Justification and Approval for Other than Full and Open Competition (See AFARS 5153.303-5)
1. Contracting Activity: U.S. Army Corps of Engineers, St. Louis District Contracting Office
2. Description of Action: Approval is for a new contract for Sewer Services in City of Findlay, for Lake Shelbyville. This will be a Firm-Fixed Price contract using Operation and
Maintenance funds.
3. Description of Supplies/Services: The Contractor shall provide a sewage system connection to the City of Findlay sewage treatment system for Lone Point Recreation Area and Coon Creek Recreation Area; then treat and perform sewer services, and operate and maintain the lift stations for the Lone Point and Coon Creek Recreation Areas at Lake
Shelbyville, in Shelby County, Illinois for a period of ten ( 10) years from date of award. The
Contractor agrees to furnish and the Government agrees to purchase sewer utility service in accordance with the applicable tariff(s), rules, and regulations as approved by the applicable governing regulatory body and as set forth in the contract. The cost of this service is
$688,000.00, plus monthly sewage service utility charges.
4. Authority Cited: 10 United States Code 2304 and 40 United States Code 113(e)(3) as implemented in Federal Acquisition Regulation 41, Acquisition of Utility Services.
5. Reason for Authority Cited:
a. Background: Historically, Lake Shelbyville has provided their own sewer services with sewage lines going from Lone Point Recreation Area to Coon Creek Recreation
Area to Opossum Creek Recreation Area where their water plant is located. The current sewage lines cross over the lake three times, and have worn down over time.
Lake Shelbyville can either shut down their recreation areas to re-build the sewage lines where they currently are to continue operations with their own water plant; or they can have the Village of Findlay create a connection to the Lone Point and Coon
Creek Recreation Areas. The cost of paying the connection fee to the Village of
Findlay and paying a monthly utility service fee is significantly cheaper, and less invasive in the operations of the campgrounds. The cost estimate of Lake Shelbyville replacing the sewer line from Lone Point to Coon Creek is estimated to be at least
$782,960.00; plus approximately $17,000 per year in treatment costs. It is in the
Government's best interest to receive sewage services from the Village of Findlay for the foreseeable future.
