If, in the opinion of the Contracting Officer, the Fabricator falls behind the approved schedule, take steps necessary to improve progress, including those that may be required by the Contracting Officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Fabricator to increase the number of shifts, overtime operations, days of work, and/or the amount of construction plant, and submit for approval any supplementary schedule or schedules in bar chart form as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.

c. Failure to comply with the requirements of the Contracting Officer will be grounds for a determination by the Contracting Officer that the Fabricator is not prosecuting the work with sufficient diligence to ensure completion within the time as specified in the Contract. Upon making this determination, the Contracting Officer may terminate the Fabricator's right to proceed with the work, or any separable part of it, in accordance with the default terms of this Contract.

1.6 WITNESS POINTS

Witness points will be established for the Initial Quality Assurance (QA)

SECTION 01 32 16 Page 3

Inspection. Intermediate QA Inspections may be performed by the Government or the Government's Agent.

The Initial QA Inspection should commence after the Government has determined that there is substantial completion of components that comprise a reasonable sampling of significant details. The extent of completion and details and the date of the Initial QA Inspection should be determined at the Prefabrication Conference by the Government after discussion with the Fabricator. At that time, the Fabricator should produce a detailed schedule showing the progresssion of work and completion of components. This schedule will be updated monthly and provided by e-mail to the Contracting Officer, The Fabricator should give the Contracting Officer two weeks notice prior to the predetermined date for the Initial QA Inspection including adjustments for changes in schedule. Intermediate QA Inspections will be conducted on an as needed basis and at the discretion of the Government. The Fabricator should allow the Government to inspect all welds, as well as all casted adn forged components. The Fabricator should allow the Government to inspect all other components prior to painting.

Weld inspections will follow AWS D1.5M/D1.5. Fabricator must provide unpainted components for visual and NDT inspection. At these stages of fabrication, the Contracting Officer should be given two working days to inspect the Tainter gate and other components. The QA inspection period should not commence until after a minimum period of 72 hours after any welding. After the Contracting Officer has inspected the Tainter gate and other components, the Fabricator will proceed with the fabrication until the next witness point is reached, unless it is waived in writing by the Contracting Officer. Each component is subject to a Final Fabrication Inspection Prior to painting. The Contractor must give the Contracting Officer a minimum notice of two weeks prior to the Final Fabrication Inspection.

1.6.1 GOVERNMENT WITNESS POINT INSPECTIONS

Quality Assurance (QA) will occur throughout the length of the contract.

The Government QA representatives must have access to the structure and any documentation pertaining to the fabrication of the structure at all times during the length of the Contract. Government witness point inspections must be performed at intervals stated below for each gate. Additional shop visits and witness point inspections may occur at the sole discretion of the Government at any time during the length of the contract. At a minimum, unless determined otherwise by the Government, the following Witness Point Inspection intervals for each gate are:

1.6.1.1 Witness Point 1

Government personnel will inspect the materials to be used in fabrication and perform an initial walk-through of the fabrication shop. The Government will inspect purchased material conforming to the submitted material disposition records (including but not limited to steel plates and shapes, welding filler metals, shielding gases, paints and primers, etc.).

Verification of equipment calibration and personnel credentials will also be performed at this time.

1.6.1.2 Witness Point 2

Structure partially welded (25 percent-50 percent level of completion).

Sufficient number of members erected and welded to display the overall geometry of the structure and level of craftsmanship implemented by the Contractor. Preliminary control dimensions made to verify the observed

SECTION 01 32 16 Page 4 shrinkage and distortion (if present) are within acceptable limits with regard to fabrication tolerances.

1.6.1.3 Witness Point 3

Structure fully welded. Prior to coating. The Contractor must prepare specific areas of the steel surfaces to NACE 1 surface condition during Government inspection when requested by the Contracting Officer or their authorized representative. The Contracting Officer or their authorized representative must be present during verification of Control Dimensions.

