About this file

This is a Justification & Approval for Other Than Full and Open Competition document for a simplified acquisition under $250,000. The National Park Service (NPS), Yosemite National Park Utilities Branch, is procuring the rental of one 300kW diesel generator and fifty feet of associated cables for emergency power generation at the Wawona Tunnel along Highway 41. The generator must operate continuously 24/7 to sustain emergency radio communications at Turtle Back and provide essential tunnel lighting and ventilation fans. The vendor must deliver the generator fully fueled and transport it to and from the Wawona Tunnel. The delivery requirement is no later than 12:00 PM on Thursday, February 26, 2026 (PR Number 0044039401, dated March 3, 2026).

The justification for this non-competitive acquisition is based on urgent and compelling circumstances. A severe winter storm caused damage to three-phase overhead high-voltage electrical lines, resulting in complete loss of commercial power to the Wawona Tunnel. Loss of power compromises emergency communications capability, creates unsafe tunnel conditions lacking lighting and ventilation, and severely impacts NPS public safety responsibilities. Market research was not feasible due to the immediate, mission-critical nature of the requirement, and only the existing IDIQ vendor could meet the emergency, same-day delivery requirement with the exact generator specifications needed. No additional vendors were solicited because any delay would compromise public and employee safety. The document is signed by Katie Bablitch (Project Officer), Timothy D. Modjeski (Contracting Officer), and Eric Jordan (Warranted Individual 1 Level Above Contracting Officer).

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $10,000 ($2,000/$2500 for Construction/Services) AND

UP TO $250,000

(See FAR 13.106-1)

Date: March 3, 2026 PR Number: 0044039401

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): The National Park Service (NPS), Yosemite National Park Utilities Branch, requires the rental of one (1) 300kW diesel generator and fifty (50) feet of associated cables for emergency power generation at the Wawona Tunnel along Highway 41. The generator must operate 24/7 to sustain emergency radio communications at Turtle Back, and to provide continuous power to essential tunnel lighting and ventilation fans. The generator shall be delivered fully fueled and transported to and from the Wawona Tunnel by the vendor. Delivery is required no later than 12:00 PM on Thursday, February 26, 2026.

2. Sole Source Justification rationale (Check one and explain below):

______ Only one responsible source.

__X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other :

Explain: A severe winter storm caused damage to three-phase overhead high-voltage electrical lines, resulting in the complete loss of commercial power to the Wawona Tunnel. Emergency communications and life-safety systems rely on immediate restoration of power. The tunnel lighting and ventilation fans are critical to visitor and employee safety, and the communication infrastructure at Turtle Back must remain operational.

Failure to meet the required delivery and performance timelines would result in:

• Loss of emergency communications capability.

• Unsafe tunnel conditions lacking lighting and ventilation.

• Severe operational impact to NPS public safety responsibilities.

Due to hazardous winter conditions, the area is currently inaccessible for full damage assessment, and continuity of operations cannot be maintained without immediate generator rental.

The need was identified promptly upon detection of storm damage and loss of power.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

Market research was not feasible due to the immediate and mission-critical nature of the requirement.

The Government determined that only the existing IDIQ vendor could meet the emergency, same-day delivery requirement and provide the exact generator power rating and cable configuration required for 24/7 operations at Wawona Tunnel.

No additional vendors were solicited because any delay would compromise public and employee safety.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
