About this file

This sole source justification document identifies the need to overhaul centerline and carriage winches on US Coast Guard cutters. The US Coast Guard requires overhaul services for right-hand and left-hand carriage winches, centerline winch, and sheave assemblies installed on its Sentinel-class cutters. These components were designed and manufactured by SLM, which is the original equipment manufacturer and only party possessing necessary technical data and expertise to perform the overhaul in accordance with specifications. The Coast Guard conducted market research including a sources sought notice from January to February 2022 but received no responses indicating other potential offerors. Given the proprietary nature of data and SLM's unique qualifications and position as OEM, this non-competitive award is justified under FAR authority for sole source acquisitions when only one responsible source is available to meet agency requirements. The contracting officer determined the anticipated price from SLM to be fair and reasonable based on comparisons.

4. An Identification of the statutory authority permitting other than full and open competition.

This is sole source acquisition conducted under the authority of FAR 6.3 02-1 -- Only One Responsible

Source and No Other Supplies or Services Will Satisfy Agency Requirements. 41 U.S.C. 3304(a)(l).

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

The SLM Right-Hand (RH) and Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies are used on the WMSL fleet. SLM is the Original Equipment Manufacturer (OEM) of the

Right-Hand (RH) and Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies.

The WMSL Right-Hand (RH) and Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies operate on specific standards that were designed, engineered, and tested by OEM.

Operational capabilities and crew safety rely on a properly working Right-Hand (RH) and Left-Hand

(LH) carriage winches, centerline winch, and sheave assemblies. If the Right-Hand (RH) and Left

Hand (LH) carriage winches, centerline winch, and sheave assemblies were to operate improperly it could cause injury or harm to cutter personnel, cutter, small boat or civilians.

All technical information for the existing Right-Hand (RH) and Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies is proprietary to the OEM and is unavailable to allow the government to evaluate alternative parts or competitively procure alternative parts. The alternative parts are not known and may not be easily determined. The acceptance of alternative parts is unacceptable and may result in excessive cost to the Government, reduced reliability, reduced safety, and may hamper the Coast Guard mission requirements. Winch or sheave assembly failure would undoubtedly result in a major degradation of the ship's ability to perform its mission, small boat operations are part of the WMSLs primary missions.

The U.S. Coast Guard does not possess the necessary drawings and specifications that would enable another vendor to manufacture any of the parts. The scope of manufacturing, tolerances, specifications, repair & overhaul procedures, equipment and special tools required to manufacture & repair these parts is unknown. Without adequate data, the Coast Guard is not capable of evaluating equal or alternative parts manufactured by other than the OEM. The use of OEM parts and technical expertise will ensure components and repair & overhaul processes are sufficient to enable physical and functional interchangeability with the existing Right-Hand (RH) and Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

In accordance with FAR Subpart 5.203, a synopsis was posted by USCG on SAM.Gov website from

30 May 2023 to June 15 2023. This requirement was posted in the USCG Acquisition Planning

Forecast System (APFS) on 8 February 2022. In an effort to solicit as many potential sources as practicable, a Sources Sought Notice was posted by USCG on SAM.Gov website from 11 January

2022 to 25 January 2022. This notice informed the industry of the USCG's intent to purchase SLM

Right-Hand (RH) and LeftHand (LH) carriage winches, centerline winch, and sheave assemblies currently installed on the WMSL fleet. Other organizations having the expertise and required capabilities to provide equivalent parts were invited to submit information discussing such capabilities within six (6) calendar days after the posting date. The notice yielded no responses.

Solicitation No. 140D0423Q0595

The OEM was able to confirm there are no authorized distributors for SLM Right-Hand (RH) and

Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies currently installed on the WMSL fleet.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on comparisons with the Independent Government Estimate (IGE), market research, including searching pricing information on the internet, and historical pricing for similar USCG parts.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

In addition to the sources sought notice posted to SAM.gov, the COR contacted the OEM for a list of qualified repair facilities. SLM confirmed there are no authorized repair facilities other than OEM.

Internet/Industry Contact - The results of the internet research and industry contact revealed that SLM is the contractor identified as being the OEM, possessing the necessary technical data, drawings, manufacturing data, specifications, and purchase tolerances.

9. Any other facts supporting the use of other than full and open competition.

This requirement cannot be modified to enhance competition as all technical information for the existing

Right-Hand (RH) and Left-Hand (LH) carriage winches, centerline winch, and sheave assemblies is proprietary to the OEM. The Government will be harmed if repair services are not performed by the OEM and may result in excessive cost to the Government, reduced reliability, reduced safety, and may hamper the Coast Guard mission requirements. Winch or sheave assembly failure would undoubtedly result in a major degradation of the ship's ability to perform its mission, small boat operations are part of the

WMSLs primary missions.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

A sources sought notice was posted by the USCG on sam.gov on 11 January 2022 requesting that parties express their interest in writing to the Contracting Officer. No responses were received from the sam.gov posting.

Prior to the sources sough notice, an email from SLM was received by the USCG stating their qualifications and they responded that they would not release any manufacturing, drawings, specifications, or related technical data necessary for accomplishing the parts required for the current

Right-Hand (RH) and Left- Hand (LH) carriage winches, centerline winch, and sheave assemblies currently installed on the WMSL fleet.

Based on responses received and the proprietary nature of the required technical data, the Contracting

Officer has determined that SLM is the only vendor capable of satisfying this requirement.
