About this file
This is a Justification Review Document for a sole-source contract award for emergency temporary air conditioning services at the District of Columbia Armory.
The contracting activity is USPFO-DC-C, and the procurement seeks emergency turn-key temporary Air Conditioning (A/C) services, including specialized HVAC units, power generation, fuel, and daily maintenance for the DC Armory drill floor. The period of performance is June 5, 2026 through September 30, 2026. The contract is being awarded to Aggreko, LLC on a firm-fixed-price basis under sole-source authority pursuant to 41 United States Code 1901 as implemented in RFO FAR 12.102(b). The justification cites emergency conditions following termination of a previous 8(a) program contract with a firm that failed to perform. A major event scheduled for June 9, 2026, with thousands of participants and press coverage requires immediate cooling capabilities, and the five-day mobilization window makes full and open competition impossible without unacceptable delays that would result in uninhabitable facility conditions and life-safety hazards. Market research confirmed that Agrokgo, LLC is the only known source with prior site knowledge and specific equipment necessary to mobilize, install, and commission a system of the required scale within the compressed timeframe. The Small Business Administration conditionally released the requirement from the 8(a) program, with the understanding that future DC Armory cooling requirements will return to competitive 8(a) procurements. Legal Counsel, the Contracting Officer, and the Command Advocate for Competition have reviewed and approved this justification. An award notice will be posted after contract award in accordance with RFO FAR 5.301.

Sole Source Justification and Approval Under RFO FAR 12.102(b)
1. Contracting Activity: USPFO-DC-C
2. Description of Action: New firm-fixed-price contract awarded on a sole-source basis under emergency conditions following a terminated contract for the same services.
3. Description of Supplies/Services: Emergency turn-key temporary Air Conditioning (A/C) services, including specialized Heating, Ventilation, and Air Conditioning (HVAC) units, power generation, fuel, and daily maintenance for the DC Armory drill floor.
Period of performance is 05JUN2026 30SEP2026. Estimated Value:
4. Authority Cited: 41 United States Code 1901 as implemented in RFO FAR 12.102(b), Restricting competition Table 12-1 for restricting competition under the authority of the simplified procedures.
5. Reason for Authority Cited: The cited authority, Title 41 U.S.C. 1901 as implemented in RFO FAR 12.102(b), is utilized because this is a commercial requirement, that will be sourced using simplified acquisition procedures. This requirement was previously awarded to an 8(a) firm that failed to perform and the contract was subsequently terminated. The Small Business Administration (SBA) agreed to conditionally release this requirement from the 8(a) program in order to permit another contractor to perform these critical services through 30 September 2026. However, the previous contract was terminated for the convenience of the Government ability to reprocure services with an exemption to limiting competition, and therefore requires a sole source justification for the new procurement. Due to the short suspense window before a major June 9, 2026, event, at the DC Armory, with thousands of participants and press coverage, full and open competition would result in unacceptable delays, severe mission failure, and uninhabitable facility conditions. The incumbent contractor failed to provide a functioning system and, per SBA conditions for releasing the requirement from the 8(a) Program, their contract is being Terminated for Convenience. This termination leaves the DC Armory without cooling. Without immediate cooling for the event, the facility will be uninhabitable, presenting life-safety hazards and risking severe mission degradation. Aggreko, LLC is the only known source with prior site knowledge necessary to mobilize, install, and commission a system of this scale within a five (5) day window.
6. Efforts to Obtain Competition: Due to the extreme five (5) day mobilization window partially occurring over a weekend, standard competition of the requirement is impossible without causing unacceptable delay. An award notice for this sole source action will be posted after award in accordance with RFO FAR 5.301.
