JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Undersea Warfare Center (NUWC) Division, Keyport
2. Description of the Action Being Approved.
Award of a firm-fixed price contract modification on a sole source basis for construction services in support of Building 894 Create A Secure Boundary from Chinook Properties, Inc.
3. Description of Supplies/Services.
N0025324C6004 was issued as a competitive, firm fixed-price, construction contract for
$478,724.86 with a period of performance of 3 March 2025 through 2 January 2026. The Statement of Work (SOW) required the contractor to provide security upgrades including adding security bars to duct work, door removal and wall infill, capping tube skylights and other upgrades such as welding door hinge pins, adding security locks, badge readers, and astragals to enhance door security.
This contract modification will add additional upgrades not identified in the original statement of work that are required for door security to create a secure boundary. The door security upgrades include sensors, alarm system expansion modules, and
Switches. The mechanical room is removed from the secure boundary which changes the door lock , steel bars to be added to and adds egress device. The estimated cost of this modification is and will be funded by FY25 Capital Improvement Program (CIP) funds.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority.
The original contract N0025324C6004 is not completed and competing the required additional work would result in a minimum duplicative cost to the government in the amount of which includes costs for mobilization/demobilization, rental equipment, and bonding. The estimate was developed using historical actual pricing. Additionally, there are currently two contractors working in the affected space with one contractor resurfacing the floors. A third contractor risks disruption to the existing execution schedules and the contractors' ability to successfully meet their deadlines.
Conducting a separate procurement for these services would unacceptably delay the completion of the subject project by due to additional requirement development and procurement lead times. This project is to support the Naval Undersea Warfare
Center, Division Keyport (NUWCDIVKPT). A delay in the project’s completion will negatively impact the production capability and the mission readiness of the programs that support the Navy’s mission.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed contract was synopsized on the SAM website on 5 December 2024 and only two companies expressed an interest in this requirement. No additional market research was conducted for this action because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Chinook Properties, LLC, to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NUWCDIVKPT has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NUWCDIVKPT will assess whether competition for future requirements is feasible.
