About this file

This document is a Justification & Approval for Other Than Full and Open Competition (JOFOC) for a simplified acquisition over the micropurchase threshold up to the Simplified Acquisition Threshold.

The National Park Service at Lava Beds National Monument has a requirement to install fiber optic cable to improve connectivity between buildings at their headquarters complex, replacing obsolete CAT 5 cable. The project is critical for continued connectivity at the park's administrative facilities, including headquarters, operations, maintenance, and fire operations. The anticipated cost is $65,000. A sole source award to Cal Ore is justified as they are the only local company with the capacity to install the fiber optic cable, are the current IT service provider familiar with the existing conduits, and the fiber optic lines are proprietary to the installing company. Awarding to Cal Ore would be the most efficient approach to complete the project without requiring replacement of the entire IT network.

This JOFOC is related to a Special Notice for the fiber optic cable installation, which is being issued under simplified acquisition procedures and other than full and open competition. Interested vendors are requested to submit contact information and capabilities by August 24, 2024, but this is not a request for competitive proposals. The North American Industry Classification System (NAICS) code is 237130 with a $45 million small business size standard.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Part 2) UP TO SAT

(See FAR 13.106-1)

Date: May 6, 2024

PR Number: 0040662753

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Install Last Mile fiber optic cable for improved connectivity between buildings at the LABE Headquarters complex. Buildings include Headquarters, Operations, Maintenance and Fire Building. This replaces obsolete CAT 5 cable and end equipment. Fiber will be installed in existing conduit, with a limited addition of new conduit. In buildings, Fiber will be installed in either pvc conduit, flexible metallic conduit or electrical metallic conduit to protect against rodents and other damage. This project is critical for continued connectivity at the park administrative complex which includes: Facilities, Integrated

Resources, Fire Operations and emergency operations center, and park headquarters.

The project is WASO funded for $65,000.00.

2. Sole Source Justification rationale (Check one and explain below):

X Only one responsible source:

Urgent and compelling circumstances exist, ______ Other _____________________________________________________

Explain:

Cal Ore is the only local company that has the capacity to install fiber optic cables in the vicinity of Lava

Beds National Monument (LABE). Cal Ore is the current IT service provider for LABE, so they are familiar with the pre-existing conduits, and their locations within the buildings at the HQ Complex.

Additionally, fiber optic lines are proprietary, meaning the company that installs them can only use their own IT connectivity. If a company other than Cal Ore were to install fiber optic cables at the HQ

Complex at LABE, the entire IT network would have to be replaced, so that the fiber optic lines would be compatible with the different contractor. This would not only delay the fiber optic installation, it would increase the expenditure for this project, by adding unnecessary work. A sole source award to Cal Ore would be efficient as they are the current provider for the system. They provide, own, and operate the main microwave link that supplies internet, data, and phones to the park. Cal Ore also provides and operates internal point to point (PTP) wireless connection between the Visitor Center and HQ complex at

LABE. Cal Ore is the only company with such intimate knowledge of the entire internet, data, and VOIP phone system. Without the IT system properly functioning at LABE, the park would in essence shut down, as there would be no internet, data, or VOIP phone system to carry on with daily operations.
