Performance Work Statement
Falls Lake – Wilmington District
Water Line Repair
20 August 2024
1. Summary of Work
The work site is located near the comfort station of the Falls Lake Tailrace Fishing Area. Water is surfacing through cracks in the asphalt parking lot above an existing 1.5” PVC waterline. Service to be provided under this contract shall include all equipment, labor, supervision, and materials (except otherwise specified) necessary to:
A. Locate an existing water line leak. Locating the leak will involve cutting into the asphalt parking lot of the tailrace area. Waterline is buried approximately 4 ft under ground.
B. Repair/replace any 1.5” PVC Schedule 80 water line and/or fittings that are damaged and causing the leak.
C. Install a 4” pressure reducing valve on the waterline after the existing backflow preventer.
D. Perform leak testing, refill all trenching, repair all damaged asphalt, and re-seed any disturbed ground.
All work associated with the execution of the contract shall comply with local, state, and federal regulations.

2. Safety
A. All equipment used, and work performed shall be in accordance with safety requirements set forth in the current edition of EM 385-1-1, US Army Corps of Engineers Safety and Health
Requirements Manual, which is available by downloading from:

All contractor operations shall comply with this manual, and all applicable federal and state laws.
USACE inspectors have the authority to stop work due to safety violations.
B. Daily Safety Meetings. Safety meetings shall be held daily at the beginning of each shift to discuss the day’s activities, review the AHA for the activities, and discuss and safety issues from the previous day’s work. The safety meeting shall be documented on SAW Form 4 and provided to the COR every Monday morning. The COR shall be a part of the safety meeting either in person or by phone.
C. Accident Prevention Plan (APP)
Ten (10) calendar days prior to the pre-work meeting, the Contractor shall submit an APP in accordance with Chapter 2, Para. 2-7.b, using ENG Form 6293, Accident Prevention Plan

Contracting Officer or their Designated Representative prior to commencement of any work.
The APP shall interface with the Contractor’s overall safety and health program. The
Government considers the Prime Contractor to be the “controlling authority” for site safety and health for all subcontractors. APPs will be reviewed by the Safety Office and the review will be completed within 10 days after submission.

Activity Hazard Analysis (AHA).
Before beginning each work activity, the Contractor performing the work activity shall prepare and submit an AHA for review and acceptance by the Contracting Officer or their Designated
Representative. The AHA is a documented risk management process by which the steps required to accomplish a work activity/task are outlined and the actual/potential hazards and controls are identified. Each work activity/task shall include a Risk Assessment Code (RAC). ENG Form 6206
(https://www.publications.usace.army.mil/LinkClick.aspx?fileticket=K66no-4L-v4%3d&tabid=16438&portalid=76&mid=43543) may be utilized for the AHA. Similar tools are Job Hazard Analysis (JHA) and Job Safety Analysis (JSA). Review of AHAs will be conducted by the COR/CDSO and the Safety Office.
D. Monthly Manhour Report.
The Contractor shall submit a Monthly Exposure Report by the fifth (5th) of the month for the previous month. The report is a compilation of employee-hours worked each month for all site workers, both prime contractors and subcontractors.
E. Accident Notifications and Reporting.
(a) Initial Accident Notification.
(1) Notify the Contracting Officer or their Designated Representative as soon as practical, but no more than eight hours after fatalities, in-patient hospitalization, amputation, eye loss or property damage of $600,000 or more. All other accidents require initial notification as soon as possible, but not later than 24 hours. The Contractor is responsible for obtaining appropriate medical and emergency assistance and for notifying fire, law enforcement, and regulatory agencies. These accidents must be investigated in depth to identify all causes and to recommend hazard control measures.
(2) The notification shall include the following: Contractor’s name; Contract title; type of
Contract; name of activity, installation, or location where accident occurred; date and time of accident; names of personnel injured; extent of injury, if known; extent of property damage, if any, and a brief description of the accident (for example, type of construction equipment used, and PPE used. For serious accidents noted above, preserve the conditions and evidence on the accident site until the Government investigation team arrives on-site and Government investigation is conducted. The Contractor shall assist and cooperate fully with the Government's investigation of accidents. Initial notification may be by email, telephone or by ENG Form 3394, Mishap

(b) Final Accident Report (FAR)
(1) A FAR shall be submitted to the Contracting Officer or their Designated
Representative as soon as practical, but not more than seven days after the accident.

