UNITED STATES DEPARTMENT OF THE INTERIOR
OFFICE OF THE SECRETARY
Appraisal and Valuation Services Office
STATEMENT OF WORK
The purpose of this Statement of Work (SOW) is to provide instruction and minimum standards to the appraiser for the assignment detailed below. This SOW outlines certain requirements that must be addressed as part of the appraisals and establishes the minimum expectations for the scope, content, support, and presentation of the analysis.
The appraiser must read and fully understand the contents of this SOW prior to commencing the appraisals, as many aspects of the requested assignment have been detailed throughout. This SOW must be included as an attachment to the completed report(s).
Failure to comply with the terms and conditions of this SOW may result in the omission of required elements and may lead to the return or rejection of the appraisal report(s) for non-compliance.
SECTION 1: CASE PROPERTIES
Case Name: Blackfeet Appraisals – Group A
AVIS Case & Project Numbers: Refer to Section 8 of this SOW.
Tract Name/Numbers: Refer to Section 8 of this SOW.
Agency: Bureau of Indian Affairs (BIA)
Requested Service: Market value appraisals
SECTION 2: SUBJECT OF THE APPRAISAL
Property Description: The Appraisal and Valuation Services Office (AVSO) is requesting 15 separate appraisals of parcels located within the Blackfeet Indian Reservation. The subject parcels are identified in Section 8 of this Statement of Work. No structural improvements are to be appraised under this assignment.
The Blackfeet Reservation is located in north-central Montana, primarily within Glacier County, with a small portion extending into Pondera County. The reservation borders Glacier National Park to the west and Canada to the north.
Legal Description: The legal description is provided in the Title Status Report for each property. The title reports will be provided upon contract award.
Property Rights Appraised: Fee simple estate subject to outstanding rights and/or reservations of record
Outstanding Rights and/or Reservations:
The appraisals are to consider the exceptions noted in the Title Status Report for each parcel. Any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value.
5/28/2026
AVSO Statement of Work Page 2 of 7
Access: Physical and legal access may vary by tract. The appraiser is responsible for determining the nature and extent of each parcel’s legal and physical access. Any limitations affecting access must be discussed and analyzed in relation to their impact on marketability and market value.
Real Property Improvements: No structural improvements are to be valued under this assignment. If improvements are observed during inspection, they should be identified and briefly described in the report, but no improvement value is to be developed.
Personal Property: Personal property must be disregarded for purposes of the appraisal.
SECTION 3: APPRAISAL PROBLEM IDENTIFICATION
Client: U.S. Department of the Interior, AVSO
Intended Users: AVSO and Blackfeet BIA, on behalf of the United States of America
Intended Use: The intended use of the appraisals is to assist the client and intended users with approval of negotiated sales and/or exchanges of land.
Type of Value: Market Value
Definition of Market Value: Federal regulations prescribe the following definition of market value for use in negotiating a sale of Indian trust land. The appraiser must use this definition of market value in the appraisal report and develop the appraisal in a manner consistent with this definition.
The most probable price, as of a specified date, in cash, or in terms equivalent to cash, or in other precisely revealed terms, for which the specified property rights should sell after reasonable exposure in a competitive market under all conditions requisite to a fair sale, with the buyer and seller each acting prudently, knowledgeably, and for self-interest, and assuming that neither is under duress.
Source: The Appraisal of Real Estate Appraisal, 16th Edition, The Appraisal Institute
Effective Date: The effective date must be no later than 30 calendar days prior to the submission of the completed appraisal report(s), unless the AVSO review appraiser approves in advance other conditions in writing.
SECTION 4: ASSIGNMENT CONDITIONS
Confidentiality: The appraisal report and all information furnished by the BIA or AVSO to the appraiser are to be considered confidential.
Property Inspection The contract appraiser must inspect the subject parcels and all comparable market data used in the appraisals, unless the AVSO review appraiser has approved other conditions in writing. The extent of the inspections should be sufficient to adequately identify those characteristics which impact the estimates of fair market value. The inspections of the subject parcels will be coordinated with the BIA realty staff and/or landowner. The appraiser must notify, in advance, both the BIA and AVSO review appraiser when the property inspections will occur so they have adequate time to make travel arrangements.
AVSO Statement of Work Page 3 of 7
Extraordinary Assumptions: None. If the appraiser determines that extraordinary assumptions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.
Hypothetical Conditions:
The valuation of the subject property in fee simple title is a hypothetical condition, the use of which may affect the assignment results. This assignment has three authorized Hypothetical Conditions:
1. The property rights for trust land held by the United States on behalf of the Indian or Tribe are assumed to be equivalent to fee simple status, although the allotment can consist of numerous fractional interests that have never been legally partitioned from the whole.
