52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
See below Addendum to FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM TO FAR 52.212-2
EVALUATION – COMMERCIAL ITEMS (OCT 2014)
In accordance with FAR 15.101-2, the Government will award a contract resulting from this solicitation to the responsible offeror submitting the lowest priced, technically acceptable offer that satisfies all terms and conditions of this solicitation.
Award will be made to the responsible Offeror submitting the Lowest Priced, Technically Acceptable (LPTA) offer that satisfies all terms and condition of the solicitation. Offers will be evaluated for acceptability, but not ranked using non-price factors/sub-factors. All non-price factors and sub-factors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/sub-factor. In other words, a rating of “unacceptable” for any factor or sub-factor will result in the entire offer being rated “unacceptable”.
The following ratings will be used in evaluating all non-price technical factors and sub-factors.
Technical Acceptable/Un-acceptable Ratings Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
In order to be considered for award, there must be an “acceptable” rating in every non-price factor/sub-factor. In other words, a rating of “unacceptable” for any factor or sub-factor will result in the entire offer being rated “unacceptable”.
FACTOR A – TECHNICAL PROPOSAL
(a) Sub-factor 1 – Contractor’s License and Certificate: The offeror shall be evaluated the submitted an American Power Corp (APC) Uninterruptible Power Supply (UPS) service license in Korea and certificate from APC to performance UPS maintenance service. See paragraph 2 of Performance Work Statement (PWS).
(b) Sub-factor 2 – Contractor’s Prior Experience: The offeror shall be evaluated on submitted documentation demonstrating at least one (1) year experience with preventative maintenance and repair of APC UPS in medical environment or similar service relevant to this solicitation’s requirement within four (4) years from the closing date of sonication. (See paragraph 2.3 of PWS) The offeror shall provide evidence of prior experience in following format:
The title of the contract/project/employer A brief description of work completed Name of the Client Organization or Requiring Activity (RA) Period of contract/project (year/month/date – year/month/date) Complete name of point of contact at the Client Organization Phone number of the primary point of contact of the Client/RA
FACTOR B - PAST PERFORMANCE: Past performance shall be evaluated on an acceptable/unacceptable basis.
Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided.
The offeror shall have recent and relevant past performance in care coordination, discharge planning or case management in a medical setting or similar types of services. Recent past performance is within the last five (5) years as of the closing date of the solicitation.
The past performance will be evaluated for all offeror’s proposals by the Contract Specialist/Contracting Officer in the following manner:
(i) Reference will be contacted by phone or e-mail to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(ii) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.
Past Performance Evaluation Ratings Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”
FACTOR C - PRICE: Proposed price will be reviewed to determine if the estimate is adequate, complete, and reasonable to assess the offeror's understanding of the solicitation. The pricing proposals will be evaluated in accordance with FAR 13.106-3(a)(1)&(2).
