About this file
This is a Justification & Approval for Other Than Full and Open Competition document for a simplified acquisition under FAR 13.106-1. The document authorizes a limited-source procurement for emergency boiler replacement at the Lodgepole Visitor Center, dated March 4, 2026, with an Independent Government Estimate of $117,480.
The procurement is justified under "urgent and compelling circumstances" rather than sole source. The Lodgepole Visitor Center, located at 6,700 feet elevation, experienced failure of its second hydronic boiler on February 17, 2026, with the remaining operational boiler found to be leaking and in imminent danger of failure on February 25, 2026. Without immediate replacement, the facility faces catastrophic freeze damage to plumbing and hydronic systems, structural damage from prolonged sub-freezing exposure, forced closure of the visitor center, severe operational impacts to on-site administrative and law-enforcement offices, increased fire risk from portable electric heaters, and degraded emergency response times. Market research confirmed that no other manufacturer produces direct replacements compatible with the existing installation and that competitive procurement timelines would unacceptably increase the risk of building damage and facility shutdown. The procurement specifies two Laars NeoTherm NTH-285PXX3 boilers as the only units that integrate directly with existing gas, venting, hydronic, electrical, and control systems. The document was signed by Kip Shaw (Project Manager) on 03/05/2026, Timothy Modjeski (Contracting Officer) on 04/21/2026, and Eric Jordan (Warranted Individual 1 Level Above Contracting Officer) on 04/21/2026.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR
Part 2) UP TO SAT (See FAR 13.106-1)
Date: _March 4, 2026_________________ PR Number: _TBD___________________
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
On February 17, 2026, the Lodgepole Visitor Center became aware that the second of its two hydronic boilers had failed. Subsequent inspection on February 25, 2026, revealed that the remaining operational boiler was leaking and in imminent danger of failure. Both existing units are Teledyne Laars NeoTherm NTH-285PXX3 boilers
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
__X___ Urgent and compelling circumstances exist.
______ Other
Explain:
The facility is located at 6,700 ft elevation, where winter temperatures routinely fall into the teens and twenties. Without immediate heating capability, the building faces a serious and imminent risk of:
• Catastrophic freeze damage to plumbing and hydronic systems
• Structural damage to the facility due to prolonged exposure to sub-freezing temperatures
• Forced closure of the Lodgepole Visitor Center for an extended period
• Severe operational impacts to administrative and law-enforcement offices located on-site
• Significant increase in fire risk if staff must rely on portable electric heaters
• Degraded emergency response times if staff must be relocated
The Government therefore requires immediate replacement of both failed units to prevent high-value asset loss and interruption of essential park operations.
The Independent Government Estimate (IGE) for replacement under a construction contract is $117,480, and the period of performance must begin as soon as materials and a qualified contractor can be secured.
Under FAR 13.106-1(b)(1)(i), these circumstances constitute a valid Urgent and Compelling justification.
Market research was conducted to identify alternate boiler makes or models. No other manufacturer produces a direct replacement compatible with the existing installation, and no alternative units were identified that could be integrated without significant reconfiguration
The existing boilers are Laars NeoTherm NTH-285PXX3 units, and replacing them with the same model is required because:
• They are the only known units that integrate directly with existing gas, venting, hydronic, electrical, and control systems.
• Using any other manufacturer would require extensive redesign, modifications to mechanical, electrical, venting, and control systems, and additional commissioning delays.
• Redesign and reinstallation time would significantly increase the risk of building damage, contradicting the urgent-action requirements described above.
• A brand-name replacement minimizes downtime, reduces installation complexity, and ensures compatibility with the remaining components of the hydronic system.
A review of qualified contractors in SAM revealed several capable installers; however, the time required for a competitive procurement would greatly increase the risk of additional building damage, system failure, and facility shutdown.
Thus, a brand-name, limited-source procurement for two (2) Laars NeoTherm NTH 285PXX3 boilers is justified to prevent unacceptable delays and ensure immediate system restoration.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
A review of other manufacturers’ comparable equipment was performed that did not reveal any direct replacements to the Laars NeoTherm NTH-285PXX3 for integrability to the existing installation. A review of qualified contractor registrations in SAM shows several available, however the time needed to advertise for a contract will greatly increase the risks of loss to the government if we proceed to open competition.

4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
