Part 4 Part 404, Chapter 3

Justification for Other Than Full and Open Competition

JUSTIFICATION AND APPROVAL

Justification for Other Than Full and Open Competition (FAR 6.3)

1. Contracting Agency and Activity. The Department of the Interior, United States Geological Survey, Reston Acquisition Branch, plans to contract by means other than full and open competition. This document sets forth the justification and approval for use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984.

2. Nature of Action Being Approved. New firm fixed price contract to purchase a Sorvall X4R Pro-MD Centrifuge with microplate carrier for the Eastern Ecological Science Center(EESC).

MFR Thermo Scientific, 2 Radcliff Rd, Tewksbury, MA. 01876-1182 USA

3. Description of Supplies or Services. A centrifuge that can be used in the harvesting workflow steps to separate or concentrate cells or cell component that has precise temperature control and accurate centrifugal speeds.

4. Estimated Dollar Value. $15,036.06

5. Statutory Authority. The proposed action may be awarded without full and open competition under 41 U.S.C. 253(c)(1) as implemented in FAR 6.302-1

6. Rationale Supporting Use of Citation in No. 5. Thermo Scientific uses the Auto-Lock Rotor Exchange system in their General Purpose Pro Centrifuges. This unique exchange system makes the rotors interchangeable between the centrifuges that operate on the same platform i.e., Sorvall series. Previous award 140G0121F0468($24,970.56) to Fisher Scientific Company L.L.C was to purchase a Sorvall X4R Pro-MD for the EESC. The benefit of purchasing Thermo Scientific General Purpose Pro Centrifuges is that all the rotors and associated components are compatible with the existing centrifuges at the EESC.

7. Other Information. There are no additional facts to be reported in this section.

8. The Efforts to Identify Additional Sources Including the Market Research Conducted.

A search on GSA Advantage found two established sources that offer the Sorvall X4R Pro-MD, GS07F161BA Fisher Scientific(o) and GS-07F-0636W Franklin Young International Inc.

(s)(d)(dv). SBA Dynamic Small Business Search showed that there are at least 3 small business that are listed as distributors for Thermo Scientific laboratory equipment, Genesis Enterprises, Tevet, LLC, and Franklin Young International Inc. A query on VetBiz for NAICS Code 334516- Analytical Laboratory Instrument Manufacturing found 13 Veteran Owned Small Business (VOSB) and 119 Small Disabled Veteran Owned Small Business (SDVOSB). A review of Thermo Scientific product literature, verified that the Auto-Lock Rotor Exchange System is unique to Thermo Scientific General Purpose Pro Centrifuges.

9. Future Plans to Permit Competition. The Government will continue to conduct thorough market research to gauge the marketplace capabilities for future requirements.