2. The allotment is not affected by Federal or Tribal laws restricting the sale of trust or restricted lands; analysis assumes the allotment could be sold and purchased on the open market without any restrictions.
3. For the purpose of analysis, the subject parcel is assumed to have similar land use restrictions (zoning) and encumbrances (property tax load) associated with the comparable sales used in the analysis.
4. For the purpose of the analysis, the subject parcel is assumed vacant and unimproved.
The appraiser must invoke the above hypothetical conditions. If the appraiser determines that any additional hypothetical conditions are necessary, he/she must contact the AVSO review appraiser for prior written approval.
Jurisdictional Exceptions: None. If the appraiser determines that a jurisdictional exception is necessary, the appraiser must contact the AVSO review appraiser for prior written approval.
Pre-Work Meeting: The contract appraiser will be required to attend a pre-work meeting. The pre-work meeting will be conducted prior to the inspection of the property. The purpose of the meeting will be to discuss this Statement of Work and the expectations of AVSO. The meeting will be held via teleconference. The AVSO review appraiser will coordinate the date and time with the appraiser. BIA realty staff may be invited to attend, as appropriate.
Appraiser Qualifications: This appraisal assignment requires a State Certified General Appraiser in good standing with the State of Montana. The appraiser needs to be licensed or certified or hold a temporary permit in Montana prior to accepting the assignment. The engaged appraiser must sign the report.
Appraisal Methodology: The Sales Comparison Approach is expected in this assignment. Development of additional approaches should be determined after analyzing the quantity and quality of market data available as well as what is typically required for valuation assignments of that type. Applicable approaches are required if they are necessary for credible results. A detailed discussion of the reasoning to omit typical approaches must be included.
AVSO Statement of Work Page 4 of 7
Applicable Regulations and Appraisal Standards:
The analysis shall be developed in a manner that supports the BIA’s responsibilities under 25 CFR Part 150, which establishes policies and procedures relating to Indian land title records, title status reports, and interests affecting trust and restricted lands.
The appraisal report must be developed and written in accordance with the current edition of the Uniform Standards of Professional Appraisal Practice (USPAP).
Market Data Requirements: The appraisals shall focus on market data from the Blackfeet Reservation whenever reliable and relevant data is available. However, limited market data may require expansion of the geographic scope and/or timeframe to obtain sufficient information. The appraiser is responsible for defining and justifying the broader market area and explaining the relevance of any off-reservation data relied upon in the analysis.
The market area should not be arbitrarily limited to reservation boundaries if doing so would exclude relevant market evidence. Research shall include, as appropriate, deed and public records research, sale verification, active and expired listings, and interviews with knowledgeable market participants familiar with the market area.
Data Verification: The contractor shall verify market data to the extent necessary to ensure its reliability and relevance. Simply reporting information from MLS data sheets or similar sources is not sufficient verification.
Verification should include confirmation of key transaction details, such as price, terms, motivations, and property characteristics, through multiple sources when available, including conversations with parties knowledgeable of the transaction such as brokers, buyers, sellers, or other market participants. Any limitations in verification shall be clearly disclosed in the report.
Reporting Format: The appraisal report(s) shall be prepared in narrative report format. Standardized form reports (e.g., URAR, FNMA/FHLMC forms, etc.) are not acceptable for this assignment.
Due to the number of parcels involved, the appraiser may wish to consider a reporting format similar to a “project report” rather than preparing multiple separate narrative reports.
Regardless of the reporting format selected, the final narrative appraisal report(s) must clearly communicate the appraisal process and adequately support the market value opinions in a manner understandable to the intended users.
AVSO Statement of Work Page 5 of 7
SECTION 5: APPRAISAL REQUIREMENTS AND INSTRUCTIONS
The appraiser shall prepare the appraisal(s) in Appraisal Report format consistent with USPAP Standards Rule 2-2(a). See USPAP Advisory Opinion 28 (AO-28) for additional guidance regarding scope of work and reporting requirements.
Additionally, the appraisal must include the following:
1. Cover Page must prominently identify the USPAP reporting option (Appraisal Report), as well as the client, property identification (e.g. tract name), AVIS case number, effective date of value, date of the report, and the appraiser’s name and contact information.
2. The descriptions of the subject parcels and comparable market data shall contain sufficient detail to allow the intended users to understand and visualize the relevant property characteristics. Such information should include, as applicable, legal description, land use, type and quality of access, improvements, fencing, water sources and adequacy for grazing, vegetative cover, soil types, topography, and other relevant physical or economic characteristics. All comparable sales relied upon shall be confirmed, analyzed, and reported in a similar level of detail and in a consistent manner with the subject property.
