PERFORMANCE WORK STATEMENT
PART I - INSTRUCTIONS & NOTICE TO OFFERORS
1. REQUIRED SAM REGISTRATION:
Prior to submitting an offer, offerors must be actively registered in the System for Award Management (SAM) website. Registration instructions may be obtained, and online registration may be accomplished, at www.sam.gov.
2. SCOPE OF WORK:
The Scope of Work is described with the solicitation. Offerors should understand the services requested and then bid an appropriate amount on the Schedule of Prices/CLINS.
3. SCHEDULE OF PRICES (CLINS):
Offerors must quote on all items and entire quantities contained in the basic period and all ordering periods to be considered for award. Offers received not complying with this requirement will be considered non-responsive and will be rejected.
4. WAGE RATES:
Prevailing Wage Rates will apply for any award resulting from this solicitation. See the included Wage Determination, and contract clauses 52.222-41, Service Contract Act of 1965 for details.
5. DOCUMENTS TO RETURN:
In order to be considered responsive, offerors shall complete and return all of the following:
□ Solicitation Cover Sheet, including Taxpayer ID Number, CAGE Code, Point of Contact, Phone Number and Email Address
□ First page of solicitation, including offeror’s complete mailing address, telephone number, of feror’s name, title, and signature.
□ Schedule of Prices (CLINS)
□ The Contractor must have an ISA Certified Arborist on-site while work is being performed and submit an arborist certificate in the solicitation packet.
See contract clause FAR 52.212-2 “Evaluation – Commercial Items” for evaluation factors.
Of ferors must complete all fill-ins and assure all return pages are received by the due date and time shown on page one of the solicitation. Please mark the solicitation e-mail with the Solicitation Number and Project Title and address to anne.m.fleischman@usace.army.mil.
6. TELEPHONE NUMBER:
Offerors must provide on the first page of this solicitation a telephone number at which they can be contacted for a period of one week following the due date of this solicitation. Quotes from persons who cannot be contacted by telephone during normal office hours (8:00 a.m. through 4:00 p.m., CST) within the one-week period following closing of this RFQ will be considered non-responsive and will be removed from further consideration.
7. LENGTH OF CONTRACT:
Performance of the Tree Maintenance IDIQ will be from 01 June 2022 (or date of award if later) to 31 May 2027.
8. GENERAL:
1. The Contractor shall provide all equipment, supplies (unless specified otherwise), labor, and supervision necessary to perform the work described herein at various locations throughout Saylorville Lake managed area.
2. Each work item shall be performed according to the specifications described herein and in the delivery order.
3. The Contractor must have an ISA Certified Arborist on-site while work is being performed.
9. WORK LOCATIONS:
1. Work sites are widely scattered and vary in topography, vegetative cover, and access for equipment. Several work sites may be contained within the same delivery order, providing for efficiency and economy of scale. However, travel time between sites should also be considered and bid accordingly. Include mobilization in bid price. Actual delivery work order may include multiple sites with same vicinity.
2. General location sites are indicated on the Saylorville Lake Area Map. All delivery orders shall include fieldwork site locations with accompanying maps and description of each area.
10. SPECIAL INSTRUCTIONS:
1. Thoroughly read the Scope of Work, attached herein of the request for quotation. Your bid should be based on the requirements of the job and what it will take to successfully complete the job.
2. Bids should be quoted on the Bid Schedule. Bidders should refer to Scope of Work for a description of work to be performed and quantities identified on Bid Schedule when quoting a bid.

3. The breakdown of unit price is included for evaluation, for invoicing prices for each service, and may be used in determining deductions for deficiencies in accordance with the contract clause.
11. EVALUATION OF ORDERING PERIODS:
1. The Government will evaluate offers for award purposes by adding the total price for all ordering periods to the total price for the basic requirements.
2. Evaluation of ordering periods will not obligate the Government to exercise the option (s).
3. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
12. ANTITERRORISM (AT) AND OPERATIONS SECURITY (OPSEC)
1. ACCESS AND GENERAL PROTECTION POLICY AND PROCEDURES
**NOTE: To protect the privacy of the Contractor, all Contractor employees, and all sub-contractor employees, background checks, OPSEC SOPs, E-verify, and I-9 forms shall be submitted with a coversheet stating the contract number (e.g. W912EK-19-C-XXXX), title of project, and the company's point of contact information, in a sealed envelope/container and mail:

Security Clause 1.
AT Level 1 Training. All Contractor and sub-contractor employees requiring access to non-public or private Government property must complete Anti-Terrorism (AT) Level 1 Training within 30 calendar days after notice to proceed date. The required training is under the heading “JS-US007-14: Level 1 Antiterrorism Awareness Training.” Contractor employees who have a Common Access Card (CAC) may log in with their CAC. Contractor employees without a CAC shall log into the “Non-CAC users” link and need to complete the training all at once, as no record of training shall be maintained aside from the certificate that is printed upon completion. All AT Level 1 Training certificates must be submitted to the Contracting Officer within 5 calendar days of completion.
Security Clause 2(b).
For Access and General Protection Policy and Procedures. All Contractors and sub-contractor employees shall comply with installation and facility access guidelines and rules as stated herein. Contractor workforce must comply with all personal identity verification requirements as directed by Department of Defense, Department of the Army Headquarters, Rock Island District and/or local policy. In addition to the changes otherwise authorized by the Changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in Contractor security matters or processes.
In support of Rock Island District evaluation of personnel authorized for access to federal facilities, the Contractor shall submit background checks that have been conducted by a bonded third party within the last 6 months of Notice to Proceed date and authorize reports to be provided to the Rock Island District Security and Law Enforcement Office by the third party. The background check will cover, at a minimum, the ten years covering states the employee has lived in, national criminal records check which includes felony and misdemeanor offenses, Department https://jkodirect.jten.mil/Atlas2/faces/page/login/Login.seam of Motor Vehicles records, and a national sex offender registry check, submitted 14 days prior to accessing the project site.
Identif ication Badges: The Contractor shall be responsible for furnishing a photo identification badge/card to each employee prior to the employee's work on-site, and for requiring each employee engaged on the work to display identification. At a minimum, the badge shall have the following items shown, the employee’s picture, employee’s name, and company name working for. The badge will be prominently displayed unless restricted for safety concerns, in which case it will be available for immediate display upon request (carried on person).As employees are added or deleted from the submitted and approved Access Control List (ACL), this information will be reported immediately to the Contracting Officer (KO). Added employees will not be permitted on-site until requirements of this paragraph are completed, submitted, and approved.
Disqualifying factors include, but are not limited to:
1. Criminal conduct, in particular violent crime and sex offenders;
2. Habitual use of intoxicating beverages to excess as evidenced by Driving under the inf luence or public intoxication records; or
3. Any illegal activity or other disqualification which makes the individual unfit for service
(e.g. drug trafficking or procurement fraud).
In addition to the submitted background checks, supplemental agency checks may be performed at the discretion of the Rock Island District security personnel. The Contractor agrees to cooperate and ensure that Contractor personnel provide any documentation required to complete these checks. Any person lacking proper identification credentials or deemed a security threat may be denied access to the project. Such action in no way relieves the Contractor from performance of the Contract. The Rock Island District retains the right to deny any Contractor and sub-contractor employee from working on a contract awarded by the Rock Island District based on final background investigation results. All information received as a result of a background check will be handled according to Privacy Act regulation.
In the event that an unexpected change in personnel is required, due to sudden absence of a critical path employee, the Contractor shall immediately contact the Contracting Officer to coordinate obtaining written approval from the Security Office for new/additional personnel to be brought on site prior to background check acceptance. Contractor shall submit Personnel Change Request Form and will receive written authorization from the Security Office prior to bringing new personnel on site, and ensure a background check is sent to the Rock Island District Security Office no later than ten days from written notice of approval. The Rock Island District reserves the right to terminate access of the employee upon completion of the Government’s review of the background check and the Contractor shall be notified immediately of any such Government decision.
In the event of an unforeseen change in work site conditions which may require a contract modification, and the contractor is required to immediately add personnel, a Personnel Change Request Form will be submitted to and approved by the Security Office prior to bringing new personnel on site, and ensure a background check is sent to the Rock Island District Security Of f ice no later than ten days from written notice of approval. The Rock Island District reserves the right to terminate access of the employee upon completion of the Government’s review of the background check and the Contractor shall be notified immediately of any such Government decision.
Subcontractor personnel not expected to be on the worksite for more than 15 days may be allowed on site with the following conditions:
1. Employee will be on site a total of 15 days or less, for the duration of the project.
2. Employee is added to the ACL as a short term employee.
3. Employee is escorted while on site. This is defined as being in the line of sight of an identified contractor employee who has a background check on file with the Rock Island District (as noted on the ACL).
4. Each contractor employee can sponsor only five short term employees at a time.
Foreign National employees: Due to a difference in background check procedures for long term foreign national employees, all such employees must provide a photocopy of their passport to the Rock Island District Security Office NLT 30 days prior to arrival on site. Short term foreign national employees (e.g. specialists with a two week period of performance) may work on site with the following conditions:
1. Foreign national employee will be on site a total of 15 days or less, for the duration of the project.
2. Foreign national employee will comply with E-verify requirements E-verify paragraph).
3. Approved and identified contractor employee shall escort the foreign national employee at ALL times while on site.
4. Each contractor employee can sponsor only one short term foreign national at a time.

