(PR/SOL/CONTRACT #) 40569810/140A2322P0237
1. Contracting activity/agency. Department of the Interior, Bureau of Indian Education, Division of Acquisition, on behalf of the Bureau of Indian Education, NMNC Facility Management.
2. Description of supplies or services required to meet agency needs.
Pueblo Pintado Community School’s main school building 1729 has fan coil/heat pump units that are not working. Local maintenance and contractors cannot do the repairs as the units are not accessible. TRANE Technologies shall relocate the equipment to allow technicians to do repairs on the units. The Period of Performance shall be 60 days from the notice to proceed date. This work is needed for the health and safety of students, staff and the visiting public during the COVID 19 Pandemic.
The equipment needs to operate per manufacturers specifications to maintain good indoor air quality and provide thermal comfort of the occupants.
The estimated cost is: $124,231.00
3. Identification of the single source to be solicited.
(TRANE, POC: Jackie Putney, 5501 San Diego Ave, Albuquerque, NM 87113, Phone (505)-554-7969,).
4. Reason for authority cited. The contracting officer has determined the circumstances of the contract deem only one source reasonably available.
(Identify and include only one of the following).
☐Only one available source.
☒Urgency – The nature of the requirement has been deemed urgent and following competitive procedures would result in unacceptable delays.
☐Exclusive Licensing Agreement
☐Brand Name – The particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. If the justification is to cover only the portion of the buy which is brand name, then it should so state; the approval level requirements will then only apply to that portion.

5. Rationale.
New Mexico Navajo Central Agency Facilities Management has used the services to TRANE at other TRANE equipment installations and each time has provided excellent services. In the past, other local providers have been utilized by nearby schools which resulted in further damage and additional costs due to lack of knowledge regarding TRANE Proprietary Equipment. TRANE’s technicians perform their work in a professional manner and are technically competent. They are licensed to perform the level work required on the TRANE HVAC units and ancillary equipment to meet industrial code compliance and regulations. It is heating season now and the spaces are without heat and work needs to be completed as soon as possible for the thermal comfort and safety of the students and staff. Additionally, during the COVID 19 Pandemic, Supply Chains have been severely restricted in ability to provide replacement supplies, parts and equipment. TRANE has the necessary supplies, parts and equipment on-hand to complete this requirement and minimize any further unnecessary down time thus ensuring maximum safe heating and air ventilation will be provided in a timely manner during this Pandemic.
6. Market Research.
Market Research was completed within the area, but due to Proprietary programing and equipment, this has to be issued to TRANE. Trane has been providing emergency work on the HVAC equipment and has an existing service contract is responsive on short notice. The Trane Technicians are certified to work on HVAC equipment and have the replacement parts readily available and eliminating down time. No other company is certified to provide this level of service on the Trane equipment.
Under the authority of FAR 13.106-1(b)(1), the undersigned hereby determines the circumstances of this contract action deem only one source is reasonably available as supported herein.
