1.5 ANTITERRORISM (AT) AND OPERATIONS SECURITY (OPSEC)
1.5.1 General Security Requirements and Guidance
The security requirements described below apply to Contractor personnel (including employees of the prime Contractor ("Contractor") and all subcontractor employees) supporting the performance requirements of this Contract. Address questions regarding security matters to the Contracting Officer. Contractor personnel are critical to the overall security and safety of USACE installations, facilities, and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; applicable Contractor personnel must complete initial training within 30 days after receiving Notice to Proceed. Notify the Contracting Officer within five business days of completing the training. Include documentation of the names of Contractor personnel trained and which training has been completed; maintain training records as part of Contract files; and be prepared to provide copies of training certificates to the Contracting Officer. Contractor personnel and vehicles are subject to search when entering Federal installations. Comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (RAMs), and Health Protection Condition (HPCON) measures. Meet performance requirements during elevated FPCON and/or HPCON levels in accordance with USACE plans and procedures. This includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by FAR 52.243-4 CHANGES, if the FPCON or HPCON levels change at any individual facility or installation, the Government may implement security changes that affect Contractor personnel. Ensure that Contractor personnel are aware of their security responsibilities, including site-specific requirements identified in local policies or procedures.
1.5.2 Physical Security and Access Control Requirements
a. Overview: Contractor personnel requiring physical access to a USACE facility must comply with the access control procedures of that location. Contractor personnel requiring unescorted access to meet Contract performance requirements will be vetted by the USACE Rock Island District Security and Law Enforcement Office (CEMVR-SL) using the National Crime Information Center Interstate Identification Index
SECTION 01 14 00 Page 4
(NCIC-III) and Terrorist Screening Database (TSDB). Contractor personnel must comply with personal identity verification requirements as specified. Contractor personnel who do not meet requirements for unescorted access to Government installations must coordinate escorted access with the Contracting Officer. Contractor personnel who receive keys, access cards, or lock combinations that provide access to Government-owned property must comply with USACE key and lock control procedures.
b. Definition: For the purposes of this Contract, USACE facilities are defined as any USACE owned or leased property for which entry is controlled and limited to authorized USACE employees, Contractors, and official visitors.
c. Procedures:
(1) Contractor personnel may have unescorted access within controlled areas upon completion of an adjudication of fitness by CEMVR-SL and entry onto an access control list (ACL) for the facility/project. Submit background checks conducted by a bonded third party within the last six months of Notice to Proceed and authorize reports to be provided to CEMVR-SL by the third party.
Background checks must consist of a check of NCIC-III and TSDB when available. Individuals may be denied access to Rock Island District controlled facilities and/or property if the results of the third party NCIC-III equivalent background check gives an indication that a person may present a threat to the good order, discipline, safety, or security of the facility. This information includes, but is not limited to a person who has:
(a) The background investigation contains criminal arrest information about the individual that causes the senior commander to determine that the person presents a threat to the good order, discipline, or health and safety on the installation.
(b) A claimed identity that cannot be verified based on the reasonable belief that the person submitted fraudulent identity information in the attempt to gain access.
(c) Current arrest warrant in NCIC, regardless of the offense or violation.
(d) Current bar from entry or access to another Federal installation or facility.
(e) Conviction of crimes encompassing sexual assault, armed robbery, rape, child molestation, production or possession of child pornography, trafficking in humans, or drug possession with intent to sell or distribute.
(f) Conviction for espionage, sabotage, sedition, treason, terrorism, or murder.
(g) Being registered as a sex offender.
(h) Felony conviction within the last 10 years regardless of the offense or violation.
SECTION 01 14 00 Page 5
(i) Felony conviction for a firearms or explosives violation regardless of when the conviction occurred.
(j) Engaged in acts or activities designed to overthrow the U.S.
Government by force.
(k) Been identified as known to be, or is suspected of being, a terrorist or belonging to an organization with known links to terrorism or support of terrorist activity.
(2) Short term Contractor personnel working at the USACE facility or project for less than 15 calendar days may be escorted at the USACE facility by a USACE employee or other Contractor personnel that is on the ACL for the facility or project. Names and dates of work for short term Contractor personnel must be submitted to CEMVR-SL via e-mail at cemvr-sl@usace.army.mil to be added to the ACL for the period they will be working at the facility.
d. In addition to the submitted background checks, supplemental agency checks may be performed at the discretion of CEMVR-SL personnel.
Cooperate and ensure that Contractor personnel provides documentation required to complete these checks. Any person lacking proper identification credentials or deemed a security threat may be denied access to the project. Such action in no way relieves the Contractor from performance of the Contract. USACE Rock Island District retains the right to deny Contractor personnel from working on a USACE Rock Island District Contract based on final background investigation results.
e. Contractor personnel denied access based upon derogatory information from the NCIC-III or equivalent check may apply to the District Commander for a waiver. To obtain a waiver, Contractor personnel must:
(1) Obtain a certified copy of their complete criminal history including arrests and convictions.
(2) Obtain a letter of support from their USACE sponsor. The letter must indicate that the sponsor requests that the person be granted unescorted access to accomplish a specific purpose as well as the anticipated frequency and duration of such visits. If Contractor personnel is terminated, the sponsor must inform the CEMVR-SL so that unescorted access is no longer authorized.
(3) Submit a letter requesting the access denial be waived, to the USACE sponsor who will submit it to the District Commander. The letter must include offenses, including an explanation of why the conduct should not result in denial of access. Other factors that the sponsor or requesting individual should address are the:
(a) Nature and seriousness of the conduct;
(b) Specific circumstances surrounding the conduct;
(c) Length of time elapsed since the conduct;
(d) Age of the person at the time of the incident or conduct;
(e) Proof of efforts toward rehabilitation; and
SECTION 01 14 00 Page 6
(f) Current mailing address or email address for Army communications.
(4) The USACE sponsor will review the person's information for completeness and determine whether to endorse the request for a waiver.
(5) If the USACE sponsor endorses the waiver letter, the sponsor will provide a letter of recommendation for the person. The letter must address the relevant conduct that caused the denial and indicate why the conduct should not prohibit the person from being granted unescorted access. The USACE sponsor will submit the letters to the District Commander.
(6) The District Commander will render a determination in line with good order, discipline, and health and safety of the facility.
The District Commander will provide a copy of the determination to the person.
(7) The results of the District Commander's decision will be provided to the CEMVR-SL to update the Access Control List for the project.
(8) Persons who had a waiver request denied may request reconsideration from the District Commander one year after the date of the Commander's decision. Persons may request reconsideration earlier if they can present significant information that was not available at the time of the original request or show that the basis for the original denial was overturned, rescinded, or expired.
f. If an unexpected change in personnel is required due to sudden absence of critical path Contractor personnel, immediately contact the Contracting Officer to coordinate obtaining written approval from CEMVR-SL for new or additional Contractor personnel to be brought on-site prior to background check acceptance. Submit ATTACHMENT A - Personnel Change Request Form to receive written authorization from CEMVR-SL prior to bringing new Contractor personnel on-site. Ensure that a background check is sent to CEMVR-SL no later than 10 days from written notice of approval. USACE Rock Island District reserves the right to terminate access of Contractor personnel upon review of the background check. The Contractor will be notified immediately of any such Government decision.
g. If an unforeseen change in work site conditions, which may require a Contract Modification, causes the immediate addition of Contractor personnel, submit ATTACHMENT A - Personnel Change Request Form to receive written authorization from CEMVR-SL prior to bringing new personnel on-site. Ensure that a background check is sent to CEMVR-SL no later than 10 days from written notice of approval. USACE Rock Island District reserves the right to terminate access of Contractor personnel upon review of the background check. The Contractor will be notified immediately of any such Government decision.
1.5.3 E-Verify Program

Payment will not be made for excavation in any area not adjacent to, and in prolongation of, areas where full depth has been secured except by decision of the Contracting Officer. Should any nonadjacent area be excavated to full depth during the operations, payment for all work will be deferred until the required depth has been excavated as specified and indicated. If an interim survey is deemed in the best interest of the Government, an interim survey may be performed by the Government and partial payment for completed work may be applicable. The Contractor may request an interim survey for partial payment be performed by the Government during a Task Order. There is no guarantee the Government will be able to perform the interim survey when requested. Government survey will be the basis for measurement and payment. The Contractor may be required to suspend dredging at any time when, for any reason, the gages or ranges cannot be seen or properly followed.
1.15 DREDGING PRODUCTION SCHEDULE
Schedule operations in order to perform a minimum of 4,000 cubic yards per day of channel maintenance dredging or 20,000 cubic yards per week and a minimum of 1,000 cubic yards per day of small boat harbor dredging.
Operations shall be 24 hours per day, 7 days per week, including holidays, except as otherwise specified. Notify the Contracting Officer of the means, methods, and schedule to regain lost production.
Durations for task orders will be calculated based on adding the time for volume to be dredged, time for transportation between sites, and time for set up, break down, and reconfigurations of pipe as follows:
a. Time for Volume Dredged Dredge volume / 4,000CY per day, rounded up to the nearest day
b. Time for Transportation Between Sites River miles / 4mph + 3 hours per lockage, rounded up to the nearest day
c. Time for set up, break down, and reconfigurations For pipeline needs of 0 feet to 5,000 feet of length:
2 days for set up, 2 days for break down For pipeline needs of over 5,000 feet of length:
3 days for set up, 3 days for break down For pipeline reconfiguration, if applicable:
2 days for reconfiguration
For example: 57,000CY cut. 2,500 feet of pipeline required, one reconfiguration required, 100 river miles of transport, one lockage.
57,000CY / 4,000 CY/Day = 14.25 days round to 15 days 2,500 feet of pipeline = 2 days setup + 2 days breakdown = 4 days One reconfiguration = 2 days 100RM / 4mph = 25 hours + 3 hours lockage = 28 hours round to 2 days.
Total = 15 + 4 + 2 + 2 = 23 days for task order
The first dredging task order following issuance of mobilization will not include days for setup as those will be incidental to mobilization.