Security Clause 15.
Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program website (http://www.uscis.gov/e-verify) to meet the established employment eligibility requirements. The Contractor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. Documentation of company enrollment in E-verify, via a print screen of the company profile within the E-verify system, must be submitted to the Security Office no later than 3 business days after the initial Notice to Proceed.
*When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification must be given/coordinated with the designated Government representative. This Form will be provided to the Security Office after Notice to Proceed is given.
PART II
PERFORMANCE WORK STATEMENT
1. PRE-WORK CONFERENCE
1. Af ter award, but prior to commencement of work, the Contractor shall contact the COR to arrange a mutually agreeable time to meet at the Saylorville Lake Office for purposes of discussing and developing a mutual understanding of the requirements and details of work. The contractor shall also be prepared to submit a current copy and discuss at this meeting the following items:
Insurance Certif icate Letter designating On-the-Job Supervisor Written Accident Prevention Plan (APP) Environmental Protection Plan Licensed Arborist Certification CPR and First Aid Certificate
2. Prior to the start of each delivery order under the above contract, the contractor shall contact the Saylorville Lake Office to arrange a mutually agreeable time to discuss the specifications of each delivery item with the COR.
2. SUPERVISION OF WORK
1. The contractor shall give personal supervision to the work or have a competent foreman or superintendent, with authority to act and satisfactory to the COR, on the job at all times while work is being performed. The Contractor shall furnish the COR the names of all persons so designated. The contractor shall have a licensed Arborist on site and shall supply the employee(s) name and certification to the COR prior to performing on site work.
3. REPORT OF WORK PERFORMED
1. The Contractor shall submit weekly the Contractor’s Weekly Log to be supplied at the pre-work conference of all work performed.
2. Work shall be performed within the hours of 7:00am and 4:00pm Monday through Friday unless otherwise directed by the COR.
4. INSPECTION
1. The work shall be performed in accordance with contract specifications and/or directed by the COR, and is subject to inspection by appointed inspectors to insure compliance with the terms of the contract.
2. The COR shall be notified within one business day upon completion of each work item.
The Contractor, at no additional cost to the Government, shall correct any deficiencies noted in the inspection within five days of notification by the COR.
3. If repeated inspections of a work item (3 or more) are required due to contractor’s failure to perform to contract specifications, a re-inspection fee of $40 per inspection may be deducted from contractor payment as well as other contract administrative actions.
5. PAYMENT PROCEDURES
1. Payment for services performed under this contract will be made after satisfactory performance of work described in work delivery order and upon receipt of invoice.
Invoices shall be submitted to the Saylorville Lake Office, 5600 NW 78th Ave, Johnston, IA 50131. The Contractor shall submit an original invoice upon completion of work delivery order. Each invoice shall contain the following information:

Each Task Order will specify the email address and point of contract to submit invoices to.
6. SAFETY
1. All work shall be performed in accordance with safety requirements set forth in Corps of Engineer’s Safety and Health Requirements Manual, EM 385-1-1, dated 30 November 2014, or current copy, a reference copy is available at the Saylorville Lake Office, 5600 NW 78th Ave, Johnston, IA 50131. After award the COR will provide a copy of the Safety and Health Manual to the Contractor. 2. The Contractor shall prepare a written Accident Prevention Plan (APP) and submit it to the COR at the pre-work conference as specified in Part II Section A. The APP shall include at a minimum the following: signature sheet, background information, statement of safety & health policy, responsibilities & lines of authority, subcontractors & suppliers, training, safety & health inspection, accident reporting, emergency plans, and risk management process (AHA-activity hazard analysis).
3. Contractor shall be familiar with ANSI Z133-2012, Safety Requirements for Arboricultural Operations – Safety Requirements can be referenced in APP submittal.
7. DELIVERY ORDERS
1. Delivery orders are necessary to accomplish the work required under this contract will be issued by the Contracting Officer. Delivery orders are written by the Saylorville Lake COR, approved by the Contracting Officer and sent to the Contractor by the Contracting Of f icer.
2. A map of the delivery order location will be attached to the delivery order. That map will highlight the location of where work shall be done.

9. TASK DESCRIPTIONS

- Roadway/Campsite Clearance: Selective pruning of live, dead, and/or damaged branches to provide vertical clearance of 14ft above the travel/usable portion of the roadway or campsite. Usable portion is anything above concrete, asphalt, gravel, or any other hard surface.
- Walkway Clearance: Selective pruning of live, dead, and/or damaged branches to provide vertical clearance of 10ft above walkways, trails, or other walking paths/surfaces.
- Structure Clearance: Selective pruning of live, dead, and/or damaged branches to provide horizontal or vertical clearance of 6ft from any structure.
Branches over 4” diameter shall not be removed unless authorized by the COR.
Not more than 20 percent of the crown should be removed during pruning unless otherwise authorized by the COR.
Branches are to be transported to a COR designated local disposal site on US Army Corps of Engineers (USACE) property within 5 miles of cutting location.

