About this file

This is a Memorandum to the File documenting a determination of sole-source justification for a FAR Part 13 acquisition under the Simplified Acquisition Threshold for the U.S. Marine Corps.

The required item is a Mobile Ordnance Deformer, a specialized diesel-powered mobile system designed to process spent ammunition cartridges up to 20mm at a rate of 8,000 to 11,000 pounds per hour. The equipment features a high-speed rotary drum grinder, integrated hydraulic infeed and discharge conveyors, a heavy-duty hopper, and centralized control panel, all mounted on a low-profile trailer with electric brakes and safety lighting. The system is transportable in a single 40-foot High Cube shipping container. Operating in conjunction with the facility's Safety Certification Unit, the deformer deforms and crushes expended brass cartridges of .50 caliber and below in compliance with MCO P8020.10, NAVSEA OP-5, and MCO 5530.14A to ensure physical demilitarization prior to scrap yard transfer or sale. The sole-source determination is based on exclusive licensing agreements, as Bouldin & Lawson, LLC is identified as the sole manufacturer and proprietary source of the Mobile Ordnance Deformer. The justification emphasizes that this specific equipment is uniquely engineered to interface seamlessly with the Marine Corps' existing Bouldin & Lawson Safety Certification Unit, and utilizing any other manufacturer's system would result in critical integration failures and require costly, unauthorized modifications to the current configuration.

MEMORANDUM TO THE FILE

Subj: DETERMINATION THAT ONLY ONE SOURCE IS REASONABLY

AVAILABLE FOR A FAR PART 13 ACQUISITION UNDER THE SIMPLIFIED

ACQUISITION THRESHOLD

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

The Mobile Ordnance Deformer is a highly specialized, fully integrated, and diesel-powered mobile system designed for high-capacity material processing. Built upon a rugged, low-profile trailer equipped with electric brakes and highway-compliant safety lighting, the unit features a high-speed rotary drum grinder capable of processing spent ammunition cartridges up to and including 20mm at a rate of 8,000 to 11,000 pounds per hour. To ensure seamless, continuous operations, the system is engineered with integrated, hydraulically driven infeed and discharge conveyors, a heavy-duty end-mounted hopper, and a centralized control panel, all requiring a single 40-foot High Cube shipping container for global transport.

In strict compliance with MCO P8020.10, NAVSEA OP-5, and MCO 5530.14A, this unit is utilized to safely and rapidly deform expended brass cartridges to ensure they are rendered completely unusable prior to transfer or sale to an approved scrap yard. Operating in direct sequence with the facility's Safety Certification Unit, which inspects and detonates any potential live ordnance before it enters the grinding chamber, the deformer provides a critical, closed-loop safety solution. By bending and crushing spent ammunition casing of .50 caliber and below, the system guarantees physical demilitarization, eliminates safety hazards, and satisfies all federal and military regulations governing the disposal of expended small-arms range residue.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

A. X ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. __ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

V 1.6 (20 December 2023)

2. X EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

Bouldin & Lawson is the sole manufacturer and proprietary source of the Mobile Ordnance Deformer. This specific equipment is uniquely engineered to interface seamlessly with the Marine Corps' existing Bouldin & Lawson Safety Certification Unit. Utilizing any other manufacturer's system would result in critical integration failures and require costly, unauthorized modifications to the current configuration.

3. ___ OTHER REASONS.

B. ___ BRAND NAME

Item required must be a brand name, product, or feature of a product, particular to one manufacturer.

C. ___URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:
