About this file
This is a Sole Source Justification memorandum for a $15,370.38 purchase order to acquire Geological and Geophysical (G&G) Data from TGS under Purchase Request No. 0044006721. The Bureau of Ocean Energy Management (BOEM) requires this data as part of its Resource Evaluation Program to develop maps identifying areas favorable for hydrocarbon accumulation and determine fair market values for offshore lease areas.
The justification establishes TGS-NOPEC Geophysical Company as the only viable source for this proprietary data, which was collected through specific permits issued to the company. The period of performance is 30 days after receipt of order. The procurement falls under NAICS code 541360 (Geophysical, Surveying and Mapping) with a small business size standard of $28.5M. No notice of intent to sole source was required as the action is under $25,000. The data will support BOEM's responsibilities in evaluating offshore leases, ensuring conservation and diligence of resource development, assuring safe operations, and estimating public resources and reserves volumes.

specifically, the OCS Lands Act at Code of Federal Regulation (CFR) 551.11, 551.12, and
551.13, to provide the Department of the Interior access to and copies of certain G&G data and information pursuant to exploration, development, or production of oil and gas as well as establishing reimbursement criteria.
All data that BOEM will be obtaining are proprietary to the permittees and operators addressed above and are only available from those unique sources. The acquisitions to secure the reproduction of the data needed are not available for competition. This is because the data are a result of the issuance of permits to a specific company and are located in unique positions specific to that permit and not related to other permitted areas. The OCS Lands Act, as amended, CFR, and Federal Acquisition Regulation (FAR) provide the statutory authorities for acquiring the data on a noncompetitive basis.
The period of performance for this Purchase Order shall be 30 days after receipt of order, with an estimated total price of between $15,000 to $16,000, which is provided under requisition
0044006721.
In accordance with FAR 13.106-1(b) there is only one responsible source, and no other supplies will satisfy the agency’s requirements. For this requirement only, the TGS-NOPEC Geophysical
Company is the only vendor that exists that has access to this data. In accordance with FAR
5.101(a)(1), a notice of intent to sole source was not required as the action is not expected to exceed $25,000.
I certify that this justification in accordance with FAR 13.106-1(b) is accurate and complete to the best of my knowledge and belief.