The hole will be backfilled with topsoil (provided) and domed to the level of 2” above the adjoining grade. The f inished site shall be raked smooth. Backfilling shall be accomplished on the same day as the stump grinding.

20. Chipping branches up to 6” diameter with on-site disposal
Including but not limited to chipping of previously cut branches and limbs up to 6” diameter. Branches and limbs will be placed by USACE staff in close proximity to roads or trails. Chips will be disposed of on site with COR coordination.

22. Professional Consulting
Professional Consulting includes performing tree inventories and tree risk assessments.
Tree inventory will include collection of data using a handheld GPS and data recorder which will facilitate the display and analysis of tree data. At a minimum, the following information will be collected for each tree: Site conditions, Location, Species, DBH, Risk Rating, and Maintenance needs.
Tree risk assessments will include Level 1 and Level 2 tree risk assessments performed by an ISA Tree Risk Assessment Qualified personnel.
All tree inventories and tree risk assessments will take place in high use recreation areas including campgrounds and trails. All professional consulting shall be clarified by the COR at the pre-work conference.
23. Emergency Work
Including but not limited to any tree work necessary to correct problems caused by failures or deficiencies which constitute an immediate danger to health hazard or a threat to property. Emergency work could include lightning strikes, storm damage, ice, disease, etc. Emergency work will be initiated by notice (phone call or other means) from the COR or a designated representative. The contractor will have 48 hours to fix the issues after being contacted by the COR.
10. EQUIPMENT, QUALIFICATIONS, AND SPECIAL CONSIDERATIONS
1. Tree maintenance will primarily occur within campgrounds and other recreation areas.
Additionally, tree work will occur along roadways, maintained trails, and access points.
2. Use of a scissor-lift or bucket truck will be needed for some delivery orders. Most tree trimming will be on campsites, along roadways, or in recreation areas. Trimming of trees includes the entire canopy unless otherwise stated.
3. Tree pruning will be done with chainsaws or properly sharpened hand tools for clean cuts in accordance with ANSI A300 Tree, Shrub, and Other Woody Plant Management – Standard Practices, and ANSI Z133-2012 Safety Requirements for Arboricultural Operations. Felling of trees shall be done by chainsaw in accordance to ANSI Z133- 2012 Safety Requirements for Arboricultural Operations.
4. The contractor shall use proper pruning methods. Pruning cuts must be made with clean, sharp, non-powered hand tools, or with small chain saw in consultation with COR, to minimize damage to the trees. Pruning operations will be performed in accordance with ANSI A300 Part 1- 2017 Pruning. The Contractor shall have proper pruning techniques clarif ied with the COR at the pre-work conference. Pruning operations must comply with Corps of Engineer’s Safety and Health Requirements Manual, EM 385-1-1, dated 30 November 2014, or current copy.
5. No pruning of oak trees will be permitted from March 1 to October 31 unless specifically ordered.
6. The Contractor shall clean the grounds and dispose of all debris, twigs, leaves, branches, chips, etc. unless directed in delivery order to leave on ground. The grounds shall be cleaned before the end of each workday unless otherwise stated. Disposal shall be outlined in the delivery order.
7. Contractor must use extreme caution when felling trees in campgrounds and recreational areas. If needed, contractor shall barricade/tape off work area to keep public away during felling. When cutting on trails, the contractor will be responsible for posting signage and closing the trail during time of work. Contractor shall be required to have “spotters” observing each direction from the trees being cut or pruned to be sure that members of the public maintain a safe distance. Contractor shall make every effort to protect adjacent standing landscape trees and facilities when felling in all campgrounds and recreation areas.
8. In order to minimize damage to the Neal Smith Recreation Trail, the COR may limit the vehicles/equipment allowed onto the trail for cutting/pruning/felling. COR will discuss vehicle/equipment options with the contractor at the time of the Delivery Order execution.
Any work done adjacent to the Neal Smith Trail shall have signage posted by contractor stating “work ahead.”
9. All cut trees and shrubs will be cut as flush with ground as possible, unless directed otherwise in delivery order.
10. Trees and shrubs with a fork or clump of stems below 4.5 feet will be added together to get the diameter. Trees and shrubs with a fork or clump of stems above 4.5 feet will be listed as the individual stem DBH.
11. To protect potential roost or maternity sites for Indiana bat, cutting of large shagbark hickory trees or large standing dead deciduous trees with loose but attached bark will not be permitted between April 1 and October 1.
