JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA) UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

D. Justification:
The justification for this non-competitive action is: The HIMSS Global Conference Interoperability Showcase, Aug 9th – 13th, 2021 held in Las Vegas, NV, is a forum where various healthcare/public health use cases are demonstrated showing how standards-based systems and technologies are exchanging data to support an Interoperability Story. The Showcase provides an opportunity for CDC programs to demonstrate standards-based interoperability and health information exchange between public health and healthcare information systems. These demonstrations are further supported by the IHE Connectathon which is held March 1-5, 2021 held in the cloud where CDC programs work with vendors to test out various IHE profile e.g.
Cancer, Vital Records, and more prior to participating in HIMSS.
Since CDC has an organizational affiliate membership with HIMSS supporting multiple programs, the cost to participate in the HIMSS Interoperability Showcase is reduced by 10% from $65k to $59k at a cost of $9,834 per participating program. Currently the following CDC programs will be demonstrating systems within the Showcase and have agreed to the cost-share:
· Cancer Reporting(NCCDPHP)
· Electronic Case Reporting (eCR) and MEDMorph (CSELS)
· Vital Records – Birth and Death Reporting (NCHS)
· Occupational Data for Health (NIOSH)
· Hospital Reporting (NCEZID)
· Vaccine Administration (NCIRD) The CDC wide contract will incorporate multiple use cases, multiple systems with multiple exhibitor registrations thus creating one process for CDC versus multiple processes for approval and payment. CDC will demonstrate an ‘interoperability story’ at the HIMSS21 Interoperability Showcase. Proposed ‘story’ would include CDC systems and partners participating in a public health interoperability story through the following opportunities at the HIMSS21 Showcase:
· Private Meeting Room

(ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
· Urgency
· Exclusive licensing agreements/Proprietary data

· In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
· Urgency
· Only One Source
· Logical Follow Up

2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
HIMSS is uniquely positioned to support CDC’s demonstrations in their 2021 HIMSS Global Conference & Exhibition, August 9th-13th, 2021 in Las Vegas, NV. The Interoperability Showcase is held annually in conjunction with the annual HIMSS conference which brings together 40,000+ health IT professionals, clinicians, executives and vendors from around the world. HIMSS offers health IT educational sessions, Health IT leaders/speakers, cutting-edge health IT products and powerful networking opportunities for public health to engage with industry leaders. HIMSS offers more than 300 education programs featuring keynotes, thought leader sessions, roundtable discussions and workshops, plus a full day of preconference symposia. CDC programs participate each year in demonstrating the value of public health systems using health IT standards to effectively exchange and use data from health care information systems, e.g.
EHRs. Since this is a HIMSS related activities, HIMSS is the only contractor that can provide this service.
b. What other products/services were considered and why did they not meet the need?
Other contractors were considered, but a search of the internet revealed that there are not other organizations that offer this membership or program benefits. As a result, HIMSS is the only source that can fulfill the requirement for this action.
3. Program Office efforts to seek potential offerors:
Market research yielded no other vendors in this field. There are no other such venues/showcases for this kind of work and HIMSS is the only option. It is not expected that other contractors besides HIMSS will be able to offer services to coordinate and support CDC’s demonstrations and participation in the HIMSS Interoperability Showcase.
E. Program Office Certification:
I have reviewed this sole source justification and certify the justification is true and accurate to the best of my knowledge and adequate to support other than full and open competition.
