JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ORGANIZATION: The contracting organization responsible for this action is the 120th Base

Contracting Office, 2800 Airport Ave B, Great Falls, MT 59404-5570.

II. DESCRIPTION OF ACTION: The contractual action is a new Sole Source Firm-Fixed Price Contract to purchase

NVIS iPad Cases and Filters for aircrew personnel.

III. DESCRIPTION OF SUPPLIES/SERVICES: This procurement is for the purchase of NVIS iPad Cases and Filters as listed below:

NVIS READY CASE FOR iPad mini 5 - FC-IPM5-002

DC20 FILTER KIT CF-20 TABLET - FPDCND-510

DCND NVIS FILTER- iPad mini 5 - FP-DC20-CF20

IV. AUTHORITY: The statutory authority permitting other than full and open competition for this acquisition is 10

U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements; as implemented by Federal Acquisition Regulation Part 6.302-1. IAW FAR 8.405-6(a)(2), the award will be made for an item peculiar to one manufacturer and is essential to the Government's requirements, and market research indicates other companies' similar products do not meet, or cannot be modified to meet, the agency's needs at a reasonable cost.

V. APPLICABILITY OF AUTHORITY: Cevians is the only known source of these products who is known to meet the government's requirement specifications. Award to any other who can provide equivalent would not be a problem, but none are known of at this time.

FAR 6.302-1(c) provides the use of brand name descriptions when the requirement can only be met by one brand name product.

VI. EFFORTS TO OBTAIN COMPETITION: Extensive market research has been completed by the Montana Air

National Guard (MTANG), however we are unable to find another company who provides a similar product. Additionally market research provided by other units, to include a sources sought notice on FBO has failed to find another contractor who can provide a similar product.

VII. FAIR AND REASONABLE COST: The Montana Air National Guard (MTANG) has a requirement for using their iPads for night military aerospace operations. The NVIS case and filter are integrated and prevent damage due to normal wear and tear of flight operations. When not in use for night operations, the filters can be removed to allow for day operations. Three previously awarded contracts were reviewed for price fair and reasonable. The price paid for items was comparable to what other agencies purchased the items for.

VIII. MARKET SURVEY: Extensive market research has been conducted but fail to yield another contractor who provides a similar product that can be utilized in the manner necessary to facilitate the training required.

IX. OTHER FACTS: N/A

X. STEPS TO FOSTER COMPETITION: Cevians is the only known source for this particular item and is a proprietary source. However, This J&A and the resulting award will be posted in www.fbo.gov with the cognizant NAICS code for this type of product. Any manufacturer who does not yet offer an equivalent product will be able to see yet another purchase of this type from Cevians as a Sole Source and will be enticed to enter the market.

Document represents certification that the justification is accurate and complete to the best of his/her knowledge.

XII. TECHNICAL REQUIREMENTS/PERSONNEL CERTIFICATION: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
