Justification and Approval for Use of Other than Full and Open Competition

Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below:

1. Identification of Agency and Contracting Activity.

Department of the Navy, Office of Naval Research (ONR).

2. Nature/Description of Action.

ONR intends to issue a sole source contract to Transformation Systems Inc. (TSI) for virtual and onsite Leadership Effectiveness and Potential (LEAP) Training Workshop Modules, Balanced Score Card (BSC) training, and analytical support for the Office of Naval Research (ONR) Code 51. This will be a Firm Fixed Price contract awarded under FAR 13.5 Simplified Procedures for Certain Commercial Items.

TSI was awarded a sole source Purchase Order N00014-20-P-4009 on 04 August 2020 to provide LEAP Training Workshop Modules and BSC training/metric assessment to ONR. The period of performance was 04 August 2020 to 31 December 2020. The Purchase Order was awarded under authority FAR 13.106 ‘Only One Responsible Source’ with a total award value of $147,000.

3. Description of Supplies/Services.

This acquisition is for Leadership Effectiveness and Potential (LEAP) Training Workshop Modules.

LEAP is an assessment framework to identify strengths and development opportunities to become more personally, organizationally, and motivationally agile. The workshop format combines experiential learning, paired mentoring, group discussion, individual development and action planning. The LEAP modules consist of Personal and Organizational Assessments, Interactive Training and Development, Coaching/Mentoring, Balanced Score Card (BSC) training, and the LEAP training app. The LEAP workshop modules provide customizable training and analytical support in response to ONR’s BSC performance management tool, which was implemented by the Chief of Naval Research to improve process and personnel realignment.

The Office of Naval Research requires eighteen (18) LEAP training sessions with a capacity of twenty

(20) people per session, totaling 360 attendees. The training shall include a virtual and onsite option that allows full functionality and the caliber of onsite training provided by LEAP modules.

The period of performance for the action is twelve (12) months from date of award, with an estimated value of $441,000.00 of FY21 RDT&E funds.

The North American Industry Classification System (NAICS) is 611430 for Professional and Management Development Training, size standard $12M.

4. Identification of Statutory Authority.

The statutory authority for this action is 10 U.S.C. § 2304(c)(5), as implemented by FAR 6.302-5(b)(7) Authorized or Required by Statue, which specifically authorizes sole source contract awards under the Women Owned Small Business (WOSB) Program 15 U.S.C. § 637(m).

5. Identification of the Justification Rationale.

TSI is a WOSB that has previously provided ONR with a customizable COTS program that provided masteries useful to ONR management personnel in achieving personal, organizational, and motivational success. The LEAP BSC workshops and BSC metric assessments were tailored to meet ONR’s BSC framework requirements, therefore alternative training modules would not provide the level of expertise and insight that is required to ensure continuity from the initial trainings to future trainings. The components of the LEAP training requirement are critical as leadership continues to roll out and institutionalize the BSC training and utilization across the enterprise. ONR requires the continuation of this training in order to ensure the development and refinement of key ONR BSC activities and to include the interpreting of metrics, training and development opportunities that support the vision and mission of ONR and implementation of the BSC management framework.

The Small Business Administration has determined that WOSB firms are underrepresented in federal procurement for NAICS code 611430 assigned to this procurement. TSI (Cage: 1M7S9) is a Woman Owned Small Business (WOSB) and certified by the U.S. Small Business Administration (SBA) WOSB Program on 05 February 2021.

Based upon the market research, the Contracting Officer does not reasonably expect that there are two or more capable WOSBs that can meet this requirement.

The Government anticipates awarding a sole source contract to TSI on or before 22 April 2021.

6. Best Value Determination.

The Contracting Officer shall determine price reasonableness prior to award utilizing proposal analysis techniques described in FAR 15.404. Additional price discounts will be requested.

7. Description of Market Research.

A Notice of Intent to Award a Sole Source was posted to https://beta.sam.gov/ on 02 December 2020 and remained public for fifteen (15) days. The Notice of Intent stated ONR intends to issue a contract award to a single source under the authority of FAR 6.302-5(b)(7) Authorized or Required by Statue – Sole Source Awards under the WOSB Program.

One Interested Party, Technical Management Services (TMS), responded to the Sole Source Notice on 16 December 2020 and provided a Technical Capability Statement, which was evaluated by the Government. The Government concluded the capability statement did not provide sufficient information to determine if the company has expertise/capability in providing the required similar or equivalent Balanced Score Card (BSC) training. The component of the BSC training requirement is critical as leadership continues to roll out and institutionalize the BSC training and utilization across the enterprise.

TMS’s capability statement did not include detail of proposed virtual training could be hosted on a reliable platform that allows for the required attendance capacity and breakout rooms. The Government concluded TMS was not capable of meeting ONR’s requirements and an award to this company would result in potential risk and have an immediate and possible lasting negative impact on ONR meeting its mission requirements in a timely and consistent manner. No other capability statements were received by the closing date on 17 December 2020.

8. Statement of actions, if any, to remove barriers to competition in the future.

Additional sources and training components will be considered in the future if the agency has a continued need for this requirement.
