About this file

This is a Class Justification and Approval (CJ&A) document for the use of other than full and open competition in federal contracting.

The Naval Surface Warfare Center, Crane Division (NSWC-CD) seeks to award a Firm Fixed Price Blanket Purchase Agreement (BPA) on a brand name only basis to Times Microwave Inc. and authorized distributors for cables, connectors, and attaching hardware. These supplies support depot maintenance actions and fleet operations, with estimated requirements valued at a maximum amount over five years (specific dollar amount redacted). The authority to act under this CJ&A expires on September 30, 2030. The procurement is justified under 41 U.S.C. 1901 based on the technical necessity of Times Microwave brand products. The cable sets are used across currently installed systems and incorporate specific electrical characteristics required to achieve full system performance. Various cables and connectors function as matched sets with phase matching and electromagnetic performances calibrated to each other. The Government does not own the complete data package for these proprietary cables and parts. Purchasing alternative brands would require complete modification and redesign of system interconnections and associated assemblies, resulting in an estimated cost increase of $40 million and a five-year schedule delay. The Contracting Officer has determined the anticipated costs will be fair and reasonable. An extensive market survey showed multiple vendors interested, making this suitable for a multiple award BPA structure. NSWC-CD has no current plans to compete future purchase orders for these supplies given the technical constraints, though the organization will assess competition feasibility if alternative sources emerge.
