Source Selection Information – see FAR 2.101 and 3.104
JUSTIFICATION OF SINGLE SOURCE SOLICITATION
UP TO THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
Contract # - 1240BF21P0009 – Corner Bay
1. Agency and contracting activity. Department of Agriculture, Forest Service, Procurement and Property Services
(PPS) and Tongass National Forest.
2. Description of supplies or services required to meet agency needs.
Time and Materials contract for urgent road and bridge repairs due to extreme weather conditions in remote area.
Expected period of performance 12/18/2020 – 5/31/2021. Ceiling price: $49,460.40.
Identification of the awardee to be solicited. TLC Management LLC, Gordon Chew.
3. Authority and supporting rationale. The contracting officer has determined the circumstances of the contract action to meet the following statutory authority under FAR 13.106-1(b)(1): Unusual and compelling urgency – When the Government would be seriously injured if full and open competition is sought, the agency is permitted to limit the number of sources solicited.
SE Alaska has had unusual amounts of rain which is causing flooding, landslides, and road damage. SE Alaska is comprised of many islands making it extremely difficult to mobilize quickly in emergency type situations. The Corner Bay area needs road and bridge repairs performed quickly which will require a local Contractor that has the capability to immediately respond and begin clean-up work with equipment nearby. These repairs are of an urgent nature due to the potential costs associated with more damage occurring by succumbing to another rain event like the one that caused the flooding, landslides and damage. High flows in rivers/streams and floods caused roads to washout, plugged drainage structures, loss of surfacing materials, and a 50’ bridge to be dislodged off of its abutments. Also, this road system serves as a major haul route for a local independent Timber Sale operator who is currently shut down due to the wash outs, slide debris covered roads. This has the potential to cause significant loss of revenue for the Timber Sale Purchaser, laid off employees, as well as, a potential contract claim with the Forest Service from the Timber Sale Purchaser.
4. Determination.
FAR 13.106-1 (b)(1)(i) Authorizes Contracting officers to solicit from a single source for purchases not exceeding the simplified acquisition threshold. Based on the justification provided, it is my determination that the circumstances of this acquisition deem only one source is reasonably available (reference FAR 13.106-1(b)). Based upon the requirements of FAR 12.209 (Commercial) and 13.106-3 (SAP):

5. Approval.
I certify that I have reviewed the justification provided above, and it appears to be accurate and complete to the best of my knowledge and belief. As such, this justification is approved.