1.6.1.4 Witness Point 4

Prior to shipping. Coating applied to mil thickness, curing complete as specified, attachment of seal assembly, attachment of trunnion hubs (snug tighten bolts), attachment of trunnion yokes (for fit check, remove for shipping), installation of trunnion pin bushings, installation of trunnion pins (for fit check, remove for shipping), and attachment of all associated hardware and appurtenances.

1.6.1.5 Witness Point 5

1.7 SCHEDULE MONTHLY UPDATES

Update the Fabrication Schedule at monthly intervals or when the schedule has been revised. Keep the schedule updated and current, reflecting actual activity progress and plan for completing the remaining work. Submit purchase orders and confirmation of delivery dates.

a. Narrative Report: Provide with schedule updates. Identify and justify:

(1) Progress made in each area of the project.

(2) Critical path.

(3) Date/time constraint(s), other than those required.

(4) Changes in the following; added or deleted activities, original and remaining durations for activities that have not started, logic, milestones, planned sequence of operations, and critical path.

(5) Status of Contract Completion Date and interim milestones.

(6) Current and anticipated delays (describe cause of delay and corrective actions(s) and mitigation measures to minimize).

(7) Description of current and future schedule problem areas.

Each entry in the narrative report to cite the respective Activity ID and Activity Description, the date, reason for the change, and description of the change.

1.8 CONTRACT MODIFICATION

Submit a Time Impact Analysis (TIA) with each cost and time proposal for a proposed change. TIA to illustrate the influence of each change or delay

SECTION 01 32 16 Page 5 on the Contract Completion Date or milestones. No time extensions will be granted nor delay damages paid unless a delay occurs which consumes all available Project Float, and extends the Projected Finish beyond the Contract Completion Date.

a. Each TIA to be both narrative and schedule form. The narrative to define the scope and conditions of the change; provide start and finish dates of impact, successor and predecessor activity to impact period, responsible party, describe how it originated, and how it impacts the schedule. The schedule submission to consist of 3 native files:

(1) Fragnet used to define the scope of the changed condition;

(2) Most recent accepted schedule update as of the time of the proposal or claim submission that has been updated to show all activity progress as of the time of the impact start date; and

(3) The impacted schedule that has the fragnet inserted in the updated schedule and the schedule "run" so that the new completion date is determined.

b. For claimed as-built project delay, the inserted fragnet TIA method to be modified to account for as-built events known to occur after the data date of schedule update used.

c. All TIAs to include any mitigation, and determine the apportionment of the overall delay assignable to each individual delay. The associated narrative to clearly describe the findings in a chronological listing beginning with the earliest delay event.

(1) Identify types of delays as follows:

(a) Excusable Delay: Force-Majeure (e.g. weather) - Fabricator may receive time extension, but time will not be compensable.

(b) Inexcusable Delay: Fabricator Responsibility - Fabricator will not receive time extension.

(c) Compensable Delay: Government Responsibility - Fabricator may receive compensable time extension.

(2) If a combination of any of the delay types outlined above occurs, it is considered a Concurrent Delay, which will require an analysis of the facts to determine compensability and entitlement to any time extension under the applicable Contract Clause(s).

d. Submit Data disks containing the narrative and native schedule files.

e. Unless the Contracting Officer requests otherwise, only add conformed Contract modifications into the Project NAS.

1.9 2-WEEK LOOK AHEAD SCHEDULE

Prepare and submit a 2-Week Look Ahead Schedule to provide a more detailed day-to-day plan of upcoming work identified on the Fabrication Schedule.

1.3 SUBMITTAL CLASSIFICATION

1.3.1 Government Approved

Government approval is required for extensions of design, critical materials, deviations, equipment whose compatibility with the entire system to be checked, and other items as designated by the Contracting Officer.

Government approval is required for any deviations from the Solicitation or Accepted Proposal and other items as designated by the Contracting Officer. Within the terms of FAR 52.236-21 SPECIFICATIONS AND DRAWINGS FOR CONSTRUCTION, they are considered "shop drawings."

