About this file

This is a Justification for Other than Full and Open Competition (J&A) document for a contract modification with the DC National Guard.

The contracting activity is DC USPFO (W912RI) on behalf of the requiring activity, DCNG Make DC Safe and Beautiful JTF. The action seeks to issue a firm fixed-price bilateral modification (Contract Action W912RI-26-C-A005) to extend commercial catered meal services for 50 days, with an estimated requirement of 370,150 meals (breakfast, lunch, dinner, and midnight service). The modification is classified as a sole source procurement under FAR 6.302-1, authorized as a directed change under FAR 52.212-4(d). The fund type is O&M, Army. The justification cites 10 U.S.C. 2304(a)(1) or 41 U.S.C. 3304(a)(1) as the authority for other than full and open competition, based on the rationale that only one responsible source can satisfy agency requirements for continuity of service.

The primary rationale for sole source award is that the original competitively awarded catered meals contractor failed to provide satisfactory service with significant quality deficiencies. A second contractor was subsequently awarded and has established a proven record of successful performance. Extending the contract to any other source would result in unacceptable delays and disrupt critical service, as a new contractor would require significant ramp-up time for mobilization and supply chain establishment. The incumbent contractor is fully integrated on-site and capable of providing seamless, immediate continuation of service. The current contract period of performance runs from February 1, 2026 through March 31, 2026. The Government plans to pursue full and open competition for the follow-on requirement and may issue an RFI to gauge industry interest. The justification must be posted on SAM.gov within 14 days after contract award for a minimum of 30 days in accordance with FAR 6.305.

c. Market Research The DC National Guard is committed to maximizing competition for the long-tem1, follow-on requirement. A Request for hlfom1ation (RFI) may be issued to gauge industiy interest and capabilities, and the subsequent solicitation will be stiuctured to encom·age robust competition.

d. hlterested Sources Due to the short two month period of perfom1ance and the immediate need for continuity, the Government has not identified any vendor, other than the inctm1bent, who can meet the requiren1ents for this interim support effo1t without causing mission failure.
