BIA Office of Justice Services IDIQ - Adjudication Services

Statement of Work

1. Background

The Bureau of Indian Affairs (BIA), Office of Justice Services (OJS) has a requirement to solicit at a minimum of 3 firms, depending on availability, to Small Native American owned for Adjudication services for tribal law enforcement programs. This effort will provide background investigations to the tribes whose adjudication services are a part of Bureau of Indian Affair’s requirement pursuant to the Tribal Law and Order Act (TLOA).

OJS’s mission is to provide justice services and technical assistance to federally recognized Indian tribes and communities, and to respect and protect sovereignty through promotion of self-determination. In order to execute TLOA requirements, contractor support is needed to assist OJS in implementing its requirements in a timely and coordinated effort, and in fulfilling strategic directives and methodologies as approved by senior management and pursuant to TLOA.

2. Requirements

In general, the Offerors shall provide all management, administrative, and technical support, expertise, labor, all materials, supplies and equipment (except as otherwise specified herein), necessary to plan, schedule, coordinate, and carry out the requirements. An IDIQ (Indefinite Delivery-Indefinite Quantity) will be issued for this requirement. OJS anticipates one Award for these Adjudication Services. The IDIQs will be open to

BIA/OJS only, meaning, only BIA OJS, with approval by the COR (Contracting Officers Representative) and CO

(Contracting Officer), will issue orders under this IDIQ. Offerors must hold a valid license and be bonded with an insurer.

Estimated total quantity per 12-month period is 25 individual adjudication requests. The maximum quantity per 12-month period is 50 individual adjudication requests.

3. Scope of Work

Offerors must have experience with adjudication processes. Offerors must also have experience in obtaining favorable/unfavorable background adjudications using a set of pre-described standards. The Offerors must be able to identify derogatory factors, have an administrative mechanism in place to conduct inquiries to obtain mitigating information from the subject. The Offeror will issue a case summary report of adjudication and a suitability certification for individuals who meet eligibility requirements. If the subject does not meet eligibility requirements the contactor will provide a summary report of final adjudication citing the reasons why the subject failed to meet the statutory requirements for a favorable background determination. Offerors must also be knowledgeable, but are not limited to the following:

Tribal Law and Order Act (TLOA)

4. Responsibilities

The contractor will provide a monthly report to BIA OJS on the status of adjudications. Before conducting the background adjudications, the contractor must have a release from the individual to conduct the investigation. Contractors must be in compliance with the requirements and statutes that are established for a specific position. The contractor must document, use professional judgment and review the consideration of all of the available facts. The contractor must provide a written formal recommendation for either a favorable determination or an unfavorable determination for an individual’s background. Contractors must also provide a written report indicating the individual’s risk of abuse of the public trust in carrying out assigned duties.

Contractor requirements:

A. Prior to conducting the background adjudication screening, the Contractor shall obtain a signed statement from the individual which authorizes the investigation.

B. The Contractor shall process and produce favorable/unfavorable background adjudication service using a set of pre-described standards.

C. The Contractor shall provide a written formal recommendation for either a favorable determination or an unfavorable determination.

D. The Contractor shall identify the derogatory factors.

E. The Contractor shall have an administrative mechanism to conduct inquiries to obtain mitigating information from the subject.

F. When applicable, the Contractor shall include in the written report the tribal employee's risk of abuse of the public trust in carrying out assigned duties.

G. When applicable, the Contractor must be in compliance with the requirements and statutes that are established for a specific position.

H. The Contractor shall issue a case summary report of adjudication and a suitability certification for individuals who meet the eligibility requirements. If the individual does not meet the eligibility requirements, the Contactor shall provide a summary report of final adjudication citing the reasons the individual failed to meet the statutory requirements for a favorable determination.

I. The Contractor shall provide a monthly report to the BIA OJS COR on the status of adjudications.

J. The Contractor shall immediately notify the BIA-OJS Point of Contact in a reasonable and timely manner if the contractor gets backlogged and is unable to meet the delivery schedule on any adjudication. Additionally, the Contractor shall provide the reasons for the backlog and a timetable for the resolution of the backlog.

K. The Contractor may have to testify before a court hearing when deemed appropriate.

5. Quality Assurance

The Contractor's performance and the quality of timely services provided hereunder shall be subject to final inspection and acceptance by the Contracting Officer in conjunction with the Contracting Officer

Representative (COR). The COR shall conduct periodic performance reviews to ensure the accuracy and timeliness of adjudications meet the performance standards for OJS.

6. Period of Performance

The period of performance of this IDIQ shall be from award date through 12 months (2017) with 4 option year periods. It is at the Government discretion to exercise the option periods, if the Government choses to exercise an option period, it will be exercised by contract modification requiring the signature of both parties, Option periods are as follows:

Option Period One: 2017 to 2018

Option Period Two: 2018 to 2019

Option Period Three: 2019 to 2020

Option Period Four: 2020 to 2021

7. Deliverable Schedule

The contractor will notify BIA-OJS in a timely manner if for some reason, the contractor gets backlogged on adjudications. The contractor will provide a reason for the backlog and a timetable for a solution to the backlog.

8. Place of Performance

The contractor shall perform the contract services at the contractor’s facility.

9. Travel

Travel is not authorized or required in the performance under this IDIQ. If contractor testimony is required in person at the court facility, authorization must be provided by the COR and Federal Travel Regulations will be utilized.

10. Non-Disclosure Information

In addition to the requirements of this IDIQ, the contractor agrees by performing this effort that all associated personnel agree not to disclose any data or information related to this effort without the prior approval of the

COR and the CO. This certification should be incorporated into the contractor’s proposal and must be signed by all personnel performing under this effort.

11. Rates

All prices are firm-fixed price. All Rates shall be proposed as fully loaded. Escalation formulas used by the

Offeror in developing Option Year Rate escalations shall be submitted with details. The government shall pay for all out of pocket disbursements incurred in the direct connection with the performance of this contract, such as: fees for state repository checks, local law enforcement checks, and/or court record searches.

Contractor shall provide monthly report and copies of the supporting documentation to verify all itemized expenses.

12. Hours of Work

The work hours are assumed to be the typical work hours governing a standard business work day, i.e. 8/9 hours between the hours of 8:00 am and 6:00 pm, Monday – Friday.

The following Legal Holidays are observed under this contract:

New Year's Day 1 January

Martin Luther King's Birthday Third Monday in January

President's Day Third Monday in February

Memorial Day Last Monday in May

Independence Day 4 July

Labor Day First Monday in September

Columbus Day Second Monday in October

Veterans Day 11 November

Thanksgiving Fourth Thursday in November

Christmas Day 25 December

13. Invoicing

The contractor shall submit the original invoice(s) and itemized listing monthly to the Internet Payment

Platform System (IPP). http://ipp.gov

14. Option to Extend the Term of the Contract 52.217-9

The Government may extend the term of this contract by written notice to the Contractor within 30 days;

provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least

60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

If the Government exercises this option, the extended contract shall be considered to include this option clause. The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6 months.

15. Option to Extend Services 52.217-8

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 45 days.

16. Contract Type

This requirement is solicited as a Firm-Fixed priced IDIQ. Task orders will be firm fixed-price. Task orders may be issued by an authorized BIA Contracting Officer.

A Task order shall have a minimum of one (1), individual adjudication request.

Task orders shall have a maximum of twenty (20) individual adjudication requests. The period of performance of Task Orders may overlap based on the need of the request office/BIA-OJS.
