the Engineer.

● Substantial Completion Date is the date on or before which all work required for Substantial

Completion must be completed. This date will not change except for an extension of the Contract time limit for a Compensable Delay as defined by Section 109.05(e) of the Specifications, or for delays resulting from the non-availability of CSX flaggers or inspectors as provided herein:

• Adjustments to the Substantial Completion Date resulting from the non-availability of CSXT flaggers or inspectors shall not result in adjustment of the Fixed Completion Date unless the Contractor demonstrates to the satisfaction of the Engineer that the delay directly impacted activities on the critical path to Fixed Completion

For the purposes of this Special Provision, Substantial Completion shall include completion of all work requiring coordination with CSX, including all substructure work requiring CSX flaggers, inspectors, or railroad coordination; all superstructure work requiring CSX flaggers, inspectors, or railroad coordination;

and all work requiring long-term closures associated with superstructure operations

If the Substantial Completion requirements are not met on or before the Substantial Completion Date as adjusted by the Engineer for Compensable Delay, the Department will assess a disincentive in an amount equal to the liquidated damages specified in Section 108.06(b) of the Specifications for each Calendar Day after the Substantial Completion Date, as adjusted by the Engineer for Compensable Delay, that the Contractor does not achieve Substantial Completion.

The disincentive and liquidated damages will not be charged concurrently. Liquidated Damages will not be charged until both Substantial Completion has been achieved and the project remains incomplete after the Fixed Completion date has passed.

The disincentive will be assessed, not as a penalty, but as agreed compensation for damages resulting from the Contractor's delay. The disincentive amount is calculated based on department-related traffic control and maintenance costs, detour costs, or daily road user costs, as applicable.

The Contractor waives any defense as to the validity of any disincentives stated in the Contract, the Specifications, or this Special Provision, and assessed by the Department against the Contractor on the grounds that such disincentives are void as penalties or are not reasonably related to actual damages.