(2) The FAR shall be submitted on ENG Form 3394, Aug 2021, Mishap Notification, and
Investigation. The Contracting Officer will provide copies of the form.
(3) Conduct an accident investigation for any load handling equipment accident (including rigging accidents) to establish the root cause(s) of the accident. Do not proceed with crane operations until cause is determined, and corrective actions have been implemented to the satisfaction of the Contracting Officer. The Contractor shall complete the Final Accident Report blocks on the form. The Contracting Officer will provide copies of the form.
(c) Near Misses.
Notify the Contracting Officer their Designated Representative as soon as practical but no more than twenty-four hours after a near miss. Complete all applicable parts of ENG Form 3394, Near
Miss Report and submit to the Contracting Officer within 7 days of occurrence. The Contracting
Officer will provide copies of the form. A near miss is an incident that does not result in personal injury, property damage, or damage to the environment.
F. Site Safety and Health Officers. Contracting Officer Representatives (CORs) and others that develop SOWs will consult with the Safety Office concerning Site Safety and Health Officer, Competent and Qualified Person requirements.
3. Specifications of Work
A. Excavate to the waterline to locate the existing leak. See map in appendix B for the location of the surfacing water. Cut and remove asphalt as necessary to locate the source of the leak.
B. Once the source of the leak has been located, identify and replace any damaged components with in-kind 1.5” schedule 80 PVC pipe and/or fittings.
C. Install a 4” pressure reducing valve on the existing 4” iron water line adjacent to the existing backflow preventer, must be installed between the backflow preventer and the water meter. See
Appendix B for the installation location. The pressure reducing valve shall be installed inside a containment box with an access at ground level. The existing 4” iron water line may need to be cut and new flanges installed on either side to connect to the pressure reducing valve. After installation, the pressure reducing valve shall be set to reduce incoming water pressure by 75 lbs, from the existing ~165psi to ~90 psi. The pressure reducing valve shall by a Zurn Model
500XL3F 4” with optional gauge or equivalent and meet the following specifications:
1. 4-inch pipe size
2. Flanged connection type
3. 400 psi maximum operating pressure
4. Reduced pressure ranges of 25 to 75 psi
5. Certified to NSF/ANSI/CAN 61 & 372 standards
D. The contractor shall conduct leak testing in accordance with industry standards from the water meter to the restroom facility to ensure the repaired water line and pressure reducing valve are fully functional.
E. Backfill all excavated trenches and holes. Prepare the bottom of the repair trench for the installation and bedding of the new PVC pipe by removing an additional 4” of soil and bedding with #67 gravel. Once installed, the new PVC pipe shall be embedded to a level even with the top of the pipe with #67 gravel before backfilling with the excavated material. Soils shall be backfilled in 6 to 8-inch loose lifts and compacted. Compaction shall be achieved by mechanized tamper (i.e., jumping jack or vibratory plate compactor). Compact each lift until there is a non-yielding surface
(i.e., the surface does not displace downwards while being compacted). Asphalt patching shall be no less than 1-1/2-inches thick to match the thickness of the existing asphalt roadway. Compacted cold patch asphalt mix is authorized. Any disturbed ground that is not covered by asphalt shall be seeded with a contractors mix grass seed and covered with straw.
4. Work Requirements
Staging Area. The contractor shall provide adequate signing and barricades and take necessary safety measures to protect the public during all construction operations. The staging area for equipment and supplies will be in the parking lot on the east side of the restroom facilities. The contractor shall close this portion of the parking lot to the public by signed barricade and leave the parking spots south of the restrooms open.
Materials shall be installed in accordance with the manufacturer’s specifications, details, and workmanship requirements. The contractor shall be responsible for protecting Government property and undisturbed land not intended for modification, from damage. Any damaged property shall be repaired to its original condition by the contractor at their own expense, including any restraining devices or other waterline support infrastructure damaged during excavation. The contractor is also responsible for removing all debris and excess materials from Government property.
Normal working hours shall be Monday through Friday (0730-1630), unless otherwise specified, or as specifically approved in advance by the COR.
Other Contractors and Corps of Engineers employees may be near the Contractor’s designated area of work. The Contractor shall cooperate fully with all Contractors in the area and shall not impede the work of others in any way.
The Government may direct the Contractor to replace any employee(s) that they deem incompetent, careless, insubordinate, under the influence of intoxicating drugs, beverages, etc. or whose continued employment is deemed to be contrary to the public interest. The Contractor shall be responsible for the immediate replacement of any employee under the conditions identified above, in addition to any costs associated with the replacement of an unsuitable employee.
5. Site Visit
The contractor is encouraged to attend a pre-work site visit prior to submitting a bid. It is the bidder’s responsibility to note the location of work, local conditions, facilities, security, equipment required for the work, and all other factors which may affect the work or costs to perform the work. Any failure by the contractor to adequately review the site conditions will not relieve responsibility for properly estimating the difficulty or cost of successfully performing the work.
An organized site visit will be held on 10 September at 1:00 PM EST at the Falls Lake Visitor Assistance Center, 11405 Falls of the Neuse Road, Wake Forest, North Carolina.
6. Period of Performance
The period of performance is 60 days from contract award.
7. Commencement of Work
The Contractor or their representative shall coordinate a pre-work meeting with the Government 72-hours prior to the desired commencement of work date. The Contractor shall obtain all maps and instructions from the Government necessary to accomplish the work. The Contractor shall become familiar with the nature and location of the work by inspection of the site; noting the local conditions, security, safety, equipment, and facilities required for the work, and all other factors which may affect the work or costs to perform the work. Any failure by the Contractor to review all available information concerning these conditions will not relieve them from the responsibility for estimating the difficulty or cost of successfully performing the work.
It shall be the responsibility of the Contractor to describe the contract requirements to subordinate employees and subcontractors.
8. Government Inspection and Acceptance Criteria
The Government considers the Contractor responsible for executing all tasks outlined within this Statement of Work. The Government may inspect the Contractors work at any time during the execution of this contract. Acceptance of the work and processing of payment shall be contingent upon the Contractor’s successful execution of the tasks described within this Statement of Work.

11. Security
The Contractor will be required to adhere to the following conditions:
10.1 General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring
Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of
Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts.
Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random mailto:francis.e.ferrell@usace.army.mil
Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. Should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
10.2 Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-
Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United
States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment
Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system.
