About this file

This is a Single Source Justification form (FWS Form 3-0034) submitted by the U.S. Fish and Wildlife Service for a sole source acquisition under the Simplified Acquisition Threshold (SAT).

The U.S. Fish and Wildlife Service is procuring acoustic transmitters from Innovasea as a single source manufacturer for an order totaling $204,501.75. These acoustic transmitters will be implanted in endangered juvenile fish to track movement and survival over 15-30 months as a continuation of a multi-year study (year 3) that has provided high-resolution movement and survival data for the endangered species. The justification for sole source acquisition is based on continuity requirements; the project has used Innovasea equipment since its initiation in 2024, and transitioning to an alternative vendor would introduce new variables, calibration differences, and data drift that would compromise data integrity standards and comparability across years. Additionally, switching vendors would pose significant risk to the established multi-year study design and could result in data corruption or loss, potentially requiring replacement of the 80+ receiver array at a cost exceeding $1 million. Innovasea uses proprietary encrypted protocols for data security and has provided specialized equipment specification and deployment design unique to this project and geography over more than two years of involvement. No market research was conducted due to the continuation nature of the work, and no other capable sources were considered acceptable. The cost was determined as fair and reasonable as the single available source for necessary supplies. The justification was certified by Program Officer McKenzie Wasley on April 14, 2026, and approved by Contracting Officer Solmaz Salih on June 3, 2026.

3. Other Capable Sources

2. Market Research Conducted

Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Instructions: The information in the text boxes are provided as sample language or to indicate a needed fill-in. Sample language should be removed from the final document. All text boxes require information and shall not be left blank.

Based on the above justification, I hereby certify and approve the use of sole source acquisition procedures under FAR Part 13 for this purchase.

Contracting Officer

Text3: Because this is a continuation of previous work with endangered species using Innovasea technology, no other capable sources were considered acceptable.
Text2: No market research was conducted because this is a continuation of a work that has used Innovasea equipment since the initiation of the project in 2024. The integrity of this long-term research depends on the continuity of existing methodologies for transmitter functionality testing and implantation as well as standardized data collection and data cleaning protocols.
Text1: The objective of this acquisition is to secure Innovasea as the single source manufacturer for an acoustic transmitter order totaling $204,501.75. These acoustic transmitters will be implanted in endangered juvenile fish to track movement and survival for 15-30 months using a grid-array of Innovasea receivers. This acquisition is for the continuation of this study (year 3), which has provided the highest resolution movement and survival data bi-annually for this endangered species to date. Data that is high resolution and quickly accessible is essential to making timely and informed management decisions pertaining to an endangered species nearing extinction and satisfies a critical data gap in the recovery efforts for the species.
Text4: Transitioning to an alternative vendor would introduce new variables and calibration differences, resulting in data drift that would complicate the comparability between years and compromise USFWS's data integrity standards. The introduction of new technology in this established multi-year study design, poses a significant risk to this project, increasing the chances of data corruption or loss during the limited window of observation and possibly requiring the replacement of the 80+ receiver array (>$1million).

The subjects of this research are endangered fish species nearing extinction. The individuals required for this project represent a significant investment of time and resources, as they take three to five years to reach the necessary size for this study. Any failure or interruption in data collection due to technological incompatibility or vendor transition would result in the irretrievable loss of data. This loss would not only delay the project by several years but would also compromise the management agency's ability to make timely, informed decisions.

Text6: The cost is fair and reasonable from this source as it is the single source that provides the necessary supplies.

Text5: Innovasea uses proprietary encrypted protocols to ensure data security and accuracy. Continuing with Innovasea as the single source technology manufacturer provides a consistent baseline for the project's multi-year dataset as well as continuity in customer service. They have been involved in this project for over two years and have assisted with optimizing equipment specification and deployment design unique to this project and geography.
