MEMORANDUM

Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE MET LAB FLOW CALIBRATOR FROM MESA LABS (Purchase Request 1301027049)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a purchase order, on a sole source specific basis, to acquire calibration equipment from Mesa Labs, 12100 W 6th Ave, Lakewood CO 80228.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The estimated value of this procurement is approximately $44,018. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This procurement will be funded with 2022 Operation and Maintenance, Navy (OMN) funds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The equipment listed above is manufactured by Mesa Labs. Additionally, Mesa Labs is the only authorized distributor for the region where NEDU is located. This instrument is critical in unmanned and manned testing apparatus for equipment calibration, used in support of life support systems. This instrument critical to daily operations at NEDU and are used for both unmanned and manned hyperbaric testing. The DryCal equipment requested, only available from Mesa Labs, are the ONLY equipment compatible with the current installed hardware and software control systems. These are propriety assemblies; other sources do not have the rights, equipment to manufacturer, or provide these listed parts. Other manufacturer’s consoles are not compatible with the established breathing simulator hardware and software in use at NEDU. Therefore it is imperative that this equipment is acquired from Mesa Labs.

In summary, using alternate equipment would prove costly in time and dollars to the Government and to the mission. Use of another system may change or introduce new parameters that may be harmful to all diving systems tested and maintained at NEDU. Therefore, it is imperative that this equipment is acquired from Mesa Labs immediately.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

As stated in paragraph 4 above, the DryCal 1020 from Mesa Labs as specified is the only source that can meet this requirement or satisfying the government’s needs and the items proposed for procurement meet the commercial item definition. Therefore, no additional market research was conducted because section 4 of this document dictates proprietary modular console design.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the DryCal 1020 from Mesa Labs is the only product that can meet all Government requirements.
