ADDENDUM 2
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be sued to evaluate offers: Technical and Price. The Government will rank quotes according to the overall price, from lowest to highest. The Government will proceed by technically evaluating only the lowest-price quote. If that quote is deemed technically acceptable, no other quotes will be evaluated; however, if it is found technically unacceptable, the second-lowest priced quote will be evaluated in the same manner. This process will continue until an awardee is determined. To be eligible for award, the offeror's quote must be found to be technically acceptable and their proposed price fair and reasonable.
1. Technical: The Government will evaluate the adequacy of the offeror’s software as specified in the Attachment 1 SOW.
The quoted software license must meet the specifications in the SOW. If the offeror is submitting a software license that is Equal to GrayKey, then the quote must be sufficiently complete to demonstrate how the software’s salient characteristics meet the requirements of the SOW.
Table A-1. Technical Rating
Technically Acceptable Quote meets the minimum requirements of the solicitation.
Technically Unacceptable Quote does not meet the minimum requirements of the solicitation.
2. Price: The offeror’s proposed price must be found to be fair and reasonable utilizing one of the techniques under FAR 13.106-3(a), Basis for award. The Offeror shall provide their proposed firm-fixed prices in the Pricing MS Excel Template (Attachment 2), which will be used to evaluate price for the award.
For evaluation purposes only, the total evaluated price is the sum of the following for the contract: Total prices submitted for
(a) the base period and (b) all option periods. Contractor shall enter these prices into Attachment 2 Pricing Template.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
