IV. AUTHORITY: The statutory authority permitting other than full and open competition for this acquisition is 10
U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements; as implemented by Federal Acquisition Regulation Part 6.302-1. IAW FAR 8.405-6(a)(2), the award will be made for an item peculiar to one manufacturer and is essential to the Government's requirements, and market research indicates other companies' similar products do not meet, or cannot be modified to meet, the agency's needs at a reasonable cost.
V. APPLICABILITY OF AUTHORITY: Monaco is the only known source of these products who is known to meet the government's specifications. Award to any other company would not be feasible due to the current Monaco system in place. This is not a complete replacement of the Monaco fire suppression system, but an upgrade to existing equipment reaching the end of their respective lifestyle.
FAR 6.302-1(c) provides the use of brand name descriptions when the requirement can only be met by one brand name product.
VI. EFFORTS TO OBTAIN COMPETITION: Since Monaco Enterprises is the sole provider/distributer of Monaco systems, it would not be possible to obtain competition since this is the only product that will work with preexisting infrastructure.
VII. FAIR AND REASONABLE COST: The Montana Air National Guard (MTANG) has a requirement for the protection of aircraft when located in the Montana Air National Guard hangars. The current Monaco system provides such protection of assets. The price paid for items/services was comparable to what other agencies purchased the Monaco D-21 upgrade.
VIII. MARKET SURVEY: Extensive market research has been conducted but failed to yield another contractor who provides a similar product that can be utilized in the manner necessary to upgrade the Monaco system.
IX. OTHER FACTS: N/A
X. STEPS TO FOSTER COMPETITION: Monaco is the only known source for this particular item. However, This
J&A and the resulting award will be posted in www.fbo.gov with the cognizant NAICS code for this type of product. Any manufacturer who does not yet offer an equivalent product will be able to see yet another purchase of this type from
Monaco as a Sole Source and will be enticed to enter the market.
XI. CONTRACTING OFFICER’S CERTIFICATION: The Contracting Officer’s signature on the Justification Review
Document represents certification that the justification is accurate and complete to the best of his/her knowledge.
XII. TECHNICAL REQUIREMENTS/PERSONNEL CERTIFICATION: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