SECTION 01 33 00 Page 4

1.3.2 Information Only

Submittals not requiring Government approval are for information only.

They are not considered to be "shop drawings" within the terms of the FAR Clause as referenced. Approval of the Contracting Officer is not required on information only submittals. The Government reserves the right to require the Contractor to resubmit any item found not to comply with the Contract. This does not relieve the Fabricator from the obligation to furnish material in accordance with the drawings and specifications; will not prevent the Contracting Officer from requiring removal and replacement of nonconforming material incorporated in the work; and does not relieve the Fabricator of the requirement to furnish samples for testing by the Government laboratory or for check testing by the Government in those instances where the technical specifications so prescribe.

1.4 SUBMITTAL REGISTER AND DATABASE

The Government-provided ATTACHMENT A - Submittal Register, must have columns (a), (g), (h), and (i) filled in with planning dates and submitted for approval within 30 calendar days after Notice to Proceed is received.

Maintain the Submittal Register and keep it updated as the work progresses throughout Contract duration. Submit completed Submittal Register with all final approved submittal items after the final inspection and prior to close out of the Contract. Use the RESIDENT MANAGEMENT SYSTEM (RMS) program as the primary tracking system for the Submittal Register and associated transmittals.

Column (c): Lists specification section in which submittal is required.

Column (d): Lists each submittal description (SD No. and type, e.g. SD-02 Shop Drawings) required in each specification section.

Column (e): Lists one principal paragraph in specification section where a material or product is specified. This listing is only to facilitate locating submitted requirements. Do not consider entries in column (e) as limiting project requirements.

Track all submittals by maintaining a complete Submittal Register, including completion of all data columns, including dates on which submittals are received and returned by the Government.

1.4.1 Use of Submittal Register

Verify that all submittals required for the project are listed; if any submittal is missing, an amendment or modification will be issued.

Coordinate and complete the following fields on the register:

Column (a) Activity Number: Activity number from the project schedule.

1.5 FABRICATOR'S TRANSMITTAL FORM PREPARATION

Use the RMS Transmittal Log for submitting both Government Approved and Information Only submittals in accordance with the instructions on the reverse side of the form and as specified. Generate the Transmittal Form (ENG FORM 4025) and electronically sign by the Fabricator Quality Control System Manager using the Resident Management System (RMS) Transmittal Log.

Properly complete this form by filling out all the heading blank spaces and identifying each item submitted.

Include all required submittal information, for each submittal item, and in the order listed on the ENG FORM 4025. Multiple submittal items from the same specification section may be transmitted with one ENG FORM 4025. Save submittal information as a .pdf file, separate from the ENG FORM 4025, named with the Contract Number and the transmittal number (for example:

W912EK21C0001 00 73 05-1.pdf).

Large File Transmittal Submissions:

For transmittal document files too large for the RMS Transmittal Document Package (usually 250 MB or larger), post the transmittal to the following website:

https://safe.apps.mil/

The Fabricator must request that the Contracting Officer provide a file drop-off request through the safe website, which will provide instructions for uploading the file. The E-mail subject and file name are to follow the same format as specified.

1.6 VARIATIONS

Variations from Contract requirements require a Government approval in accordance with FAR 52.236-21 SPECIFICATIONS AND DRAWINGS FOR CONSTRUCTION and will be considered where advantageous to the Government.

1.6.1 Considering Variations

Discussion with Contracting Officer prior to submission, will help ensure

SECTION 01 33 00 Page 6 functional and quality requirements are met and minimize rejections and re-submittals. When contemplating a variation which results in lower cost, consider submission of the variation as a Value Engineering Change Proposal

(VECP).

Specifically point out variations from Contract requirements in transmittal letters. Failure to point out deviations may result in the Government requiring rejection and removal of such work at no additional cost to the Government.