3. At a minimum, the report shall include an aerial photograph depicting the estimated property boundaries of the subject property and each comparable sale, a comparable sales location map, and representative photographs taken during the property inspection, unless waived by AVSO. Additional maps, surveys, plats, or other exhibits may be included if relevant to the appraisal problem. Aerial imagery shall be current enough to reasonably reflect the property’s physical characteristics as they existed on the date of inspection. Any unusual or significant property features shall be photographed from ground level and included in the report.
4. Ownership and History of Property: Summarize the analysis of the most current Title Status Report (TSR) for the subject property, including relevant ownership, encumbrance, and title information. Any significant differences between recent sales or transfers involving the subject property and the concluded market value shall be discussed and reconciled in the report.
5. Sales Comparison Approach: The analysis shall include a summary of the relevant market data in grid or tabular form. Comparable sales relied upon should reflect similar market conditions and be located in market areas appropriate to the effective date of the appraisal.
6. The preferred method of adjusting comparable sales data is through adequately supported quantitative adjustments (e.g., percentages, $/acre, etc.). Qualitative adjustments (e.g., similar, inferior, or superior) may be used when insufficient market data exists to support quantitative adjustments. All adjustments, whether quantitative or qualitative, must be supported by clear, appropriate, and credible narrative analysis based on documented market research. The level of detail should be commensurate with the complexity of the property and transaction;
however, at a minimum, the report shall discuss the relevant characteristics of each comparable sale and explain how each sale relates to the subject property. The comparable sales data and analyses shall be reconciled into a supported point estimate of value.
7. The AVSO Statement of Work, pages 1 and 2 of the Contract Award, and any additional documents provided with the assignment shall be included as addenda to the appraisal report. The report shall also contain appropriate references to these documents within the body of the appraisal report.
8. Unsigned and draft reports will not be accepted.
9. When the appraiser has performed any services regarding the subject property within the prior three years, he/she must disclose this in the proposal prior to engagement.
10. AVSO is the appraiser's sole client. The appraiser may not communicate assignment results to any party except AVSO, unless authorized to do so in writing by AVSO.
11. If the appraiser discovers material facts which differ from those provided by AVSO or encounters circumstances which prevent the appraiser from developing an unbiased appraisal, the appraiser must contact the AVSO review appraiser for instructions.
AVSO Statement of Work Page 6 of 7
12. Any communication with the bureau realty contact or property owner shall include the assigned AVSO review appraiser.
13. Even though communication is encouraged with the property owner and BIA, only the assigned AVSO review appraiser can modify appraisal instructions (in writing).
14. Any communications between AVSO (client) and the contract appraiser that pertain to the appraisal review (i.e., review questions, comments, concerns, etc.) are confidential. Disclosure of these communications to any other party is prohibited.
15. This appraisal assignment will be an engagement between the appraiser and AVSO, the appraiser’s client. The appraiser must address any questions regarding appraisal instructions and/or technical requirements for the appraisal to the AVSO review appraiser. Appraisal assignment contacts will be provided upon contract award.
SECTION 6: PERFORMANCE / DELIVERABLE REQUIREMENTS
Appraisal Report Delivery: Targeted performance period for completion of all the appraisals is 120 days from date of contract award. If the contractor determines that the requested performance period is not feasible, then an alternative delivery date may be provided in the proposal.
Deliverables: Draft reports are not acceptable. The appraiser shall submit one electronic (PDF) copy of the appraisal report directly to the AVSO review appraiser. Simultaneous distribution of the report to any other party is prohibited. The initial submission must be provided in a searchable PDF format that allows text searching, highlighting, and the insertion of review comments.
If multiple appraisal reports will be submitted under this assignment, the contract appraiser shall provide one appraisal report for review as early in the process as practical. This will allow AVSO the opportunity to identify any necessary revisions, modifications, or corrections affecting the credibility and adequacy of the report. The intent is to minimize repetitive review comments and avoid carrying the same deficiencies forward into subsequent reports. Delivery of additional reports shall be held until feedback on the initial report has been received.
Review & Comments Provided: The appraisal report(s) will be reviewed in their entirety for compliance with USPAP and this SOW. Any identified deficiencies will require revision/correction.
The review process is anticipated to be completed within approximately 30 days of receipt of the appraisal report(s). Any requested revisions shall be completed and resubmitted within 10 days.
Invoice Submission & Payment: 60 days after the appraiser has been notified the appraisal review is complete.
Closeout: 60 days after final payment.
Note:
The final invoice/request for payment is not to be submitted until the AVSO review appraiser notifies the contract appraiser the appraisal review is complete.
Any adjustments to the above Performance / Deliverable Requirements shall be communicated to the Contracting Officer by the AVSO review appraiser. The Contracting Officer will approve or reject the request by email. Approved adjustments will be communicated to the contracted appraiser and BIA, as appropriate.
