About this file

This is a Limited Sources Justification form from the U.S. Fish and Wildlife Service (FWS) for procuring SkyMira satellite push-to-talk radio and GPS tracking services for law enforcement vehicles in the Southwest Region. The procurement will utilize the existing Bureau of Land Management (BLM) Law Enforcement Communications Center (FLECC) infrastructure, with services providing reliable vehicle tracking and two-way communication in remote areas where cellular service is unavailable. The contract includes a one-year base period with four optional one-year extensions, totaling five years, with an estimated annual cost of $70,000 and a total potential value of $350,000.

The justification is based on FAR 8.405-6(b)(1) for items peculiar to one manufacturer, as market research indicates SkyMira is the only vendor capable of meeting the agency's specific technical and operational requirements. The services are already integrated with existing systems, and replacing SkyMira would likely disrupt continuity and require new hardware or cause technical incompatibilities. The procurement directly supports the FWS mission under the Fish and Wildlife Act of 1956, with the agency noting that awarding the contract directly will save approximately $14,000 annually in indirect fees.

FWS Form 3-0058 (Rev. 5/2024) U.S. Fish and Wildlife Service

Limited Sources Justification

JOINT ADMINISTRATIVE OPERATIONS

Acquisition Operations

In accordance with FAR 8.405-6, the Contracting Officer may restrict consideration of sources for orders placed or BPAs established under Federal Supply Schedules (FSS) under the condition that the restricted consideration be justified in writing.

Instructions: The information in the text boxes are provided as sample language or to indicate a needed fill-in. Sample language shall be removed from the final document. All text boxes require information and shall not be left blank.

1. Agency and Contracting Activity:

Department of the Interior, U.S. Fish and Wildlife Service (FWS), Joint Administrative Operations, Acquisition and Property Operations.

2. Nature and/or Description of the Action Being Approved:

This This request is to authorize the Division of Refuge Law Enforcement – Southwest Region to procure SkyMira satellite push-to-talk radio and GPS tracking services for law enforcement vehicles, utilizing the existing Bureau of Land Management (BLM) Law Enforcement Communications Center (FLECC) infrastructure.

SkyMira’s satellite-based services provide reliable, near real-time vehicle tracking and two-way communication capabilities in remote and rugged areas where traditional cellular service is unavailable.

The system enhances officer safety, supports mission-critical situational awareness, and improves operational coordination. Key features include GPS-based vehicle location monitoring nationwide, push-to-talk satellite communication, and secure access to live data through a web-based portal.

This action directly supports the mission of the U.S. Fish and Wildlife Service under the Fish and Wildlife Act of 1956 (16 U.S.C. § 742e), which authorizes the Service to protect wildlife resources and conduct necessary law enforcement operations. By partnering with BLM through the FLECC program, the Division benefits from interagency standardization, streamlined procurement, reduced implementation costs, and shared program management resources.

3. Description of the Supplies or Services Required to Meet the Agency’s Needs (including estimated value):

No hardware or equipment is needed, as everything required is already in place and currently in use under an existing agreement.

The requested procurement is for SkyMira satellite push-to-talk radio and GPS tracking services, which support law enforcement operations. This new contract would replace the current agreement to ensure continued, uninterrupted service. The contract includes a one-year base period with four optional one-year extensions, totaling five years if all options are exercised. Services are provided on a per-user basis, with an estimated annual cost of $70,000 and a total potential value of $350,000 over the full contract term.

4. a. Authority Cited (Select One):

☐ FAR 8.405-6(a)(1)(A) – “An urgent and compelling need exists, and following the procedures would result in unacceptable delays.”

☐ FAR 8.405-6(a)(1)(B) – “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.”

☐ FAR 8.405-6(a)(1)(C) – “In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule (FSS) order provided that the original order was placed in accordance with the applicable FSS ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.”

☒ FAR 8.405-6(b)(1) – Items Peculiar to One Manufacturer. “The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.”

b. Supporting Rationale:

-SkyMira services are already in use and integrated with existing systems (e.g., BLMs FLECC platform).

-The requirement is not for new or generic satellite communication services but for a specific configuration and compatibility with infrastructure already in place.

-Replacing SkyMira with another provider would likely disrupt continuity, require new hardware, or result in technical and operational incompatibilities.

-If market research shows that no other vendor can provide the exact required integration, this clause supports the justification.

5. Best Value Determination:

This procurement request is determined to be fair and reasonable based on similar previous awards.

6. Market Research:

Market research was conducted at the time the agency initially selected SkyMira, and no other vendors were identified that could meet all the agency’s technical and operational requirements. These requirements included full compatibility with the Bureau of Land Management (BLM) Law Enforcement Communications Center (FLECC) system, reliable satellite-based push-to-talk voice communication, and real-time GPS tracking services in remote areas with no cellular coverage.

As part of the current procurement planning, the agency revisited the market research and again found no other vendors capable of providing the full range of required services with the necessary system integration, reliability, and performance. SkyMira remains the only known vendor able to meet all operational needs without requiring new hardware, retraining, or disruption to existing communications infrastructure. Therefore, SkyMira is still the only vendor identified that can fully meet the agency’s requirements.

7. Any Other Facts Supporting the Justification:

Completing this justification and awarding the contract directly will save the program approximately $14,000 annually in indirect fees that would otherwise be incurred through existing interagency agreements. By leveraging an established system with no need for additional equipment, training, or integration, this approach ensures continuity of operations while achieving meaningful cost savings for the agency.

8. Statement of Actions to Remove Barriers:

No prior awards have been made using full and open competition for these specialized services. This is a limited field, and market research shows SkyMira is the only vendor meeting all technical and integration requirements. Due to this, competition is currently impractical. The agency will continue to monitor the market and consider competition if viable for future acquisitions. No additional barriers to competition are anticipated currently.