Potential dredging locations, potential placement locations, and dredging statistical information are attached, see Section 01 30 00 ADMINISTRATIVE REQUIREMENTS. The river miles for these dredging locations and dredge material placement sites will be provided per Task Order. These
SECTION 01 14 00 Page 11 computation sheets are compiled from historical data; they are not a warranty or representation as to which specific areas will require dredging, the quantities to be dredged, or the placement sites which will be used under this Contract.
1.16 SHOALING
If shoaling occurs in any section previously accepted, notify the Contracting Officer before the Task Order is completed. The Government will survey the shoal at its discretion. Redredging may be required if:
a. It is agreed by the Contracting Officer that shoaling has occurred;
b. Shoaling occurred due to natural processes; and
c. A Task Order price is agreed upon by both the Contractor and the Contracting Officer.

1.3.2.2 Measurement
River miles are defined as the distance on the marked navigation mid channel sailing line as detailed on the Illinois Waterway Navigation Charts (current edition). River Miles will be computed from the navigation charts. They will be computed from the marked navigation channel at a point directly perpendicular to the center of the entire current dredge cut to the marked navigation channel at a point directly perpendicular to the center of the entire next dredge cut, and rounded to the nearest tenth of a mile. Under this Contract, payments will not be made when the distance traveled between assignments is 2 miles or less. The dredge and attendant plant will not be given priority over the other waterway users for lockages through the locks. Observation of normal queuing procedures is required unless otherwise permitted by the lockmaster. Prepare the tow for efficient and safe lockage. Ensure that all equipment is secured for moving between dredging sites. No separate payment will be made for delays while transiting between sites. Movement between sites is considered as a single movement regardless of the number of trips made between the start point and the end point. The distance for transportation of plant will be measured from the previous Task Order dredge or mooring site or the Contractor's current location to the next Task Order dredge or mooring site, whichever is less.
1.3.2.3 Unit of Measure

1.3.4.3 Unit of Measure
Unit of measure: nearest hour.
1.4 CONTRACT MAXIMUM AND MINIMUM
1.4.1 Maximum
Task orders will not exceed a cumulative amount of $25,000,000 for the length of the Contract, as set forth in Clause 52.216-22(b) INDEFINITE
QUANTITY.
1.4.2 Minimum
The Government is obligated to order no less than $50,000 of work specified in the Schedule of Prices for the ordering periods and any exercised subsequent ordering period, as set forth in Clause 52.216-22
INDEFINITE QUANTITY.
1.5 ADJUSTMENT TO FUEL PRICE
This paragraph prescribes the adjustments that will be made to the unit price(s) for certain Contract Line Items in the event of changes (either upward or downward) in diesel fuel prices. The Contracting Officer will calculate the Adjustment to Fuel Price (AFP) for the affected Contract line item unit prices on an individual task order basis. These adjustments are premised on the assumptions set forth in this clause and will be applied uniformly regardless of the Contractor's actual cost experience in performing the work under this Contract.
For purposes of this adjustment, the Contracting Officer will use a Base Fuel Index (BFI). The BFI will be the published price (in dollars/gallon) in effect for Diesel Fuel (all types) for the Midwest (PADD 2) Region as established by the Energy Information Administration (EIA) on 02 June 2025. This information is published at https://www.eia.gov/petroleum/gasdiesel/ . The index is currently updated on a weekly basis.
A Current Fuel Index (CFI) in dollars per gallon will be established at issuance of each task order. The CFI will be the published price in effect for Diesel Fuel (all types) for the Midwest (PADD 2) Region as established by the Energy Information Administration (EIA) in effect on the first calendar day of the month during which the task order is issued by the Contracting Officer. The AFP (addition or subtraction) to the unit price for a given line item will be computed by application of the following formula:
SECTION 01 20 00 Page 7
AFP = ((BUP*% Fuel Cost) / (BFI - 0.513))*(CFI-BFI)
Where:
" AFP = Adjustment to Fuel Price " BUP = Bid Unit Price, the unit prices for each applicable Contract line item " CFI = Current Fuel Index (in dollars per gallon) " BFI = Base Fuel Index (in dollars per gallon) = $3.388 on 02 June 2025 " % Fuel Cost = presumed percentage of bid item cost attributable to fuel for a given Contract Line Item subject to adjustment under this clause as indicated in the table below (this percentage IS NOT subject to adjustment as a result of the Contractor's actual cost experience) " 0.513 = the presumed fuel tax rate (in dollars per gallon)
1.5.1 Basis of Adjustment
The AFP will be calculated and applied to (added or subtracted from the price of) each unit of each Contract Line Item Number (CLIN) identified in the table below, that will be used in a given task order. The adjustments to the unit prices for a given task order will be used for the life of that task order, including any modifications or adjustments to it. The adjustments will be rounded to the nearest cent; prices of elements within the formula will be rounded to the nearest tenth of a cent (three decimal places). CLINS not listed in the table below are not subject to adjustment for changes in fuel price under this or any other clause of the Contract.