1.6.2 Proposing Variations

Check the column "variation" of ENG FORM 4025 for submittals which include proposed deviations requested by the Fabricator. If lower cost is a benefit, also include an estimate of the cost savings. Set forth in writing the reason for any deviations and annotate such deviations on the submittal. The Government reserves the right to rescind inadvertent approval of submittals containing unnoted deviations.

1.6.3 Warranting that Variations are Compatible

When delivering a variation for approval, Fabricator warrants that this Contract has been reviewed to establish that the variation, if incorporated, will be compatible with other elements of work.

1.6.4 Review Schedule is Modified

In addition to normal submittal review period, 10 working days will be allowed for consideration by the Government of submittals with variations.

1.7 GOVERNMENT APPROVING AUTHORITY

The Government Approving Authority, the Contracting Officer, will:

a. Note the date on which the submittal was received.

b. Review submittals for approval within scheduling period specified and only for conformance with project design concepts and compliance with Contract documents.

c. Identify returned submittals with one of the actions as specified and with markings appropriate for action indicated.

Upon completion of review of submittals requiring Government approval, code and date approved submittals. An electronic copy of the approved submittal will be retained by the Contracting Officer and an electronic copy of the submittal will be returned to the Fabricator.

1.7.1 Review Period

Contracting Officer review will be completed within 60 calendar days after date of submission. Submittals will be returned to the Fabricator with submittal action codes described in the instructions as provided on the ENG

FORM 4025.

1.8 SCHEDULING

Schedule and submit concurrently submittals covering component items forming a system or items that are interrelated. Include certifications to

SECTION 01 33 00 Page 7 be submitted with the pertinent drawings at the same time. No delay damages or time extensions will be allowed for time lost in late submittals. Adequate time (a minimum of 30 calendar days exclusive of mailing time) must be allowed and shown on the register for review and approval.

a. Coordinate scheduling, sequencing, preparing, and processing of submittals with performance of work to avoid delays. Allow for potential resubmittal of requirements.

b. Submittals called for by the Contract documents to be listed on the register. If a submittal is called for but does not pertain to the Contract, include the submittal in the register and annotate it "N/A" with a brief explanation. Approval by the Contracting Officer does not relieve the Fabricator of supplying submittals required by the Contract documents but which have been omitted from the register or marked "N/A."

c. Re-submit register and annotate monthly by the Fabricator with actual submission and approval dates. When all items on the register have been fully approved, no further re-submittal is required.

d. Carefully control procurement operations to ensure that each individual submittal is made on or before the Fabricator scheduled submittal date shown on the approved "Submittal Register."

1.9 DISAPPROVED SUBMITTALS

Make corrections required by the Contracting Officer. If the Fabricator considers any correction or notation on the returned submittals to constitute a change to the Contract drawings or specifications, notify the Contracting Officer, as required under the FAR 52.243-1 CHANGES, FIXED PRICE The Fabricator is responsible for the dimensions and design of connection details and construction of work. Failure to point out deviations may result in rejection and removal of such work at the Fabricator's expense.

If changes are necessary to the submittals, make revisions and re-submit in accordance with the procedures above. Accomplish no item of work requiring a submittal change until the changed submittals are approved.

1.10 APPROVED SUBMITTALS

The Contracting Officer's approval or acceptance of submittals is not to be construed as a complete check, and indicates only that the general method of construction, materials, detailing, and other information are satisfactory. Approval or acceptance will not relieve the Fabricator of the responsibility for any error which may exist, as the Fabricator under the Fabricator Quality Control (FQC) requirements of this Contract is responsible for dimensions, the design of adequate connections and details, and the satisfactory construction of all work. After submittals have been approved or accepted by the Contracting Officer, no resubmittal for the purpose of substituting materials or equipment will be considered unless accompanied by an explanation of why a substitution is necessary.

The Government will electronically code and sign the transmittal form, and return the completed transmittal package back to the Fabricator through RMS.
